An Ordinance amending Chapter 60 of the
St. Paul Legislative Code pertaining to
zoning for the City of Saint Paul and the
zoning maps thereof.
WHEREAS, Pursuant to Minnesota Statutes, � 462 .357 and
� 64.210 of the Legislative Code, John 0. Murrin duly petitioned
to rezone Lot 21, Block 1, Summit Park Addition, located on the
north side of Grand Avenue between St. Albans and Dale, from RM-2
to OS-1 for the purpose of constructing law offices, the petition
having been certified by the Department of Finance and Management
Services on July 23, 1979 as having been consented to by at least
67� of the owners of the area of the property to be rezoned, and
further, having been consented to by at least two-thirds of the
owners of the property situated within 100 feet of the total
contiguous descriptions of real estate held by the same owner or
any party purchasing any such contiguous property within one year
preceding the date of the petition; and
WHEREAS, The current planning committee on September 6, 1979
conducted a public hearing for the purpose of considering the re-
zoning petition, and, pursuant to Section 107.03 of the Administra-
tive Code, submitted its recommendation to the Planning Commission
that the petition be granted; and
WHEREAS, The Planning Commission considered the rezoning
petition at its meeting held on September 14, 1979 and recommended
that the City Council approve the petition; and
WHEREA5, Notice of a public hearing before the City Council
on the said rezoning petition was duly published in the official

WHEREAS, A public hearing before the City Council, having
been conducted on November 13, 1979 where all interested persons

THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section l.
That the zoning map of the City of Saint Paul, Sheet No. 27,
as incorporated by reference in Section 60.401 of the Saint Paul
Legislative Code, as amended, is hereby further amended as
follows:

Dear Madam:
This is written in response to the petition of John 0. Murrin to rezone
from RM-2 (Multiple Family, Medium Density) to OS-1 (Office Service)
property on the north side of Grand Avenue between St. Albans and
Dale Street for the purpose of law offices.
The Current Planning and Zoning Corimittee held a public hearing on
September 6, 1979. There was no opposition present at the hearing and
one letter was presented in support of the rezoning. The Committee
recommended approval on a vote of 4 to 0 with one abstention based on
findings that the site was previously zoned commercial , the proposed
use is compatible with adjacent land uses and the District 16 proposed
land use plan designates this site as commercial/residential mix. The
District 16 plan also supports the preservation of existing buildings
on Grand Avenue. The rezoning meets the intent of the OS-1 zone, other
uses permitted in the OS-1 zone would not be detrimental to the
community.
The Planning Commission upheld this recommendation for approval on a
unanimous 18 to 0 vote on September 14, 1979.
This matter is scheduled to be heard by the City Council on November 13, 1979.

JOHN 0. MURRIN (#8493) : A petition to rezone from RM-2 to OS-1 property on the

The petitioner was present. There was no opposition present.
Due to lack of time and the fact that no opposition was present at the hearing, it
was decided not to show slides of the site nor to give the staff report.
Mrs. McNeally stated that the staff recommends approval of the rezoning request.
There was one letter from residents of 653 Grand Avenue stating their support af
the rezoning request.
Hearing no testimony, t�r. Bryan closed the public hearing portion of the meetfng.
� Mr. Pangal made a motion to approve the request for rezoning based on findings 2 and
4 through 12 of the staff report. Mr. FitzGibbon seconded the motion. The motion
to approve the rezoning request was passed with a roll call vote af 4 in favor and
1 abstention. '

A. SUFFICIENCY: The application to rezone was filed on a consent petition, subscribed and
sworn to before a notary public on May 11 , � 1979;: declared sufficient by Finance Dept. on
July 23, 1979; and received in the Planning Division on July 30, 1979. 15 parcels were
eligible; 10 signatures were required; 10 signatur.es were obtained. The purpose was
stated as R1�1-1 to OS-1 for Law Offices.
B. PURPOSE: The applicant proposes to rezone in order to continue use of the Metropolitan
Lebal Clinic. `.
C. FRONTAGE & AREA: This irregular lot has frontage of 40' on Grand Avenue and depth of
150 , for an approximate area of 6,800 sq. ft.
D. SITE/AREA COPJDITIONS: The site is occupied by the Metropolltan Legal Clinic, a restored
we ing fronting on Grand. The law offices occupy the first floor, with apartments above.
There is also a small , two story structure located on the alley and used for a residence;
and a single car garage. There is room for parking a couple of cars in front of the
garage. The Restoration Restaurant is adjacent to the west; Just Grand, a retail shop,
to the east; a mixture of commercial uses abut the site across Grand. G rand is a
collector street. �
E. FINDINGS: �
1 . The 1963 Comprehenisve Land Use Plan designated the site as Hiqh Densitjr - Residential .
2. The site was nreviously zoned Commercial .
3. The 1975 Zoning Ordinance designated the site as RM-2 (Medium Density - Residential . �
4. Grand Avenue is a mixture of Residential-Gommercial zoning, _ reflecting existing uses
in 1975. The lot adjacent to the west is zoned B-2; lots to the east are RM-2:
lots to the south are B-3.
5. The Restoration, a restaurant, is adjacent to the west. Just Grand, a retail shop,
is adjacent to the east. These recent additions to Grand Avenue reflect a renewed
interest in and vitalization of this street. ,
6. The District 16 proposed Land Use Plan designates this site, as well as the rest of
Grand Avenue, as Commercial/Residential P�lix. The existing proposed use of the site
complies with this objective.
7. The District 16 Plan documents human services as a need; these human services.
specifically include legal services.
8. The District 16 Plan also supports the preservation and restoration of build}ngs
which "provide continuity to the street's appearance." The subject site contributes
to the street's appeal .
9. Section 60.471 states the intent of the OS-1 : "The OS-1 Office-Service District is
intende� tQ accamrnod�te various types of office uses performing administrative, pro-
fessional and personal services and to serve as a transitional use between the more
intensive uses of land such as major thoroughfares or commercial districts and the
7ess intensive uses ot' land sucn as one-family residential ." .
In this case, the QS-1 would serve as a transition between RM-2 zoning to the east
and B-2 zoning to the west.

10. Uses permitted in the OS-1 zone would not appear to be potentially detrimental
to the neighborhood. =
11 . Although off-street parking cannot be required for existinq structures, it
would appear that the OS-1 zoning would generate minimal traffic and parking.
There are 2 - 3 spaces on the si.te, as well as on-street parking on Grand.
12. There is a Certificate of Occupancy for 3 units for this �site.
F. STAFF RECOMMENDATION: Based on Findin�s Z & 4-12, Staff recommends approval of the�
