Wyoming Street into nine residential lots and one outlot, along with a request for a variance of minimum lot width and area requirements; and WHEREAS, the appropriate City departments have reviewed the plat and found that it meets the requirements of Chapter 67 of the Zoning Code; and WHEREAS, notice of a public hearing before the City Council was duly published in the official newspaper of the City and notices were mailed to each owner of affected property including all property in St. Paul situated within 350 feet of the subject property; and WHEREAS, the City Council held a public hearing on the proposed preliminary plat on February 28, 2001, where all interested parties were given the opportunity to be heazd and the Council considered all the facts and recommendations concerning the plat; NOW, THEREFORE, BE IT RESOLVED, that the City Council accepts and approves the attached final plat for Walnut Ridge at 468 E. Wyoming Street, including approval of the applicanY s request for a variance of minimum lot area and width xequirements to allow all nine residential lots to be less than 50�0 sq. ft. in azea, foux of the lots to be 39 feet wide, and one lot to be 35 feet wide, subject to the condiuon that the applicant shall file a copy of the Council Resolution approving the plat with the Ramsey Counry Recorder's Office. PARCEL SIZE: 47,426 SF (1.089 acre) EXISTING LAND USE: One single-family house. D. SURROUNDING LAND L Lafayette Freeway boarders the site on the east. There are two duplexes to the north across Wyoming Street. Riverview Cemetery and one single-family house are to the west. The site slopes up to the south to unimproved Annapolis St. and West St. Paul. E. ZONING CODE CITATION: §67.301 states that platting is required when a subdivision creates five or more lots. §67.406 gives criteria for the review of subdivision applications. These criteria are covered belo�ti• under "Required Findings." §67.703 provides for the City Council to grant variances to the subdivision regulations. F. HISTORY/DISCUSSIO\: On January 22, 2001, the Board of Zonin� Appeals (BZA) approved several front and rear yard setback and lot coverage variances for construction of nine ne« houses on this site, subject to the condition that the alley bisecting the parcel and Annapolis Sheet are vacated. The BZA approval of the variances has been appealed. A Ciry Council public hearing on the appeal is being held on February 28, 2001, on the same agenda as the public hearing on this plat. G. DISTRICT COU1\TCIL RECOMMENDATION: On January 17, 2001, the Building and Land Use Committee of the West Side Citizens Organization voted "against supportine the variances • and subdivision at this time" and encouraged the applicant to meet with concerned neighbors to see if their concerns can be resolved. REQIJII2ED FINDINGS: § 67.406 of the Zoning Code requires that a11 of the following findings shall be made prior to approval of a subdivision: All the applicable provisions of the Legislative Code are complied wiEh. Petitions have been filed for the necessary vacation of a portion of Annapolis Street and the alley bisecting the site. A minimum area of 5000 SF and a minimum width of 40 ft. is required for each lot. Variances are required for the following proposed lot areas and lot widths: Lots 1, 2& 3: 3126 SF Lot 4 3224 SF Lot 5 3120 SF Lot 6 4621 SF Lot 7 4860 SF Lot 8 3609 SF Lot 9 3199 SF 39 ft. wide 35 ft. wide 39 ft. wide 39 ft. wide • Subject to City Council approval of vacation of the necessary portions of Annapolis St. � and the alley bisecting the site and subject to City Council approval of necessary variances of lot area and width requirements as part of approval of this plat, the proposed plat ts in compliance with a11 appticable provisions of the Legis2ative Code. 2. The proposed subdivision will not be detrimental to present and potential surrounding land uses. All land intended for building sites can be used safely without endangering residents by peril from floods, erosion, confinuously high water table, severe soil conditions or other menace. The site and grading plans are designed to meet this requirement. The subdivision can be economically served with public facilities and services. The subdivision can be economically served with public facilities and services from Wyoming Sh VARIANCE FINDINGS: §67.703 of the Zoning Code states that the City Council may grant a variance to the subdivision regulations �vhen compliance would create an unusual hardship to the development of land, based on the following required findings: 1. The intent of this chapter is met. The existing platting of this parcel consists of nine lots with an unimproved alley ROW bisecting the property and unimproved Annapolis Street abutting the southern end. It is unlikely that either of these rights-of-way will ever be improved due to steep slopes and the freeway abutting the east side of the property. The proposed plat creates nine developable lots with shared access to Wyoming Street. The nine proposed lots will be about the same overall size as the nine existing lots, but • reconfigured in response to the steep slopes and to provide access to the southem portion of the site. The overall area of the site is sufficient to meet the lot size requirements for nine single-family homes, but the irregular shape of the parcel an the need to provide access to the southern portion of the site prohibit the development of standard lots. The variances �vould further the intent of this chapter to promote affordable housing to persons of all income levels, and to provide more economical public services and facilities. 2. The granting of the variance will not be detrimental to the public safety, health or �velfare or injurious to other property improvements in the neigLborhood in which the property is located. This finding is met. See findings H.1 and H.6 above. 3. The conditions upon which the request for a variance is based are unique to the property for which the variance is sought and are generally not applicabie to other property. This finding is met. The property is an irregular shaped parcel of land with limited access and steep slopes over the southwestem portion of the site. These conditions make the property uniquely difficult and expensive to develop. 