RESOLVED, That pursuant to Minnesota Statutes, Section 160.11,
Subdivision 2, the Council of the City of Saint Paul hereby authorizes
and directs the proper City officials to execute a contract with the
City of North St. Paul for the sale to North St. Paul of various
types of asphalt as produced by the City of Saint Paul ' s asphalt
plant; said sales to be made subject to the terms and conditions as
set forth in said agreement.

THIS AGREEMENT, Made and entered into this 30th day of

Minnesota, hereinafter referred to as "Saint Paul" and
The Ci ty of °�orth St. Paul , hereinafter referred to as
�-Jorth St. Paul ;
WITNESSETH:
WHEREAS, Saint Paul is authorized and empowered to operate and
maint�in an asphalt plant pursuant to Minnesota Statutes, Section
• . 160.11, Subdivision 2; and .
WSEf2EAS, That statute also authorizes the sale of asphalt from
one road autr.ority to another; and
WHEREAS, Saint Paul and ��orth St. Paul
are road authorities as defined in Minnesota Statutes, Section
160.02, Subdivision 9; now, therefore,
IT IS MUTUALLY AGREED BY AND BETWEEN SAINT PAUL AND � .

1. That this agreement shall commence April 1, 1979, and ter-
minate March 31, 1980. � �
2. That at the discretion of Saint Paul exercised in supplying
its own needs for asphalt, Saint Paul will sell to
North St. Paul asphalt as available of the type
