WHEREAS, Section 4.01 of the City Charter of the City of
Saint Paul provides the City Council shall be composed of seven
councilmen; and
WHEREAS, a vacancy as recognized under City Charter Section
2.04 has occurred in the elective office of councilman by reason
of the untimely death of one of its members, Mrs. RosaTie Butler;
and
WHEREAS, City Charter Section 2.05 does mandate the City
Council to elect a qualified voter of the City to fill said
vacancy in elective office for the remainder of the unexpired
term; and
WHEREAS, City Charter Section 2.02 provides the term of
+ councilman shall be for two years commencing on the first
� Tuesday in June next succeedi�g their election, and until a
successor is elected and qualified; and
WHEREAS, the now deceased Mrs. Rosalie Butler was most
recently declared elected to the Council on April 28, 1978
(C.F. 270976) ; and
WHEREAS, the Council by Resolution C.F. 273512, adopted
August 14, 1979, did set forth a procedure which sought to
afford ma.ximum citizen participation in assisting the Council
in fulfilling its Charter obligation to fill such vacancy; and
WHEREAS, there have been submitted nominations and appli-
cations of qualified persons, together with resumes of quali-
fication and supporting statements for consideration by the
Council; and

RE: Procedures for Hearing andidates
Interested in the Vacant Council Seat
I will be unable to be at the council meeting on Tu�sday,
August 28, but I think the council should establish, �by moti�n,
some procedures_for hearing candidates Wednesday night.. i would .
- -__
suggest that the following procedures be followed: �
1) That the order for candidates speaking
be established by a lottery or draw of
names from a hat.
2) That each candidate be allowed up to
five minutes to present any statements
that the candidate may wish, and
3) That if any City Councilmember has any
questions of any candidate they may ask
such question, and the question may be
answered, outside of the five minutes.
If anybody else has any suggestions, please do not hesitate
to include them in the motion on Tuesday.

and i feel strongly about the democratic party following
our former governor/senator's (Wendall Anderson) footsteps
and making an appointment that will create an uproar among
the citizenry. I will appear for an interview the night

vacant seat of the St. Paul City Council.
Please consider my candidacy only in light of a caretaker position
should the need arise for yon to do so. In other aords I am only
interested in serving out the current term and I �rill not seek elect—
ion to the City Council in 1980.
In addition to being an alternative to a possible impending stale—
mate in your process� a caretaker type council would allow for every—
one seeking election to start out together next spring. �lthough the
law is clear� that the council does have the anthority and responsi—
bility to fill the vacancy, I sense a feeling by mar�y of ovr citizens
that they would like to be a part of the process.
CMy reasons for applying for the position are:
1. I am a life long resident of St. Paul� am familiar wi.th most
of it's problems and concerns and�have been an active participant
(mostly behind the scenes) in resolving them..
2. I think the Council members that currently are in office make
up a very good team and I think I could be a positive influence
on the team.
3. The publicity that I would gain from doing a good job would
help me in the future� should I choose to run for public office
again.

Statement to the St. Pau� City Council by applicant, Sharon L Anderson
Scarrella . YOU AF3E NOT GOING TO PICK THE BONES OF !� DEAD WOMAN
Over my dead body is this Qouneil, which by charter and law a legislative,
functioning unit, going to deprive me or anyone else of our constitutional
right to vote for and hold elective office.
We will not give, sell or have our vote exthorited from us, and we
deny and protest the fact that the (6) council pers�ns, (4) mem and (2)
women, Hozza, Maddox, Levine, Tedesco, Auby Hunt and Joanne Showwalter,
elected by the voters, salaries of approximately 25 Thousan� dollars yrly,
paid for by our taxes, have the ga11 to "appoint" or elect anyone not approv-
ed by the ma�ority of the voters of St. Paul,

Aegarding a paid for ad for applicant George McMahon, dated Thurs . April
20, 1978, in which the following names were mentioned, Niayor George Latimer,
Leanard W. Levine, David H. �ozza, Auby Hunt, apparantly indicating a pre-
�udical and bias interest in that applicant, and if in fact the MQyor or
any of the named council persons donated gif t's, financial support, We
believe in the Ethic's of Good and responsive Government, that this Council
is duty bound to request an "Advisory Opinion", from the State Ethical
Practices Board, to insure compliance with The Fair Campaign Practices Act,
and the necessity of a Campaign Finance Disclosure, Economic Interest Dis-
closure, and a Conflict of Interest Disclosure„ and perhaps when the
nomination of George McMahon, the f�llowing persons should disqualify them-
selves from voting - Latimer, Levine, Tedesco, Hozza, and Hunt, to eliminate
an� suspicion and distrust by the voting public for anyone 's pecuniary
or financial gqin, as I understand McMahon is over 30 thousnad in debt from
his last campaign. Does he owe any of you any mane��?, or your relatives?
Further as thE; city attorney Ed Starr, and the entire counail has
been served with this applicants demand as a qualified voter and taxpayer,
in accordance with the l�innesota State Constitution to seek a �udicial
determinatian on the constitutionality of our right to vote for an elective
office, and .as the only qualific9�tions necessary is that of a qualified
voter of St. Paul, and as Auby Hunt's qualifications of that of a "House-

wife" and her commission on the State Board of Judicial Standards, and the
entire councils Oath of Office to uphold and support the Constitution of
the U.S. and Minnesota, would appear that to appoint anyone would be exceed-
ing their authority and scope of employment, and "horror's to usurp the
aath of office and the State Constitution.
Therefore as a qualified Voter tax-payer, either leave the Seat F
Vacant or answer to your constitutency, or Aesign from Office yourself's.
Or better yet, hire your own personel lawyer.
