WHEREAS, the North End Improvement Club, owner of property located at 1079 Rice Street,
had appealed to the Board of Zoning Appeals requesting variance from the strict application of
the provisions of Section 62.110 of the Saint Paul Legislative Code pertaining to requirement
of an obscuring fence in B-3 zoning district; and
WHEREAS, following a public hearing with notice to affected property owners, the Board of
Zoning Appeals on February 6, 1979 granted the variance subaect to final site plan approval ;
and
WHEREAS, there exists confusion as to the exact location of the fence the openings; and
WHEREAS, Mr. Joseph Prifrel , representing the North End Improvement C1ub, Mr. Michael
Sattler, an immediate neighbor of the North End Improvement Club, and Mr. Edward Warn, Zoning
Staff, appeared before the City Council on June 20, 1979; and
WHEREAS, they have agreed to the fence height, location, opening and traffic signs:
NOW THEREFORE BE IT RESOLVED by the Saint Paul City Council that the fence be a six foot
high screening type fence located on the west property line (east alley line) of the North End
Improvement Club, cot�nencing at the north property line and extending southerly to the existing
utility pole.
FURTHER, BE IT RESOLVED that the North End Improvement Club place a stop sign and a left-
turn-only sign for traffic movement out of the alley.
FURTHER, 6E IT RESOLVED that the North End Improvement Club be reimbursed their original
Fifty Dollars ($50.00) filing fee in recognition of their civic and community contributions
in the past.
FURTHER, BE IT RESOLVED that the Saint Paul City Council shall mail a copy of this reso-
lution to the North End Improvement Club, the Zoning Administrator, the Planning Commission
and the Board of Zoning Appeals.
