We are makin� J formal objection to the proposed condemning and taking of a street easement, a permanent utility easement,and a temporary construction easement on our property. Our reasons for objecting are as follows : 1. The offer made to us by the city for these easements � and properties is well below current market value, as state� in your letter of 7-19-79. According to Peter White of the Dept. of Finance and Mgmt. Services , this offer was based on land values in this area in 1976, 3 years ago , when this work was done� in a nearby neighborhood. The value of all real estate has skyrocketed in the last 3 years. 2. The offer made to us for repladement trees and shrubs amounts to approximately 25% of the actual replacement valuQ, as quoted to us by several different nurseries. According to P�ter'�aTh'i.�E, no. .cer.tified. nursery was called..in by- :the� city for an accurate and true appraisal, estimates were made only by. � , their department from markings on a aot too elear survey sheet, of which I have a copy. : 3. Any construction on Gabriel Rd. or on proposed easements _ on our property, will deny us ingress and egress to our prop- erty, as well as to other residents on th� Rd. Even if the work were to be completed before the onset of winter, the un� � � . - - � � 2�368� settled road conditions will make it impossible for oil trucks to get in to deliver heating oil to our home, and for the garbage people to make pickups. It is our experience that Gabriel Rd. is difficult enough to negotiate in winter and during the spring snow melts and rains. Once the� road has been dug up and refilled, the settling process will make the . road impassable altogether, thus increasing and prolonging our hardships. These are facts which the city has neglected to • consider, and has not dealt with when we have made inquiries about same. • 4. We have been informed by real estate people, tha� the installation of an incomplete storm sewer will devalue our - property by as much as a possible$10,000. 00. 5. It is unsatisfactory to us that the city reffiove, set aside and replant the treea and shrubs already situated on our property, as suggested by some of your people. Nurseries have � stated that this process will surely result in damage, and that since no guarant�es can be made on thriving and healthy nursery stock, there certainly can be no guara�tees made on these re- replanted trees •and shrubs. S� �, y ' ������ September 9 , 1979 Regarding: Easement and Road Improvements on Gabriel Road To The Honorable, The Council , City of St . Paul , Minn. Two years ago , 7 out of 13 property owners along the present and proposed Gabr3el Road petitioned for water , sanitary sewer, and street improvements . (Exhibit A) The percentage of land owned ' by these petitioners is over 50%. This proposal could not be done because of �he exL-reme casts of putting the improvements through the crest of the hill on Gabriel Road . Therefore Public Works proposed an easement through four est_ablished lots , choosing these because of the lay of the land for the sewer systems . Another deterent to the proposal was the objection by the land owners on the north end of Gabriel Road where the crest occurs . On June 5 , 1979 a proposal was ratified to obtain the permanent easement rights so that a very small portion (230 ft) of water and sanitary sewer only, could be installed along Gabriel Road and then through the easement which would also contain a dry system for the future of storm sewer . This proposal only serves one pre- � sent home owner ancl one property owner . One other change that has come about is that of the ownership of property that is along one side of Gabriel hill . This has now been sold and the property owners are petitioning for water and sewer which would go up to the crest of the hill . Therefore, the percentage of people wishing the im- provements has been raised . We certainly do not like the idea of an easement , but for engineering reasons , we do agree it is the logical thing to do - but only for what is necessary. Now that land acquistion is more accessable on Gabriel hill we propose that water be brought in from that way . San- itary and storm sewer would go to the crest of the hill , stop , and continue on the other side , through the easement . Also that the road improvements be done, seeing that it would encompass all of the present Gabriel Road and the proposed extension of 230 feet . This improves the developed portion of Gabriel Road and leaves the south- ern portion to be improved when studies are done and ready for devel- opment . This proposal accomplishes several things - a compromise of the original proposal of of 1977 , improvements wanted by a majority of property owners and a job that is not done peace-meal , but a pro- ject done at one t.ime and less cost because of it . If this proposal presents to much of a change at this time , the ease- ment portion could t�e don�.: now and by next spring a satisfactory plan for the road could be accomplished. We do favor the easement being done at this time to facilitate the replacement of trees . September 9 , 1979 ���� / Regarding : Compensation and proce- dure on easement between Gabriel Road and Winthrop To The Honorable, The Council , City of St . Paul , Minn . On June 5 , 1979 the council approved the proposal to (see July 19th letter) . On July 19th, the valuations department sent us a letter stating � the appraised values to be awarded concerning fihe easement and the estimated cost to install replacement trees and shrubs along the easement . We are nd'�i contesting the compensation not for the land itself , but the handling and amount concerning the trees and shrubs . We were told the city does not like getting into the replacement of trees because of claims filed afterward - resulting from damages or dis- satisfacttion of landscaping. It awards the land owner the money equalling the amount destroyed by the easement so that the owner can handle the replacement procedure . We contacted several nurserys to get their estimates for such work. Time and money was spent doing this . As far as we know, the city did not send a nursery out so that a fair estimate could be given. Approximately one week before the scheduled council meeting, we received a letter stating a change of attitude . The city now wants to lift the present trees -some quite large- and put the same trees back. If they are damaged or die within one year (next October) we can then place a claim and the city will replace the tree with an- other years guarentee , and so on. We have been told by all nurserys that our trees , �f lifted and moved , have small chance of survival and they wouldn' t even do it . We would like experienced people to handle this , not a contractor doing sewer work as proposed . The trees that would have to be replaced if need be could not be the same size but smaller . Where is our compensation for the larger tree that is lost? Under this last minute plan, we receive no money for what is lost , we get replacement of damaged trees , plus the headaches of filing claims and have work sti11 being done next fall or longer . In all reality , the improvements could be put down Gabriel Road . In using the easement proposal , the city is saving $70 ,000 . We feel we should b treated fairly. Let us handle the trees and shrubs as we do have �y��►�r� rights on the easement . We are asking to be com- pensated fairly ; the amounts stated before, so that we can get our yards back to where they are now and what we want .
