PROCEEDINGS : Mr. Reiter reported that he had visited the property sznce
the July meeting and found it a handsome building. He had also talked
with some of the tenants , who told him they did not object to sharing
a bathroom. He had found the bathrooms to be well kept.
Alice Bijjani stated that the zoning issue had been cleared up and was na
longer an obstacle. She said there were three units on the second floor
sharing one b athroom, and three on the third sharing one on that floor, and
all other units had private bathrooms . She suggested that the number of
occupants for the six units sharing two bathrooms tie restricted to no more
than eight, which would mean no more than four persons sharing one b athroom.
BOARD ACTION : Mr. Glassman moved that a waiver be granted to permit
shared b athrooms , with a limit of four persons occupying three units on
each of the floors where bathrooms are shared, upon condition that all
remaining code violations listed in the Survey Letter of 5/30/79 are
corrected. Mr. Tieso seconded. MOTION CARRIED AND SO ORDERED.

as set forth in appellant' s appeal application, because of financial hard-
ship and practical difficulty.

PROCEEDINGS: Ms . Marcotte told the Board that the second floor had six
units , one with its own bathroom and the other five shared a bathroom.
The third floor had three units , whose occupants shared one bathroom.
She occupied the first floor apartment which had a private bathroom.
She and her husband had bought the building in 1941 and it was in opera-
tion as ten units at that time .
Father Tegeder explained that Ms . Marcotte was asking oniy that she be
allowed to continue operating the building as at present until such time
as she no longer owned it. He said that all the occupants were elderly
people of very limited incomes , some of whom had lived there for up to
30 years an d would find it most difficult to find comp arable living
quarters at such reasonable rent. The tenants were all £riends who
helped one another in whatever way was needed.
Chairman Wozniak asked if there was usually but one tenant in each unit ,
and Ms . Marcotte said that was co�rect.
Mr. Tieso asked Ms . Marcotte if she had any objections to taking care of
the other violations listed in the Survey Letter.

Ms . Marcotte replied that most of the items were being done , fire doors
were to be installed next week, electrical work was already done, and
sink that had been� connected to a drainpipe , which she had not been
aware of, was being disconnected. She questioned the need to install a
vent on the laundry tub drain, since there was a drum trap there , she was
the only person who used it , and it had never given any trouble.
Ms . Bijjani said proper venting was important, but in this case , it was
marginal whether the function of venting was served and it was not as
serious as a completely unvented trap.
Ms . Marcotte said another matter she questioned was the need for a fire-
wall in the ceiling of the attached garage.
Ms . Bijjani said she would arrange to have a building inspector stop out
and explain exactly what was needed to provide adequate fire separation
between the garage ceiling and the storage area above it. She noted tha�
it would not be costly, but served an important role in providing fire
safety. She mentioned that the city inspector had reported the building
generally in excellent shape.
BOARD ACTION: Mr. Tieso moved that the variance on the shared bathrooms
e granted, restricting occupancy to one tenant per unit, and to grant
a variance on the venting requirement on the drum trap installation in
the laundry tubs , on condition that appellant meets r�ith a city inspector
an d follows his recommendations in regard to installing a fire separation
ceiling in the attached garage of the property, and completes aIl other
repairs listed by_ _the _city inspector in Survey Letter of 7/S/79. Variance
is to remain i�. effect until such time as the property changes hands .

PROCEEDINGS: yr. Macey explained that all units had private b athrooms
except pts . 2 and 2b , whose occupants shared one bathroom. There was
only one tenant in each of those units . Other than his appeal for a
variance on the code to allow the shared bathroom, he was requesting an
extension of time to complete the other tvork listed in the Survey Letfier
of 7/17/79.
Alice Bijjani said her department had already granted an extension of
time from 30 days to six months an certain items , and on remainin g items ,
an extension from 90 days to one year.

Mr. b4acey replied that he didn' t yet know exactly how much his costs. would
be , but that� he had two properties , each with a rather extensive list of
items to be corrected, and he felt it might be difficult to obtain the
money for both projects in a year' s time.
Ms . Bij j ani stated that Mr. Macey, tivho owned other properties , had al.ways �
been most cooperative with the city in complying with code matters in the
past. She suggested that Mr. Macey work out a time schedule for the work
an d consult with her on it. For this hearing, she suggested that the Board
concern itself only with the matter of the shared baths.
BOARD ACTION: Mr. Glassman moved that a variance be granted to permit
occupancy of the two apartments where one bathroom was shared, on condition
that all other items be done in accorclance with the prescribed time
worked out in cooperation with the Division of Code Enforcement. Mr. Tieso

Mrs . Reischel said there were four rooms on the second floor. There were
two one-room units and two other rooms which she planned �o put together
to form another unit , installing a sink. The three units would share the
one bathroom on the second floor.
Ms . Bijjani recommen ded that the sharing of the first floor bathroom
betiaeen the third floor unit and the first floor occunants be pe.rmitted
only so long as the Reischel` s daughter occupied the thirci floor unit.
Mrs . Reischel stated that they would no longer rent the third floor a.f
their daughter should move out. They also nlanned to complete � all repairs
listed in the city' s Certificate of Occup ancy letter of 5/30/79 .
BOARD ACTION: Mr. Tieso moved that variances be granted (1) to pexmit
occupancy o the third floor apartment , whose tenant shared a bathroom
with tenants of the first floor unit , so long as the daughter of the
first floor tenants lived in the third floor unit , and (2) to permit
occupancy of three units on the second floor s�haring one bathroom facility,
restricting occupancy to one person per unit , on condition that all
remaining items listed in Survey Letter of 5/30/79 be corrected.
Mr. Glassman seconded.

variances be granted only for the period of ownership by Mr. and/or Mrs . .
