THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN: Section l. That Section 410.05 of the Legislative Code is hereby amended to read as follows: 410.05--���e-a�� Police Approval. The application shall be referred to ��e-���+e-Be�a���e�� a�� the Police Department, who shall report to the City Council at its next regular meeting following the filing of the application. Unless �l�e-���e-6��e�-a��.�the_ Chief of Police recommends the granting of the .permit, the City Council shall deny the application. If ��e-���e 6��e�-a�e� the Chief of Police recommends that the permit be granted, the City Council shall take action either granting or denying the same. Section 2. This ordinance shall take effect and be in force thirty (30) days from and after its passage, approval and publication. McCloskey, Jr. Assistant City Attorney RE: Manuel and Jessie Rosillo On the evening of August 26, 1978, Jessie Rosillo was arrested by Officer Michael Moorehead on a charge of driving while under the influence. Also taken into custody were Ma.nuel and Antonio Rosillo, brothers of the defendant. It is my understanding that Jessie Rosi].lo was convicted of the charge of driving under the influence, however, a few days subse- quent to his arrest, he and his brothers filed complaints with the St. Paul Human Rights Department alleging discrimination in the ma.tter of their arrest. In response to complaint letters received by this office from the St. Paul Human Rights Department requesting interviews with two particular officers, we requested from Mr. Lewis a written waiver of his right to criminally prosecute the matter. He declined to submit such a waiver and has retained his right to criminally prosecute, the latest confirma.tion of which is the attached February 26, 1979 letter from R. Scott Da.vies, special counsel to the depart- ment in this ma.tter. Mr. Davies was retained by the Human Rights Department at a fee of $40.00 per hour by Council action dated December 1, 1978. On March 6, 1979, in response to a request from Mr. Davies that the involved officers and myself appear in the department' s offices for an interview, I asserted the Fifth Amendment privilege on J � + . � Councilma.n Ron Maddox Page 'I�ao March 13, 1979 behalf of the officers approxima.tely sixty times for each individual. Even though I advised Mr. Da.vies and the departmental investigator, Jackie Cooper, that we would not cooperate because of Mr. Lewis ' threat of criminal prosecution, they insisted on proceeding through their entire prepared list of questions, and so the Fifth Amendment was asserted. This particular file is approxima.tely the seventh occasion that I have had since August, 1978 to assert the Fifth Amendment privilege on behalf of St. Paul police officers and Parks and Recreation employees. In each of these other matters, Mr. Lewis declined to waive his right to criminally prosecute, and accordingly, I advised the fifteen or so individuals involved in these seven files to de- cline to testify against themselves.
