On September 6, 1979, the Current Planning & Zoning Comnittee of the Planning Comnission held a public hearing. Five people spoke in support of the rezon- ing and letters of support were submitted from the HRA, the State Historical Society, and an adjacent neighbor. There was also considerable opposition present at the hearing. District 8 and the Ramsey Hill Association also opposed the rezoning. Major concerns included the encroachment of parking and business on a residential neighborhood and granting a conforming status to the existing building. The Committee voted 4 to 2 to recomnend approval of the rezoning. On September 14, 1979, the Planning Commission voted 12 to 6 to recommend denial of this rezoning request. This vote was in response to objections raised by the Ramsey Hill Association; however, the Planning Commission directed staff to work with the Ramsey Hill Association, District 8 and the applicant, Mr. Gadbois, to attempt to find a compromise solution. The Ramsey Hill Association letter, dated October 17, 1979, reflects that compromise: rezoning to B-2 of the land occupied by the building and proposed patio and rezoning to P-1 for all that land to be used as parking. At a public hearing before the Board of Zoning Appeals on October 23, 1979, the Ramsey Hill Association supported variances to allow Mr. Gadbois to construct an outdoor patio and off-street parking lot. The compromise solution, if adopted, would result in a rezoning of the north 50' of Lot 9 and the west 28' of the north 50' of Lot 10, Block 16, Woodland Park Addition to P-1 and the north 50' of Lot 11 and the east 15' of the north 50' of Lot 10, Block 16, Woodland Park Addition to B-2. The residents who have worked with Mr. Gadbois recoimnend to the Board of Directors that the Ramsey Hill Association support the prbposed compromise. This letter is to advise the City Council of our full support of the proposed compromise, namely: 1. B-2 zoning for the land occupied by the building and proposed patio, with a variance as necessary to facilitate the develop- ment of the patio. 2. P-1 zoning for all land to be used as parking with variances as necessary to provide for a three-foot seLback with screening from the sidewalk to the north; a ten-foot setback with proper screening for the residential property imraediately adjacent to east; and no setback from the property line to the south. This proposal allows for a 47' by 65' parkin� lot to be used for ten cars. It is our understanding that zoning the property according to these guidelines is satisfactory to all involved and provides Mr. Gadbois with the space . needed for proper redevelopment of the property. There was opposition present at the hearing. Mrs. McNeally showed slides of the site and reviewed her staff report recommending approval of the rezoning request. Leo Gadbois of 1412 Prosperity explained that it is necessary to construct a patio on the site to help eliminate water from draining into the basement. He has acquired 50 feet of the adjacent lot, which is unbuildable as a residential site, and he will use this area for parking. Julie Hiebert from the Oistrict 8 Council bro�gh� a letter frcm th2 Council expla�ning their opposition to the rezoning request. William Hanrahan of 601 liolly brought a letter fr�� the Ramsey Hill Association stating their opposition to the rezoning request. He is �n support of the rehabilitation of the building, but the rehabilitation should be dane under �he current nonconforming use. The applicant should consider buying the HRa lo� across the street for use as a parking area. Leor�ard Edstrum, northeast c�rner of Ashla��� ��nd Dale, was �;n favor of J�e rezoning request and felt the off-street parking area is a good idea. Carol Mottaz of 455 Grand stated she was in favor of the rezoning request and the off-street parking area. . Joanne Kessler of 13b8 Ashland testified in favor of the request for rezoning and felt �hat the additional parking would be beneficial to the area. John McLaughlin of 152 City Hall , lives in the area and feels that the additional parking would be a plus for the neighborhood. a problem exists with the junk car lot adjacent to the property in question. - - Philip Olmonick of 367 Ramsey stated he is currently purchasing property in the area and that the additional parking will be good for the area. Hearing no further testimony, Mr. Bryan closed the public hearing portion of the meeting. Mr. FitzGibbon made a motion to approve the request for rezoning based on findings 1 and 2 and 7 through 17 of the staff report. Mrs. Summers seconded the motion.
