WHEREAS, Gallivan' s Restaurant, Inc. , is the holder of an on—
sale intoxicating liquor license for premises located at 354
Wabasha Street, doing business as, Gallivan's, in the City of
Saint Paul; and
WHEREAS, the License Inspector has recommended the suspension
of the aforementioned on-sale liquor license; and
WHEREAS, the basis for the recommendation was communicated to
the license holder by letter dated January 26, 1979, which letter
also notified the licensee of the hearing date of February 14,
1979; and
WHEREAS, at the request of the license holder this matter was
continued to March 14, 1979; and
WHEREAS, the licensee appeared together with his attorney,
Joseph Dudley; and
WHEREAS, at the hearing the Council received evidence supporting
the claim that the license holder permitted persons to remain on the
premises or permitted the consumption or display of intoxicating
liquors after closing hours on July 15, 1978 , and January 21, 1979; and
WHEREAS, the attorney for the license holder agreed that the
police reports and the report from the office of the License Inspector
concerning the aforementioned incidents could be submitted as part of
the record; and

WHEREAS, the attorney for the license holder admitted to the
Council that the charges made by the License Inspector were true;
and
WHEREAS, after discussion the Committee recommended that in
lieu of a suspension of the license holder' s license, that the
license holder pay a fine to the City of Saint Paul in the amount
of $500.00; and
WHEREAS, the license holder agreed to the payment of a
$500.00 fine in lieu of the suspension of his liquor license.
NOW THEREFORE, Be It Resolved by the Council of the City of
Saint Paul, that the corporation known as Gallivan's Restaurant,
Inc. , holding a liquor license for premises located at 354 Wabasha
Street, Saint Paul, Minnesota, pay to the City of Saint Paul the
sum of $500.00 in lieu of a suspension of their liquor license for
violation of the ordinances of the City of Saint Paul; and
BE IT FURTHER RESOLVED that the City Clerk is directed not
to publish this resolution until notified by the Director of
Finance and Management Services, that the City of Saint Paul has
received the aforesaid sum as herein provided.

As License Inspector for� the City of Saint Paul, it is my
responsibility to inform you that on February 14, 1979, a Public
Hearing will be held before the St. Paul.City Council License
Committee.
This hearing will be held in the St. Paul City Council Chambers,
3rd Floor of the City and County Court House at 9:00 A.M.
At this hearing, it will be my recoffinendation to the License
Committee to suspend all licenses which you presently hold for the
�,rEmisea at 3�4 Wauasha Street where you do business as uallivan's
Restaurant.
Evidence of your misconduct as an on sale liquor license holder
will be pr.esented to the License Committee at that hearing.
My recommendation as License Inspector is based on the following
incidents:
- July 15, 1979 - That you permitted person and/or persons to
remain on the premises and/or also permitted
the consumption or display of intoxicating
liquors after closing time.
This is in violation of Section 308.20 of the Saint Paul Legislative
Code and of Minnesota Statute 340.14. (Enclosure)
January 21, 1979 - That you permitted person and/or person to
remain on the premises and/or also permitted
the consumption or display of intoxicating
liquors without obtaining a Sunday On Sale '
Liquor license. '

SUBJ: Unlicensed Sunday fln Sale Liquor
On January 21, 1979, I received a complaint concerning Gallivan's
Bar. The complainant stated that Gallivan's was open this day (Sunday)
and operating without a Sunday On Sale Liquor license. The complainant
then hung up without giving a name.
I then attempted to contact Joseph Carchedi and was unable to do
so. I then drove to Gallivan's to check the validity of the complaint.
I walk.ed to the front door, and on the door was a sign which stated
"Private Party". I opened the door and entered. There was a woman
seated at the front door with a list of names. I asked her if they were
open and she stated that they were having a private party. There were
people seated at the tables with glasses in their hands.
I then called Captain Verhulst and explained the problem. He
asked me why I didn't take care of it. I told him that if I went in
without a uniform or backup, it might be a bad situation. I told the
Captain that there was no Sunday On Sale Liquor license issued to that
address. He told me that he would send a squad. I asked �im if he
wanted me present and he told me he would have a squad take care of it.
I then immediately drove back to Gallivan's from the Highland Park
area. When I arrived, I used a phone in the parking ramp next to the
bar. i called Captain Verhulst and he stated that the squad had been
there and had taken care of it. I asked him if the officers found
liquor being consumed. He stated "They were not charging." It was my
impression from this conversation that although the officers apparently
found people consuming liquor, they did not witness charging for it.
I then was able to contact Joe Carchedi afid explained the problem.
I was instructed to go to the bar and get the names of the people
attending the party. I went to the front door and it was locked. I
went around to the back door and walked into the dining area. The
woman that had been at the front of the bar t�tcing names asked me what
I wanted. I told her I would like to talk to the owner and she directed
me to Pat Gallivan. I identified myself and asked if we could talk.
We went to his office and I explained to Mr. Gallivan that he was
operatiug a Sunday On Sale Liquor establishment without a license. He
then asked me if �I was familiar with the regulations. I informed him
that I was. I told him I needed a list of the people in attendance at
the party. iie made up a list and gave it to me. I then left the office.

Before I entered the office, I picked up a glass on the bar. The
glass was partially empty containing a brownish colored liquid and
smelled of alcohol. There were approximately 20 or more people around
the premises with similar glasses. Standing behind the bar was an
elderly gentleman (Andy) wearing a bartender's vest whom I recognized
as being a bartender from McCafferty's. There was also a woma.n who
appeared to be working the floor as a waitress whom i did not recognize.
