SPSO contract is in azbitration but Library management wanted to proceed with the tentative agreement to swap
Day After Thanksgiving Holiday with Christmas Eve. This Memorandum of Understanding is necessary to let that
agreement proceed. In exchange, SPSO insisted that an additional tentative agreemant be implemented ahead of
schedule.

MEMORANDUM OF AGREEMENT AND UNDERSTANDING
HOLIDAYS AND SALE OF ACCRUED VACATION
RECITALS
A. WHEREAS, the City of St. Paul (hereinafter `Bmployer") and the St. Paul
Supervisors' Association (hereinafter "Association") are parties to a Collective Bazgaining
Agreement (hereinafter "Labor AgreemenY') that is currently in farce, and
• B. WHEREAS, the parties aze currently engaged in negotiation of the successor
Labor Agreement; and
C. WHEREAS, the parties are scheduled to azbitrate certain specific issues that they
could not resolve through negotiations; and
D. WHEREAS, the parties have reached an agreement as to several other issues,
including the agreement to exchange certain recognized holidays for Association members
employed in the St. Paul Library System and to allow Association members to sell back accrued
and unused vacation; and
E. WHEREAS, the parties mutually desire to implement their agreement with
respect to exchanging the official holidays and with respect to the sale of accrued and unused
vacation prior to completion of the successor Labor Agreement;
• F. NOW THEREFORE, the parties hereby agree as follows:

14.6 An employee may also, at the discretion of the Department Head and additionally,
limited by the availability of funds in the Department's Budget, sell up to five
days, or any portion thereof, of accrued and unused vacation once per year. Such
election must be made in writing on or before December 1 of each IRS payroll
reporting year. If the employee elects to sell vacation, the payment for such sold
vacation shall be made in a lump sum in the nearest full payroll period following
the election date. The payment shall be in an amount equal to the number of
hours sold multiplied by the employee's regulaz rate of pay in effect as of the date
of such election.
14.6(1)Invoking the use of Section 14.4 or 14.5 above at any time within the IRS payroll
reporting yeaz wili prohibit the use of 14.6 above.

14.6 An employee may also, at the discretion of the Department Head and additionally,
limited by the availability of funds in the Department's Budget, sell up to five
days, or any portion thereof, of accrued and unused vacation once per year. Such
election must be made in writing on or before December 1 of each IRS payroll
reporting year. If the employee elects to sell vacation, the payment for such sold
vacation shall be made in a lump sum in the nearest full payroll period following
the election date. The payment shall be in an amount equal to the number of
hours sold multiplied by the employee's regulaz rate of pay in effect as of the date
of such election.

HOLIDAYS AND SALE OF ACCRUED VACATION
RECITALS
A. WHEREAS, the City of St. Paui (hereina$er "Employer") and the St. Paul

Supervisors' Association (hereinafter "Association") aze parties to a ColIective Eargaining
Agreement (hereinafter "Labor AgreemenP') that is currently in force, and
B. WHEREAS, the parties are currently engaged in negotiation of the successor
Labor Agreement; and
C. WHEREAS, the parties are scheduled to arbitrate certain specific issues that they
could notresolvethrough negotiations;and
D. WHEREAS, the parties have reached an agreement as to several other issues,
including the agreement to exchange certain recognized holidays for Association members
employed in the St. Paul Library System and to allow Association members to sell back accrued
and unused vacation; and
E. VJ$EREAS, the parties mutually desire to implement their agreement with
respect to exchanging the official holidays and with respect to the sale of accrued and unused
vacation prior to completion of the successor Labor Agreement;
• F. NOW THEREFORE, the parties hereby agree as follows:
