The meeting was called to order at 2:02 p.m.
STAFF PRESENT: Kristine Schweinler, License, Inspection, Environmental Protection (LIEP);
Corrine Asuncion, LIEP; Jeffery Hawkins, Code Enforcemen�.
Crerry Strathman stated this meeting is being held to heaz objections to a license for Jade Inc.,
doing business as Snelling I-94 Citgo, 326 Snellling Avenue North.
Kristine Schweinler reported the applicant is applying for the following licenses: Gas Stazion,
Restaurant - L'united, Grocery (C), and Cigarette/Tobacco. LIEP is recommending approval
pending the final zoning & Environmental Health inspections.
In response to Mr. Strathman's question, if there aze any zoning issues, Jeffery Hawkins
responded it is properly zoned and meets the pazking requirements.
John Daubney appeazed and siated he checked with the Offices of License, Inspection,
� Environmental Protection (LIEP), and found that no permit applications had been filed in order
to do construction. Pazking can be a problem and the alley on the East side of the premises is
occasionaily blocked by customers of Snelling I-94 Citgo. There is a pre-existing service station
in the area that has been there for years. There defuutely will be a pazking problem with a
restaurant business in place. The carwash has been removed from the property, without a permit.
The concern is what will be the future development of this site. There aze two buildings between
the building, owned by Mr. Daubney, and the filling station, and those buildings were taken out
by Mobil Oil. Negotiations aze in progress with Mobil Oii as to a possible accusation of the
properties. Also, there is a potential claim against Mobil Oil. VJhen the adjacent building was
removed, an uneven and jagged appearance was left and it was not done in compliance with the
ordinances of the City of Saint Paul. Potentially there could be two sepazate problems from two
directions, Mobil Oil on one side and the filling station on the wmer. If they come in with a
SuperAmerica type of operation, it will be a rarity not to have five to six cars in the parking lot at
ali times. The filling station is located on the side of a service road adjacent to I-94 and Snelling,
at the southeast corner. Customers have no means of going South bound on Snelling because of
a median. There is not enough space to take care of pazking.
�n response to Mr. Stradunan's question if permits were applied for and issued, Corinne
Asuncion appeared and responded that a mechanical permit was issued in December, 2000.
Mr. Hawkins stated the requirement for a service station, with a stall, is one parking space for
� every two hundred and seventy five square feet, plus one additional space for each stall. A

7eff Shaller appeared and stated that he does not have an objection to the license, but does have a
probiem with LIEP. Construction was started at the business when he received the Legislative
FIearing notice. The work is 90% done, and the proper process shoutd haue been to have this
hearing before a crew showed up to start construction. The main complaint is not with the
license application, but with the notificaiion procedure of the City.
Ms. Schweinler stated this hearing is to hear objections to the ficense application. By ordinance,
the City is responsible to send out natices to tke surrouading busiaesses and aeigkborhoods,
notifying them of tlie license applied for. Tlris hearing does not pertain to building permits.
Dean Showalter appeared and stated he is the owner of the establishment. In response to the
permit issue, there were building permits pulled in September by Anderson Havish Consiruction,
and the construction is 95 % complete. The license for a Grocery (C), is to sell doughauts
through a glass case. There is not any seating available in the establishment This business has
been established since 1986 and the reason for the license application is because the name on the
license was changed.
In response to Mr. Strathman's question that permits were issued, and the construction was done
in accordance to those permits, Mr. Showalter responded that is conect. Mr. Showalter said it �
ius undersfanding that the surrounding neighborhoods and businesses do not haue to be notified
of permits but they @o need to be aotified of any license applications. Mr. Strathn�an responded

Mr. 'Showalter stated the Grocery (C) license is being applied for so they can be competitive with

car parked in the alley.
