1 WHEREAS, adverse action was nutiated against the Master Plasterer's license held by
2 Jerome Wold, d/b/a JTW Co. (License Id # 000005623) by Notice of Violation dated Apri130,
3 2001; and
4
5 WHEREAS, the Office of License, Inspections and Environmental Protection has
6 recommended a penalty in this matter of a sixty day suspension of the Master Plasterer's license,
7 with the suspension to be stayed for a period of eighteen months on the condition that there be no
8 further violations related to the license and that the Licensee pay a fine of $500; and
9
10 WHEREAS, parties have agreed that this matter could be resolved without the need for
11 an administrative law hearing if the allegations were amended and the recommended penalty was
12 imposed; and
13
14 WHEIZEAS, parties have agreed that the violations upon which a penalty is to be
15 imposed are that on February 7, 2000 and October 19, 2000 Licensee obtained two separate
16 permits to install spray-on fireproofing, which in Saint Paul must be done by the holder of the
17 certificate of competency but that the actual work of the fireproofing on both jobs was done by
18 individuals who did not hold the appropriate certificate of competency and they were not being
19 supervised at the times the inspectors observed the wark being performed. Saint Paul Legislative
20 Code §370.18 prohibits the holder of a certificate of competency to allow or authorize an
21 employee or other person to do the work unless they hold the appropriate certificate of
22 competency ar are a registered apprentice; now, therefore, be it

INITIATING PROBLEM, ISSUE, OPPORTUNITY (Who, What, When, Where, Why):
n February 7, 2000 and October 19, 2000 Licensee obtained two separate permits to
install spray-on fireproofing, which in Saint Paul must be done by the holder of the
certificate of competency but that the actual work of the fireproofing on both jobs
as done by individuals who did not hold the appropriate certificate of competency and
they were not being supervised at the times the inspectors observed the work being
erformed. Saint Paul Legislative Code 370.18 prohibits the holder of a certificate
of competency to allow or authorize or an employee or other person to do the work
less they hold the appropriate certificate of competency or are a registered
apprentice.
VANTAGES IF APPROVED:
Compliance with code will be achieved with minimal hardship for the contractor.
ISADVANTAGES IF APPROVED:
ISADVANTAGES IF NOT APPROVED:
Contractors will fail to install fireproofing material properly, creating potential
fire hazards throughout the city.
