SUBJECT: Request extension of time to complete general repairs desig-
nated in Certificate of Occupancy letter of 7/19/79 , because of economic
considerations .
APPEARANCE : August R. Macey
PROCEEDINGS: Mr. Glassman said that he understood Mr. Macey was not
appealing for anyt�ing but a time extension in this case .
Mr. Macey answered that this was correct, and that he would work with the
Code Enforcement Division to prepare a reasonable time schedule.
Ms . Bijjani said her department realized that working on two properties
would be a financial drain and would take that into consideration.
BOARD ACTION: Chairman Wozniak moved that the apneal be granted as to the
extension of time on a schedule to be worked out by the appellant with
the Code Enforcement Division. Mrs . Peake seconded. MOTION CARRIED AND
SO ORDERED.

Chairman Wozniak stated that two cases on the agenda would not be heard.
Case No. 24- 79-F, 581 University, Appellant Steven Hamel , involving the
storage of motorcycles , was being postponed to the September Board meet-
ing by agreement of all parties concerned because Fire Prevention Bureau

by Code Enforcement Division in Survey Letter of 5/10/79 , because rehab
loan is anticipated from HRA an d appellant is unable to proceed until
such funds become avaiiable.

PROCEEDINGS: Mrs . Best stated that they had bought the property on
June 14 , 1979 , on contract for deed, with the knowledge of all the defic-
iencies listed in the letter to the former owner. She said she expected
the rehab money from HRA, as well as funds to enable her and her husband
to become fee owners , tivould be forthcoming in September, but work could
not proceed until then.
Several Board members noted that funds from HRA rarely materialized before
six months f ollowing approval of loan applications , and in some cas;:�� the
total funding granted to HRA was insufficient to cover all applicati�ons.
Alice Bijjani told the Board that Warren Frost , of HRA, had hoped to come
before the Board today to explain the program for non-owner-occupied,
multi-unit buildings , but he had some meetings ta attend and wasn' t sure
he could make it.
Frank Staffenson explained that there were still a few details to be
worked out before the program got off the ground. He said in this parti-
cular case , the question was whether the building would meet the parameters
tentatively set in relation to the kind of rehab work necessary. For vne
thing there was a $5000 per unit limitation, and if this turned out to be
insufficient , the owners would have to come up with additiQnal mQ�ey on
their own.
Mr. Best spoke of having had an architect , an electrician and a plumber
laok at the building , and all had indicated the project would be extremely
costly. He was beginning to have some doubts about whether to go ahead.
Mr. Glassman remarked- that there were some hazardous canditions in need
of immediate attentien. .
Ms . Bijjani said there were some things that should be done right away.
A pressure-relief valve on the hot water heater, a problem of spillage of
products of combustion from the water heater, and repair of a roof leak
� were high priority items . She listed Items No. 3, 8 , 9 , 10 , 26 , 27 , 38 ,
42 , 56 , and 63 , as deficiencies on which she suggested six months could
be allowed for completion, and a year on the remaining items . She felt
roof repair very important to prevent further damage on the interior.
Mrs . Best said the reason they bought the building was because they had
been led to believe tliey �would aualify for funds from HRA. Their only
other resource for funds would be if they could close a sale on a house
they had on the market.
Messrs . Naibi and� Tieso emphasized thr camertwhen suchhwork�couldanotabe
how little time was left before winte ,
done.
Chairman Wozniak had to leave the meeting at this point and turned the
chair over to Mr. Tieso.
BOARD ACTION: Chairman Tieso moved to grant an extension of time of six
mont s to complete roof repairs and life safety items , as enumerated by
Alice Bijjani from the asterisked items in the Survey Letter of 5/10/79
addressed to the previous owner. Mr. Glassman seconded. MOTION CARRIED AND
SO ORDERED.

SUBJECT : Request extension of time to complete roof and stove repairs
ecause of plans to sell property, and compliance would cause financial
hardship.

PROCEEDINGS : Ms . Otto explained that she did not feel the stove repair
was er responsibility, since it was not a part of the rental agreement.
When she had shown the house to the c'urrent renter, the latter had remarked
that she did not have a gas range . Ms > Otto offered to let her use one '
she had and wasn' t using. She felt the tenant should be respons.ible for
either having it repaired or buying a new one. As far as Mrs . Otto was
concerned, she thought the oId range had now been disconnected.
Mr. Conley said he had met with Mrs . Como, the tenant , at the house yes-
terday, who showed him the cracked ceilings in the front hall and back
hall pantry. The gas range was redtagged by NSP for a gas leak in the
oven control , but Mrs. Como was still using the top burners. She had
told Mr. Conley that no repairs had been made and she was paying $300
pe r month in rent. On the basis of substantial fin ancial gain , Mr. Conley
felt there ' should be no extension of time granted.
Ms . Otto said sh� did not think the roof leak was a major one and had t�ied
without success to patch it herself. She thought perhaps the house s.hould
have a new roof, but she could not afford it. She explained that the
house was tied up legally until November, but at that time she expected
to be able to sell it with a price adjustment allowing for the cost of a
new root. As to the financial gain, she said the mortgage payments were
$252 per month, and that $300 in b ack taxes were due as a result of mis-
management by a �irm wYro had previously managed it. So there was a netgain
of $48 a month, not a very large sum to work with.
Chairman Tieso suggested that Mrs . Otto should either have a repairman fix
the gas range, or send a plumber to disconnect it . and tell Mrs . Como she
would have to supply her own gas range.
Mr. Glassman thought that the loan of the gas range to Mrs . Como might mean
Agrs. Otto would be obliged to supply a replacement or make an adjustment
in the rent.
Mr. N•aibi said he felt it very important that the roof leak be fixed without
delay, since it was causing interior damage. He explained that a home
improvement loan for $2 ,500 (the approximate cost of a new roof) would
mean a monthly payment of $31 , and the house would probably se11 for that
much more if the new roof was list�d as one of its assets .
BOARD ACTION : Mrs . Peake moved to grant an extension of one month to sell
the property. If it was not sold by that time , the house should be reroofed.
The gas range should be removed immediately. Mr. Glassman seconded. MOTION
CARRIED AND SO ORDERED.

Case No. 24- 79-F, 581 University, Appel.lant Steven Hame.l , involving the
storage of r�otorcycles , was being postponed to the September Board m�et-
ing by agreement of all parti.es concerned because Fire Preventi_on Bureau
