Lessee does hereby hire and take from Lessor, upon the terms and subject to the conditions hereinafter set forfih, a portion of the premises situated in the Cifiy of Saint Paul, County of Ramsey, State of Minnesota, to wit: � Office Suite #12 in the Zimmerman Building located at 1954 University Avenue, Sainfi Paul, Minnesota 55104, this space consisting of approximately 2,100 square feet on the second floor. 1 . TERM OF LEASE, RENTAL AND OPTION TO EXTEND LEASE The term of lease shall bs for a period of two years commencing October 1, 1979 and ending September 30, 1981, with an aption by the Lessee to extend the Agreement under these fierms for an additional two-year period upon sixfiy (60) days notice to the Lessor. The rental rate under the option to renew wil� be subject to a pro rata share of any increase in real estate taxes and heating costs, using 1979 as the index year. The Lessee covenants and agre�s fio pay the Lessar as rent for the sa�d premises Six Hundred and Fifty Dollars ($650) per month commencing October 1, 1979 and payable in advance on the first day of e4ch and every month during the term of this Agreement. 2. USE OF PREMISES Lessee intends to use the space for genera) office purposes in the operation of the Women, Infants and Children's Supplemental Food Program and the Nutrition Program. 3. IMPROVEMENTS AND MAINTENANCE Lessee may not make improvements to the leased premises without the consent of Lessor. Any improvements made by Lessee with Lessor's consent shall be made at Lessee's expense. Lessor shal! provide four keys to Lessee: two controlling leased office space and two for the bui Iding entrance. ; .. ' -2- Lessor shall during the term of the lease provide the following services and equ ipment: (A) Will paint the premises in a color suitable to the Lessee and will install commercial grade carpet in a color acceptable to the Lessee prior to the occupancy date of October 1, 1979. (B) Will provide offstreet parking on a "space available" basis in areas designated. (C) Will provide approximately 500 square feet of dead storage area in the basement of the premises. (D) Will main#ain the upkeep of the surrounding yard, parking lot, and sidewalk, including the removal of snow and ice. (E) Will mainfiain in proper working order the windows, doors, electrical circuits, heating, water, sewage, gas and electrical services. (F) Will provide routine janitorial services to mainfiain the premises in a clean and sanitary manner. (G) Will provide and maintain existing window air conditioning units. Lessee agrees that i t sha I I: (A) Be responsible for telephone costs, including insfiallation. (B) Conduct business in an orderly and professional manner. (C) Pay one-half of the cost of carpet and instaflation as a single, one-time payment prior to October 1, 1979. 4. UTILITIES Lessor shall furnish at its expenss heat and water. Lessee shall be responsible for electrical costs. 5. ASSIGNMENT OF LEASE Lessee shall not assign or sublet the premises without written consent of Lessor. 6. PLACEMENT AND CONSTRUCTION OF SIGNS Lessee shall not install or construct any signs of a permanent nafiure without consent of Lessor. + r' . ,, ' -3- 7. I NSURANCE The burden of liability resides with Lessee in the event of a personal injury suit brought by a patron and due to the negligence of Lessee, during the normal course of business on leased premises. In case of total or partial destruction by fire or any other casualty so that the premises shall become untenable or unfit for occupancy in whole or in part, Lessor shall notify Lessee in writing within fifteen (15) days as provided herein that it intends to restore the premises, then Lessee may terminate the lease by notice to Lessor in writing within a reasonable time. The rent to be paid hereunder pending such restoration shall be abated in proportion to the loss and impairment of the use of said premises. 8. In the event of a default in the payment by Lessee, or in the performance by Lessee or Lessor of any of covenants or conditions provided herein and if the performing party shall fail to remedy such default within a period of sixty (60) days from and after the receipt of written notice by the ofiher party and specifying such default, then the party not in default shall at its election have the right to terminate this lease or to take any other action for the en- forcement of any right or remedy avai lable to said party. 9. NOTICE AND PAYMENT OF RENTAL All notices herein permitted or required, given by the Lessor to the Lessee or by the Lessee to the Lesso�, and all rentals herein provided to be paid, shall be deemed to have been given or paid when delivered to the respective parties personally or when deposited in the United States mails with postage and addressed to their principal place of business. I�. S�RREtvDER OF P°EN,IS�S On the first day of the term there shall be a pre-inspection jointly by Lessee and Lessor of said premises. On the last day of the term of the lease or on the sooner termination thereof, tenant shall peaceably surrender the leased - : premises in good order, condition.,and repai�, fire and other unavoidable . : casualties, reasonable wear and tear only excepted.
