Hozza: We are counsel for inidwest Plastics, Tnc. in the above noted appeal. - In examining the file in preparation for appearance on this matter, I was advised that the Ci�ty Council would again consider the issue of access on July 25, 1979. I have since been advised that the date of continuance is in fact July 26 at the regular Council meeting. Since I will be out of town on business on July 26th and 27th, I an respectfully requesting that the matter be iaid over until July 31, I979 at your regular Council meeting. SECOND OPTION TO BASE LEASE THIS AGREEMENT is made by and between Minneapolis-St. ,Paul Metropolitan Airports Commission, 6040 28th Avenue South, Minneapolis, Minnesota 55450, hereinafter referred to as LESSOR, and the CITY OF ST. PAUL, DEPARTMENT OF POLICE, here- � inafter referred to as LESSEE. WITNESSETH: The Lessor and the Lessee, in consideration of the rents, covenants and agreements herein reserved and con- tained, do hereby agree each with the other as follows: l. The Lessor grants and the Lessee accepts a lease of the following described premises in the CITY OF ST. PAUL, COUNTY OF RAMSEY, 1�!INNESOTA, to-wit: Approximately Seven Hundred Fifty Nine (759) square feet of floor space in Rooms 124 and 125 in the Administration Building at the St. Paul Downtown Airport (Holman Field) , for a term of one (1) year from July 1, 1979 through June 30, 1980, to be used as an office by the City of St. Paul, Department of Police: 2. As rent for the above described premises, the Lessee agrees to pay to the Lessor the sum of ($4,933.50) Four Thousand Nine Hundred and Thirty-Three Dollars and Fifty Cents per year payable in eleven (11) equal monthly install- ments of $411. 13 (Four Hundred Eleven Dollars and Thirteen Cents) and one (1) installment of $411. 07 (Four Hundred Eleven Dollars and Seven Cents) beginning in July, 1979. 3. This lease may be terminated by Lessee or Lessor effective at the end of any rental month, upon at least sixty (60) days written notice of such termination given to the Lessor or Lessee. 4. The Lessor shall furnish and provide for the use of the Lessee �.he following: a. Heat b. Light c. Janitorial services d. Lavatory and supplies. 5. This Agreement covers the second of two (2) one-year options allowed under the base lease effective July 1, 1977. 6. Except as otherwise provided herein, the Lessor shall furnish all materials and services required for its use of the premises and shall maintain the premises in reasonably good condition and state of repair during the continuance of its tenancy, and shall surrender the premises to the Lessor at . � `� - ����`��� -2- the termination of such tenancy in such condition as the same are in at the commencement of such tenancy, reasdriable wear and damage by the elements excepted. � 7 . Obligations of the Lessee other than the rent specified shall be encumbered in the usual manner as provided by law. 8. The Lessee for himself, his heirs, personal representatives, successors in interest, and assigns , as a part of the considera- tion hereof, does hereby covenant and agree as a covenant running with the land that in the event facilities are constructed, maintained, or otherwise operated on the said property described in this lease for a purpose for which a Department of Transpor- tation program or activity is extended or for another purpose involving the provision of similar services or benefits , the Lessee shall maintain and operate such � faclities and services in compliance with all other requirements imposed pursuant to Title 49, Code of Federal Regulations , Department of Transpor- tation, Subtitle A, Office of the Secretary, Part 21, Nondis- crimi.nation in Federally-assisted programs of the Depar�ment of Transportation-Effectuation of Title VI of the Civil Rights Act of 1964 , and as said Regulations may be amended. Further, the Lessee for himself, his personal representatives , successors in interest, and assigns, as a part of the considera- tion hereof, does hereby covenant and agree that (1) no person on the grounds of race, sex, color, or national origin shall be excluded from participation in, denied the benefits of, or be otherwise subjected to discrimination in the use of said facilities thereon, (2) that in the construction of any improve- ments on, over, or under such land and the furnishing of services thereon, no person on the grounds of race, color or national origin shall be excluded from participation in, denied the bene- fits of, or otherwise be subjected to discrimination, (3) that the Lessee shall use the premises in compliance with all othe- requirements imposed by or pursuant to Title 49, Code of Federal Regulations, Department of Transportation, Subtitle A, Office of the Secretary, Part 21, Nondiscrimination in Federally- assisted programs of the Department of Transportation-Effectua- tion of Title VI of the Civil Rights Act of 1964 , and as said Regulations may be amended. In the event of breach of any of the above nondiscrimination covenants the Minneapolis-Saint Paul Metropolitan Airports Com- mission shall have the tight to terminate the Lease and to re- enter and repossess said land and the facilities thereon and � hold the same as if said lease had never been made or issued.
