WHEREASl upon the facts presented at the said hearing con�isting
of phatographs, inspection reports and the recommendation of the
Building Department, it is further determir�d that the above building
constitutes a hazardous building within the c7efinition af M innee� ta
Statutes 463.15 far the following reasons: -
a. The subject property has been baarded up by the City since
Marchr 1979.
b. Because of age, deterioration; lack of proper maintenance,
vandalism, and extensive fire damage on second flc�or and
roal, and because of its being extremely clo�e to an+�ther
vacant structure, the building is deemed beycncl feaeible
rehabi7.itation and should be condemned and removed as se�on
as possiblef
c. The owner has made no attempt to satisfactorily repair the
damage�
d. The continuad vacant and baarded up candition contributes
a blighting influence on the neighborhoodt

RESOLVED, that in accordance with Minnesota Statutes Sections
463.15 through 463.25, and based upon the foregoing findinga of the
City Council, the Council of the City of Saint Paul does hereby make
the following order:
ORDER
1. The owners af the abQVe described building shall make the
same safe and not detrimental to the public peace, health� safety and
welfare by having the said building razed and the materials therefrom
removed from the premises within thirty (30) days from the date of
th e service of this Order�
2. t7nless such corrective action is taken to comply with this
Order or an answer served upon tha City of 3aint Paul and filed in
the Office of the C].erk of the Dietriet Court of Ramaey County�
Minneeota within twenty (20) days from the date of the service of
this Order, a Motian for Summary Enforeement of this Order to raze
and remove tha said building will ba made to the Ram�ey County
nistrict courtt
3. In the event that the building ie to be ra�ed by the City
of Saint Paul pur�ant to �udgment of the District Court, all personal
property or fixtures of any kind which may unreasonably interfere
with the razing and removal af this bnilding ehall be remc�ved �oithin
ten (�.0) days from the entry of judgmentl and it not Bo remaved, the
City of Saint Paul shall remo�re and dispose of such personal property
and fixtures as provided by lawT

The Division of Housing and Building Code Enforcement is hereby submitting
its report on the eondition of the structure at the location referred
to above.
The owners of record are : Registered fee owners : Gayle A. F Coral A.
White, 21414 Tulip Street , Anoka, MN 55303 . Unregistered owners : Gary D .
� Jacqueline M. Irene, 71 - 66th Way N.E . , Fridley, MN 55432 .
The legal description of the property is : N 1/2 of Lot 7 , Block 13 ,
Robertson F Van Bttens Addition. -
The building is a two story house of wood frame construction.
The subject property has been boarded up by the City since March, 1979.
This building because of age, deterioration, lack of proper maintenance ,
�:�a�dal�ism, extensive fire damage on second floor and roof, being extremely
close to another vacant structure and because the owner has failed to
provide a plan for the rehabilitation or wrecking of the building is
deemed beyond feasible rehabilitation and should be condemned and removed
as soon as possible.
Inasmuch as the conditions outlined above constitute a public hazard and
the owner has made no attempt to satisfactorily repair the damage despite
our warnings, and the continued vacant and boarded up condition contributes
a blighting influence on the neighborhood, it is the recommendation of
this Division that this matter be referred to the City Attorney's office
for��zing and removal through District Court proceedings .

? On behalf of Gary D. Irene and Jacqueline M. Irene, the following answer is
hereby served upon the City of Saint Paul , according to Minnesota Statutes
463.18:
ANSWER
Gary D. Irene and Jacqueline M. Irene for their Answer state:
1 . The Council Order dated July 12, 1979, in City Council File No.
273308, is specifically denied as to the following facts:
A. The party who "boarded" the property up after the fire to keep
it safe and discourage vandalism was the Irenes and not the City.
B. The building in fact is feasible for rehabilitation and should
not be condemned and removed as ordered by the Ci ty.
C. The Irenes have made reasonable effort to proceed with a sale
and repair of the property, but are being denied the right to do so.
2. The Irenes have not been provided a reasonable time for correcting
any hazardous condition. �
3. Gary D. Irene and Jacqueline M. Irene are Contract for Deed vendees
of the property and will suffer substantial financial loss unless they are
given the right to sell the property to a buyer who has agreed to .correct
any hazardous condition within a reasonable time.