4. The literal interpretation of the provisions of this chapter would deprive the appticant of rights commonly enjoyed by other properties in the same zoning district. This finding is met. See findings I.l an I3 above. • 5. The special coaditions and circumstances do not result from the actions of the applicant. This finding is met. See findings I.1 and I3 above. Because of particular natural surroundings, shape or topographical conditions of the specific property involved, unusual hardship to the owner Fvould result, as distinguished from a mere inconvenience, ef the sfrict letter of these regulations were carried out. The request for variance is related to the particular shape, topography and limited access of the property, and would result in unusual hardship to the owner if the strict letter of these regulations were carried out, as discussed in findings I.1 and I.3 above. Dennis Guptil attended the meeting to answer committee questions. A small group of neighbors showed up to voice their opinions as well. • The committee had a number of questions about this project including concerns about noise from the highway, and the cutting of trees. Neighbors were concerned about increased traffic in the area and the density of the project. Due to these concerns, the BLU committee voted against supporting the variance and subdivision at this time. The committee would like to encoura?e Dennis Guptil to meet with concerned neighbors to see if these concerns can be resoived. The BLU committee continues to support nei�hborhood development. ZONING CODE CITATION: §67.301 states that platting is required when a subdivision creates five or more lots. §67.406 gives criteria for the review of subdivision applications. The intent of this chapter is met. The existing platting of this parcel consists of nine lots with an unimproved alley ROW bisecting the property and unimproved Annapolis Street abutting the southern end. It is unlikely that either of these rights-of-way will ever be improved due to steep slopes and the freeway abutting the east side of the property. The proposed plat creates nine developable lots with shared access to Wyoming Street. The nine proposed lots will be about the same overall size as the nine existing lots, but • reconfigured in response to the steep slopes and to provide access to the southem portion of the site. The overall area of the site is sufficient to meet the lot size requirements for nine single-family homes, but the irregular shape of the parcel an the need to provide access to the southern portion of the site prohibit the development of standard lots. The variances �vould further the intent of this chapter to promote affordable housing to persons of all income levels, and to provide more economical public services and facilities. 2. The granting of the variance will not be detrimental to the public safety, health or �velfare or injurious to other property improvements in the neigLborhood in which the property is located. This finding is met. See findings H.1 and H.6 above. 3. The conditions upon which the request for a variance is based are unique to the property for which the variance is sought and are generally not applicabie to other property. This finding is met. The property is an irregular shaped parcel of land with limited access and steep slopes over the southwestem portion of the site. These conditions make the property uniquely difficult and expensive to develop. 4. The literal interpretation of the provisions of this chapter would deprive the appticant of rights commonly enjoyed by other properties in the same zoning district. This finding is met. See findings I.l an I3 above. • 5. The special coaditions and circumstances do not result from the actions of the applicant. This finding is met. See findings I.1 and I3 above. Dennis Guptil attended the meeting to answer committee questions. A small group of neighbors showed up to voice their opinions as well. • The committee had a number of questions about this project including concerns about noise from the highway, and the cutting of trees. Neighbors were concerned about increased traffic in the area and the density of the project. Due to these concerns, the BLU committee voted against supporting the variance and subdivision at this time. There are two duplexes to the north across Wyoming Street. Riverview Cemetery and one single-family house are to the west. The site slopes up to the south to unimproved Annapolis St. and West St. Paul. E. ZONING CODE CITATION: §67.301 states that platting is required when a subdivision creates five or more lots. §67.406 gives criteria for the review of subdivision applications. HISTORY/DISCUSSIO\: On January 22, 2001, the Board of Zonin� Appeals (BZA) approved several front and rear yard setback and lot coverage variances for construction of nine ne« houses on this site, subject to the condition that the alley bisecting the parcel and Annapolis Sheet are vacated. The BZA approval of the variances has been appealed. A Ciry Council public hearing on the appeal is being held on February 28, 2001, on the same agenda as the public hearing on this plat. G. DISTRICT COU1\TCIL RECOMMENDATION: On January 17, 2001, the Building and Land Use Committee of the West Side Citizens Organization voted "against supportine the variances • and subdivision at this time" and encouraged the applicant to meet with concerned neighbors to see if their concerns can be resolved. The intent of this chapter is met. The existing platting of this parcel consists of nine lots with an unimproved alley ROW bisecting the property and unimproved Annapolis Street abutting the southern end. It is unlikely that either of these rights-of-way will ever be improved due to steep slopes and the freeway abutting the east side of the property. The proposed plat creates nine developable lots with shared access to Wyoming Street. The nine proposed lots will be about the same overall size as the nine existing lots, but • reconfigured in response to the steep slopes and to provide access to the southem portion of the site. The overall area of the site is sufficient to meet the lot size requirements for nine single-family homes, but the irregular shape of the parcel an the need to provide access to the southern portion of the site prohibit the development of standard lots. The variances �vould further the intent of this chapter to promote affordable housing to persons of all income levels, and to provide more economical public services and facilities. 2. The granting of the variance will not be detrimental to the public safety, health or �velfare or injurious to other property improvements in the neigLborhood in which the property is located. This finding is met. See findings H.1 and H.6 above. 3. The conditions upon which the request for a variance is based are unique to the property for which the variance is sought and are generally not applicabie to other property. This finding is met. The property is an irregular shaped parcel of land with limited access and steep slopes over the southwestem portion of the site. These conditions make the property uniquely difficult and expensive to develop. 4. The literal interpretation of the provisions of this chapter would deprive the appticant of rights commonly enjoyed by other properties in the same zoning district. This finding is met. See findings I.l an I3 above. • 5. The special coaditions and circumstances do not result from the actions of the applicant. This finding is met. See findings I.1 and I3 above. Dennis Guptil attended the meeting to answer committee questions. A small group of neighbors showed up to voice their opinions as well. • The committee had a number of questions about this project including concerns about noise from the highway, and the cutting of trees. Neighbors were concerned about increased traffic in the area and the density of the project. Due to these concerns, the BLU committee voted against supporting the variance and subdivision at this time. The committee would like to encoura?e Dennis Guptil to meet with concerned neighbors to see if these concerns can be resoived. The BLU committee continues to support nei�hborhood development.
