WHEREAS, Pursuant to Minnesota Statutes, � 462 .357 and � 64.210 of the Legislative Code, John 0. Murrin - Zoning File #8493 Dear Madam: This is written in response to the petition of John 0. Murrin to rezone from RM-2 (Multiple Family, Medium Density) to OS-1 (Office Service) property on the north side of Grand Avenue between St. Albans and Dale Street for the purpose of law offices. The Current Planning and Zoning Corimittee held a public hearing on September 6, 1979. There was no opposition present at the hearing and one letter was presented in support of the rezoning. The Committee recommended approval on a vote of 4 to 0 with one abstention based on findings that the site was previously zoned commercial , the proposed use is compatible with adjacent land uses and the District 16 proposed land use plan designates this site as commercial/residential mix. The District 16 plan also supports the preservation of existing buildings on Grand Avenue. The rezoning meets the intent of the OS-1 zone, other uses permitted in the OS-1 zone would not be detrimental to the community. The Planning Commission upheld this recommendation for approval on a unanimous 18 to 0 vote on September 14, 1979. This matter is scheduled to be heard by the City Council on November 13, 1979. The Restoration Restaurant is adjacent to the west; Just Grand, a retail shop, to the east; a mixture of commercial uses abut the site across Grand. G rand is a collector street. � E. FINDINGS: � 1 . The 1963 Comprehenisve Land Use Plan designated the site as Hiqh Densitjr - Residential . 2. The site was nreviously zoned Commercial . 3. The 1975 Zoning Ordinance designated the site as RM-2 (Medium Density - Residential . � 4. Grand Avenue is a mixture of Residential-Gommercial zoning, _ reflecting existing uses in 1975. The lot adjacent to the west is zoned B-2; lots to the east are RM-2: lots to the south are B-3. 5. The Restoration, a restaurant, is adjacent to the west. Just Grand, a retail shop, is adjacent to the east. These recent additions to Grand Avenue reflect a renewed interest in and vitalization of this street. , 6. The District 16 proposed Land Use Plan designates this site, as well as the rest of Grand Avenue, as Commercial/Residential P�lix. The existing proposed use of the site complies with this objective. 7. The District 16 Plan documents human services as a need; these human services. specifically include legal services. 8. The District 16 Plan also supports the preservation and restoration of build}ngs which "provide continuity to the street's appearance." The subject site contributes to the street's appeal . 9. Section 60.471 states the intent of the OS-1 : "The OS-1 Office-Service District is intende� tQ accamrnod�te various types of office uses performing administrative, pro- fessional and personal services and to serve as a transitional use between the more intensive uses of land such as major thoroughfares or commercial districts and the 7ess intensive uses ot' land sucn as one-family residential ." .
