RESOLVED, that in accordance with Minnesota Statutes Sections 463.15 through 463.25, and based upon the foregoing findinga of the City Council, the Council of the City of Saint Paul does hereby make the following order: ORDER 1. The legal description of the property is : N 1/2 of Lot 7 , Block 13 , Robertson F Van Bttens Addition. - The building is a two story house of wood frame construction. The subject property has been boarded up by the City since March, 1979. This building because of age, deterioration, lack of proper maintenance , �:�a�dal�ism, extensive fire damage on second floor and roof, being extremely close to another vacant structure and because the owner has failed to provide a plan for the rehabilitation or wrecking of the building is deemed beyond feasible rehabilitation and should be condemned and removed as soon as possible. Inasmuch as the conditions outlined above constitute a public hazard and the owner has made no attempt to satisfactorily repair the damage despite our warnings, and the continued vacant and boarded up condition contributes a blighting influence on the neighborhood, it is the recommendation of this Division that this matter be referred to the City Attorney's office for��zing and removal through District Court proceedings . On behalf of Gary D. Irene and Jacqueline M. Irene, the following answer is hereby served upon the City of Saint Paul , according to Minnesota Statutes 463.18: ANSWER Gary D. Irene and Jacqueline M. Irene for their Answer state: 1 . The Council Order dated July 12, 1979, in City Council File No. 273308, is specifically denied as to the following facts: A. The party who "boarded" the property up after the fire to keep it safe and discourage vandalism was the Irenes and not the City. B. The building in fact is feasible for rehabilitation and should not be condemned and removed as ordered by the Ci ty. C. The Irenes have made reasonable effort to proceed with a sale and repair of the property, but are being denied the right to do so. 2. The Irenes have not been provided a reasonable time for correcting any hazardous condition. � 3. Gary D. Irene and Jacqueline M. Irene are Contract for Deed vendees of the property and will suffer substantial financial loss unless they are given the right to sell the property to a buyer who has agreed to .correct any hazardous condition within a reasonable time.
