WHEREAS, The Department of Planning and Economic Development
has determined that the City Market would likely generate more
revenues for the City of Saint Paul if the City were to lease the
property to a private party who, during weekdays, would operate
and manage the Market as a public parking facility; and
WHEREAS, There presently exists an outstanding Lease Agreement
between the City and Midas Corporation which sets forth the terms
and conditions under which the property would be leased to Midas as
a public parking facility; said lease not having been formally
authorized by the City Council; and
WHEREAS, The Director of the Planning and Economic Development
has determined that a properly authorized lease of the subject
property for the purposes stated above to Midas would be in the
best financial interest of the City and has therefore recommended
that the Council authorize the execution of such a Lease Agreement;
now, therefore, be it
RESOLVED, That the proper City officers are hereby authorized
and directed to execute on behalf of the City of Saint Paul a
Lease Agreement of the subject property for the above stated
purposes with Midas Corporation in a form and manner approved by
the City Attorney' s office; and, be it
FURTHER RESOLVED, That the terms and conditions of this Lease
Agreement shall supercede and take the place of those terms and
conditions of the existing Lease; and, be it
FURTHER RESOLVED, That this Lease shall not destroy nor con-
flict with that certain Operating Agreement authorized by Council
Resolution C.F. 273408, adopted July 26, 1979, it being the intent
of the Council that these Agreements shall not work in competition
with but in harmony with each other.

operator. City Purchasing publicly advertised for bids and Midas Corporation
was the successful bidder. They now operate the facility awaiting a formal
agreement.
