Referred To Committee: Date Out of Committee By Date RESOLVED, That permission and authority is hereby granted to Champion International Corporation (Hoerner Waldorf) to install , operate and maintain two traffic warning signs with flashers on Vandalia Street, in accordance with ptans and specifications approved by and under the direction of the Traffic Engineer of the Department of Public Works and subject to the following terms and conditions: 1 . That Champion International Corporation shall pay the costs of inspection and of publication of this resolution; 2. That said traffic warning signs shall be removed by and at the sole cost of Champion International Corporation whenever the Council of the City of Saint Paul shall by resolution determine such removal necessary in the public interest and accordingly order its removal ; 3. That Champion International Corporation shall take out and maintain comprehensive protective public liability insurance which shall remain in force and effect as long as said traffic warning signs are located on Vandalia Street right-of-way. This liability insurance shall fully indemnify, hold harmless, and defend the City of Saint Paul , its agents, officers and employees from any and all damages, claims, losses, judgments, suits or expenses on account of all claims of whatever nature arising out of or connected with the installation, operation, maintenance, and/or removal of said traffic warning signs. The liability insurance shall be issued by an insurance company licensed to do business in the State of Minnesota and the premium and all expenses incidental thereto shall be paid _promptty by the permittee initially and upon renewal . A certificate of this`insurance policy shall be submitted to the Department of Public Works, and must be of a form acceptable to the City Attorney. Champion International Corporation and the City shall be named as jointly insured with limits of liability indicated as follows: Bodily injury insurance (including death) in a amount of not less than $250,000,00 for all damages arising out of bodily injuries to or death of one person, and, subject to the same limit for each person, in a total amount of not less than $500,000.00 on account of any one accident. Property damage insurance in an amount of not less than $150,000.00 for all damages to or destruction of property in any one accident, and subject to that limit per accident, further subject to a total of not less than $200,000.00 for all damages to or destruction of property during the policy period. The insurance coverage shall automatically be restored immediately after the occurance of any accident or loss from which liability may thereafter accrue and the City of Saint Paul shall be notified at least 30 days in advance of the cancellation of the insurance coverage by the issuing insurance company; 4. That Champion International Corporation shall within thirty (30) days after the effective date of this resolution file with the City Clerk its written acceptance of the terms, provisions and conditions of this resolution.
