WHEREAS, the Council of the City of Saint Paul met on
May 2, 1979, to hear evidence in connection with the recommendation
of the License Inspector that the Used Auto Part Dealers License
pursuant to Chapter 343 of the Saint Paul Legislative Code issued
to John Darlow at 1515 Rice Street be revoked; and
WHEREAS, evidence was introduced by the License Inspector
that notice was mailed of a hearing scheduled for April 25, 1979,
in connection with this matter; and
WHEREAS, evidence was introduced that the hearing was
continued to May 2, 1979, at 9:00 a.m. , with the concurrence of
Dennis F. Peck, the attorney for the licensee; and
WHEREAS, the notice of the hearing contained specific not-
ification of the licensee's right to have an attorney present; and
WHEREAS, neither the licensee or his attorney appeared at
the May 2, 1979, hearing; and
WHEREAS, the absence of the licensee was noted for the record,
and the License Inspector was instructed to proceed; and
WHEREAS, evidence was introduced that on the licensed premises
at 1515 Rice Street in addition to the license activities the
licensee was operating a junkyard; and
WHEREAS, further evidence was introduced that the licensee
had not complied with assurances he made to the Council during a
public hearing in January of 1979 that he would phase out the
business at 1515 Rice Street with a final closing date scheduled
for August of b979; and

WHEREAS, the premises at 1515 Rice Street are not properly
zoned for the operation of a junkyard; and
WHEREAS, after reviewing the evidence the Council did move
that the Used Auto Parts Dealers License issued to John Darlow
be revoked.
NOW THEREFORE, BE IT RESOLVED by the Council of the City
of Saint Paul that the Second Hand Dealers License issued to
John Darlow doing business at 1515 Rice Street is hereby revoked.
