WHEREAS, Macalester College has requested permission to reconstruct the
sidewalk adjacent 1648 Grand Avenue in a manner in conflict with the City of
Saint Paul , Minnesota, Department of Public Works, Standard Detail Plates,
specifically by installing an unglazed brickplate tile surfaced sidewalk,
now therefore, be it
RESOLVED, That pursuant to provisions of Chapter 207 and 208 of the Saint
Paul Legislative Code, the Director of Public Works is hereby authorized to
issue to Macalester College or to a licensed and bonded sidewalk contractor
acting as agent for said College, a permit to reconstruct the sidewalk adjacent
to Lot 3, Block 6, Elmer and Morrison's Rearrangement of Part of Macalester Park,
by installing unglazed brickplate tile, said permit is granted and made expressly
subject to the following terms and conditions:
1. That said permittee shall , at its own cost and expense, and
in accordance with all applicable ordinances of the City of
Saint Paul , construct and maintain said sidewalk;
2. That said sidewalk construction and installation shall be in
strict conformance with plans approved by the Department of
Public Works;
3. That said permittee shall pay the costs of inspection and
publication of this resolution;
4. That said sidewatk shall be removed by and at the sole cost
of said permittee whenever the Council of the City of Saint
Paul shall by resolution determine such removal necessary in
the public interest and accordingly order its removal ;
5. That said permittee shall furnish a Surety Bond to the City of
Saint Paul in the sum of Ten Thousand Dollars ($10,000.00)
conditioned to comply with all the terms of this resolution

and to indemnify said City from all liability, costs
and expenses that may accrue, occasioned by the making
of the improvement or arising out of the same;
6. That said permittee and its successors in interest shall
hold harmless, indemnify and defend the City of Saint Paul
against any and all liability on account of all claims,
causes of action, suits, and judgments or on account of
injury to persons and/or property arising from and connected
with the construction, maintenance or operation of said
sidewalk;
7. That supplemental to all other obligations on its part,
said permittee and its successors in interest shall
furnish and maintain and pay all premiums and other
expense for public liability insurance coverage by an
insurance company licensed to do business in the State
of Minnesota in an amount of $250,000.00 against liability
for injury to any one person and $500,000.00 for personal
injuries in any one accident, and against liability for _in�,.ury
to property in an amount of $100,000.00 for any one accident,
and in the said amounts and for the said purposes respectively,
indemnifying said permittee, its successors in interest, and
the City of Saint Paul against liabi) ity on account of all
� claims of third persons for injury to person and/or property
arising from or connected with the construction, operation
or maintenance and/or removal of said sidewalk and shall
furnish a certificate of said coverage from time to time to
the Office Engineer, Department of Public Works and must be
of a form acceptable to the City Attorney;

8. That said permittee shall within thirty (30) days after
the effective date of this resolution file with the City
Clerk its written acceptance of the terms, provisions
and conditions of this resolution.
