01-10140�(GINAL Council File # 0,� �Ol� Green Sheet # � � J O� .5.�' SAIN7' P�,CI�L, MINNESOTA Presented By Referred To Committee: Date �� WHEREAS, Chapter 5.02 of the St. Paul Administrarive Code authorizes the Division of Contract and Analysis services to dispose of surplus City property and sets forth the procedures goveming the sale or donarion of such property; and WHEREAS, the Division of Pazks and Recrearion has plants at Town Square Pazk, and has determined that these aze no longer needed to carry out departmental funcrions as the pazk was closed to public use in January, 2001; and WHEREAS, the Division of Pazks and Recreation has been working with Minnesota Green, which has requested that any plants which cannot be disposed of via public sale be donated to its organizarion so that they may be distdbuted to schools, hospitals, nursing homes and other similaz facilities; and WHEREAS, the donarion of plants to Minnesota Crreen would further the Division of Parks and Recreation environmental missions, and, therefore, would serve a public purpose; now THEREFORE, BE IT RESOLVED THAT, the City Council hereby authorizes the donation of the above describes surplus property to Minnesota Crreen; and be it FURTHER RESOLVED, that said organization shall take responsibility for removing the surplus proper[y from City premises in a manner and in accordance with the rimeline mutually agreed upon with the Division of Parks and Recreation and shall bear all costs associated with the removal and transportation of the designated surplus properry and agrees to accept the property as is, and be it FINALLY RESOLVED, that upon the donation, the City shall have no further responsibility for said property and shall not provide any warranty, maintenance, repair, technical assistance, or any other kind of ongoing support, nor assume any costs that may be related to the ongoing use of the property by the donee organization.
