SUBJECT: Request waiver. of St. Paul Legislative Code , Section 13, 06 ,
pertaining to requirement that heating plant be enclosed with one-hour
fire rated materials or , as an alternative , that two autvmatic sprinkler
heads be installed over tlze heating plantin lieu of providing a one-hour
fire rated ceiling, because of financial hardship.

PROCEEDIN�S : Mrs . Miller stated that at the time she and her husband had
taken out a Title I loan to repair their property, the city had not speci-
fied that the boiler room would have �to be enclosed with sheet rock or, as
an alternative , that t�o automatic sprinkler headsbe installed. At an
inspection after all the work had been done under the Ioan, the city be-
latedly had listed this as an additional requirement. Mrs . Miller explained
that she and her husband had absolutely no further funds to work with and
were 3iving on borrowed money at this time. She asked that the requirement
be waived or that they be allowed a year or two to comply, that her husband
was just starting a business of his own in a building adjacent to the
pr�perty and did not want to sell the rental property because he hoped to
use the additional space someday when his business had grown.
Alice Bijjani expressed regret that the requirement had been overlooked
by the inspector prior to the appellant' s obtaining a Title I loan, but
she said it was an item that involved life safety that coulc� no� be ignored.
Chairman Wozniak said he could not recall the board evex having waived a
requirement involving a serious hazard to life or health, although in
some cases additional time was granted.
BOARD ACTION: Chairman Wozniak moved to grant a time extension of 90
ays to comply with the city�s order to either install sheet rock as
rec�uired or put in automatic sprinkler heads . Mr. Glassman seconded.
MOTION CARRIED AND SO ORDERED.
