An ordinance to amend Section 438. 07 (a)
of the Saint Paul Legislative Code to permit
possession of regulated beverages under certain
circumstances.
THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section 1.
That Section 438.07 (a) of the Saint Paul Legislative Code
is hereby amended to read as follows:
"438. 07. (a) Drinking on Streets and in Parks.
No person shall upon the public streets, lanes or
alleys of the city, or in any park, playground or
recreation center owned by or under the jurisdiction
or control of the City of S�iint Paul or in any park-
ing lot or area within or adjacent to such park,
playgrounti or recreation ceart��:��er� being a tres- .

intoxicating malt liquor, non-intoxicating malt

recreation center, or being a trespasser upon the
private premises of another, have in his possession
any intoxicating liquor, intoxicating malt liquor,
non-intoxicating malt liquor, or alcoholic bevera e
of any kind whatever. No person shall have in his
possession any intoxicatinc� liquor, intoxicating
malt liquor, non-intoxicating malt liquor, or alco-
holic beverage of any kind whatever upon any public
street, lane or alley located within the boundaries
of such a park, plaXground or recreation center;
provided, however that it shall be an affirmative
defense that such possession was for the purpose
of transportation of such liquor or beveraqe throuqh
the park, playground or recreation center or to a
designated shelter, facility or area as provided
herein and where such ].i uor or bevera e is in an
unopened container. Notwrthstanding t e foregoing,
any person may, from 8 :00 A.M. to 8:00 P.M. , within
picnic shelters, facilities or areas within any park,
�l.ayground or recreation center, which are designated
for that purpose by the Director of the Department of
Community Services or his delegate, drink or have in
possession non-intoxicating malt liquor.

Section 2.
.All of Section 438. 07 of the Saint Paul Legislative
Code, including the above amendment, is hereby re-
enacted as part of the Saint Paul Legislative Code.
Section 3.
This ordinance shall take effect and be in force
thirty (30) days following its passage, approval and
publication.

Attached is the amendment to the ordinance prohibiting alco-
holic beverages in the parks. It will make clear that there
is no ban on transporting liquor on city streets or through
parks when you are just going through the parks.
None of the related suggestions of Bob Piram are incorporated
in this ordinance, and he is going to work with you to fashion
ea3 those. There may be questions from the police department
about some of those other changes.
2 don't know which city department should formally be listed
as the one requesting the ordinance, but it could be the City
Attorney, Community Services, the Police Department o� the
Office of the Mayor. Take your pick.
