�uthoriaed and directed to execute Pigeon Reduction Agree-
ments covering the periods of Octaber 15, 1979, through
March 15, 1980, and October 22, 1979, through M�arch 15,
1980, with the Chicago, Milwaukee, St. Paul and Pacific
Railroad Compt�ny and Burlington Narthern Inc., respectively,
st�id agreements at no cost to the City and providing for the
City' s in�demnification of said Railroad Compnnies for the
negligent acts of the City' s employees or mgents while
conducting said program an Railroad property.

by and between BURLINGTON NORTHERN INC., hereinafter referred to as"'Northern"and C'It_Y Of $t. Paul
Department of Communi tv Services , hereinafter referred to as '"Contractor".

WITNESSETH,THAT
For and in consideration of the payment to be made by Northern to Contractor of$ N�C
upon the completion and acceptance of Contractor's performance, Contractor hereby agrees with Northern to
conduet a piqeon reduction program on some of the BN track areas from October �� -
22, 1979 to Nlarch 15. 1980, per attached letter dated Octob r 76� 1979
at or near $t. PdU� � M71111@SOtd . Contractor shall commence the work not later than

Contractor shall prosecute and complete the woric according to his own manner and methods and with and by his
own means and employees, free from any supervision or control whatever by Northern except only such inspection
as may be necessary to enabte Northern to determine whether the work performed complies with the requirements
of this contract and conforms to the plans and specifications, it being the intention of the parties hereto that
Contractor shall be and remain an independent contractor and that nothing herein contained shall be construed as
� inconsistent with that status. Contractor shall be obligated to comply in all respects with the provisions of all
applicable federal and state laws, including Price Control Acts, Social Security Acts,Unemployment Compensation
Acts, Workmen�s Compensation Acts, Equal Opportunity Acts, and Wage and Hour Acts, and with all applicable
orders, rules and regulations of federal and state officials and agencies;and Contractor agrees to indemnify and save
harmless Northern of and from any and all claims, demands, aetions, recoveries, judgments, costs and expenses in
any manner arising from Contractor"s failure to comply with any of said federal and state taws, orders, rules, and
regu latio ns.
Contractor snall secure all necessary permits which may be required by governmental authority for the prosecution
of the work to be done hereunder and shall comply with all requirements of all competent governmental authorities
relative to the prosecution of such work and the hiring of employees therefor.
Contractor shall furnish all tools and equipment needed in performance of this agreement at his sole cost and
expense.
It is further agreed that Contractor shall indemnify and save harmless Northern from all loss, claims, costs and
expenses resulting from damage to or destruction of any property, or injury to or death of any person or persons,
including the parties hereto and their employees, in any manner arising from or growing out of the above mentioned
work.

our Terminal Manager, telephone number 298-2255 when you will
be on our property.
Also, attached in duplicate is Form 15227 covering your
authority to conduct a pigeon reduction program on some of
the BN track areas from October 22, 1979 until March 15,
1980. Please arrange for execution on behalf of the City
