WHEREAS:
l. Minnesota Public Radio, Inc. (MPR) is a nonprofit corpor—
ation organized under the laws of the State of Minnesota for the
purpose of producing and broadcasting public radio programming in
this region;
2. MPR is a "listener-supported" public radio service which
is exempt from State tax under Section 209.05 of the Minnesota
Income Tax Act and from Federal tax under Section 501 (c) (3) of
the I�ternal Revenue Code as a nonprofit educational organization;
3. MPR proposes to license space from Northern States Power
Company and Northwestern Bell Telephone, Inc. , on telephone goles,
power poles, and in ducts under City streets for the purpose of
connecting a satellite earth station to its studio by two IF co-
axial cables and one set of control wires;
4. The proptssed tatal d�s�aric� ta be trav�rsed is �pproxi-
mately 4.17 miles, consisting of 147 poles and 5,000 feet of
understreet duct;
5. Section 16.01 of the Saint Paul City Charter provides
that no corporation shall place or maintain permanent fixtures in,
over, upon, or under any street or public place without a franchise
from the City;
6. MPR has represented to the City that its license agree-
ments with Northern States Power Company and Northwestern Bell

Telephone will not require new poles and ducts to be put up
solely for MPR' s operations;
7. On October 12, 1979, the Energy, Utilities and Environ-
ment Committee of the City Council considered MPR' s request to
be allowed to enter into license agreements with Northern States
Power Company and Northwestern Bell Telephone without obtaining
a franchise;
8. The Committee decided to recommend to the City Council
that MPR be allowed to enter into said license agreements with-
out obtaining a franchise upon receiving documentation showing
a willingness to enter into said license agreements by Northern
States Power and Northwestern Bell;
9. Northern States Power and Northwestern Bell has sent
documents indicating a willingness to enter into the above-de-
scribed license agreements with MPR.
10. The City Attorney' s office has reviewed said agreements
and finds them to be satisfactory;
therefore, be it
RESOLVED, By the Council of the City of Saint Paul, that
the City gives its consent to MPR entering into license agreements
with Northern States Power Company and Northwestern Bell Telephone,
Inc. , for the purpose of connecting its earth station to its
studios without obtaining a franchise; ancl be it
