4 pursuant to the provisions of the Saint Paul Zoning Code for property located on the St.

Whereas, the Zoning Committee of the Commission conducted a public hearing on
August 3, 200Q after having provided notice to affected property owners, and submitted its
recommendation to the Commission. By its resolution number 00-50, dated August 11, 2000,
the Commission decided to grant the application, subject to specific conditions, based on the
following findings and conclusions:

The city's adopted comprehensive plan and development or project plans
for sub-azeas of the city.
The site plan meets trus condition.
Applicable ordinances of the City of Saint Paul.
The site plan meets this condition:
- The use is permitted. The College of Saint Catherine's has a Special
Condition Use Permit and an athletic field is considered a permitted
accessory use for the college.
- Staff does not anticipate that the activities on the field will exceed any
noise limits.
- As part of building the field, a number of trees must be removed.
However, the campus is not in a tree preservation district that
regulates the removal of trees and sets standards for replacing trees.
36 - The field complies with required setbacks. The zoning code does
37 not establish a minimum setback for athletic fields but it requires a
38 50-foot setback for buildings on college and the soccer field would

8 The site plan meets this condition. Construction of the soccer field will
9 result in the removal of a number of existing mature trees. However, most
10 of the remainiug undeveloped land on the college's campus is wooded and
11 so any other feasible location for a soccer field would also result in a
12 similar loss of trees.

14 (4) Protection of adjacent and neighboring properties through reasonable
15 provision for such matters as surface water drainage, sound and sight
16 buffers, preservation of views, light and air, and those aspects of design
17 which may have substantial effects on neighboring land uses.

Preservation of unique geologic, geographic or historically significant
characteristics of the city and environmentally sensitive areas.
19 The site plan meets this condition. Steps will be taken to improve existing
20 drainage problems and the field will be screened by new landscaping. (See
21 items 8 and 9 below.) The field will not have lights or bleachers.

The arrangement of buildings, uses and facilities of the proposed
development in order to assure abutting properiy and/or its occupants will
not be unreasonably affected.
The site plan meets this condition. The soccer field is located as faz from
neighboring residential property as possible given the location of existing
buildings and athietic fields on the campus.
Creation of energy-conserving design through landscaping and location,
orientation and elevation of structures.
The site plan meets this condition.
(7) Safety and convenience of both vehiculaz and pedestrian traffic both within
the site and in relation to access streets, including traffic circulation
features, the locations and design of entrances and exits and pazking areas
within the site.

The satisfactory availability and capacity of storm and sanitary sewers,
including solutions to any drainage probiems in the area of the
development.
The site plan meets this condition. The soccer field has been designed to be
built on sand with drain tiles and will not add to the existing storm water
run-off for the azea. However, some neazby residents have complained
about existing drainage problems that affect their properties after heavy rain
falls. Part of the problem in

the azea near the soccer field may be due to run-off from an older parking
3 lot north of the field that drains toward the neighboring properties.

5 To deal with the drainage, two new catch basins will be installed to
6 intercept more storm water run-off and the area south of the field will be
7 graded to direct more of the run-off to the new and existing catch basins.
8 Existing catch basins will be cleaned if needed to make sure they ue
9 functioning properly.

(9) Sufficient landscaping, fences, walls and parking necessary to meet the
above objectives.
The site plan meets this condition. Some of the yazds already have large
shrubs on their back property line which wiil help screen the field.
However, additional landscaping should be planted as needed to screen the
field from adjacent residences. There aze restrictions on what can be
planted because of an easement for a public sewer that runs along the south
and east property lines: trees cannot be planted in this area but lazge shrubs
are permitted. The site plan submitted shows shrubs planted along the
south and east properiy lines. The exact location and numbers of shrubs
can be adjusted to reflect the location of existing large shrubs on the
neighboring property.
(10) Site accessibility in accordance with the provisions of the Americans with
Disabilities Act (ADA), including parking spaces, passenger loading zones and
accessible routes.
The site plan meets this condition.
(11) Provision for erosion and sediment control as specified in the "Ramsey Erosion
Sediment and Control Handbook."
The site plan meets this condition. Silt fences and measures to protect catch
basins from sediment during construction will be required.
Whereas, given the findings above and under the authority of Leg. Code § 64.300(e), the
Commission imposed the following conditions upon the approved site plan:
40 1. Landscaping and screening The field must be screened on the south and east sides by
41 planting shrubs that will grow at least 12 feet tall. The exact number and placement of
42 these shrubs will be determined by site plan review staff based on the location of existing
43 shrubs on neighboring property and input from the neighboring property owners.

2. Drainage Two new catch basins must be installed to intercept storm water and the
area south of field must be graded to direct more storm water to the new and existing
catch basins. Catch basins must be cleaned as needed to ensure that they are working
properly.
3. Seating and lighting No permanent seating for spectators and no lighting for the field
may be installed without prior approval by the City.

2 Whereas, pursuant to the provisions of Leg. Code § 64.206, Jean Iwen duly filed with the
3 City Clerk an appeal from the determination made by the Commission and requested, for the
4 purpose of considering the actions taken by the said Commission, a hearing before the City
5 Council; and
7 Whereas, pursuant to Leg. Code §§ 64.206 - 64.208, and upon norice to affected parties a
8 public hearing was duly conducted by the City Council on September 6, 2000 where all
9 interested parties were given an opportunity to be heard; and

Whereas, The City Council, having heard the statements made, and having considered the
application, the report of staff, the record, minutes and resolution of the Zoning Committee and
ofthe Planning Commission, do hereby
Resolve, That the Council of the City of Saint Paul does hereby affirm the decision of the
Planning Commission in this matter, and adopts as its own the findings in Planning Commission
resolution 00-50; and
Be it Further Resolved, that the Council, acting in this matter pursuant to Leg. Code §
64.207, hereby modifies condirion numbers "one," "two; ' and "three" as imposed by the
Commission and adds a new condition "four" to read as follows:
l. Landscaping and screening.
25 The College shall replace trees that have been or will be removed to make
26 way for the soccer field with replacement trees using a replacement schedule consistent
27 with the City's Tree Replacement policy set forth in Leg. Code § 60.788(b)(1-3).
28 Replacement trees will heip preserve the essential chazacter of the college campus as
29 well as the abutting residential neighborhood and will promote a physical and aesthetic
30 buffer between the soccer field and abutting residential properties. In addition, a
31 landscaping plan consistent with this replacement condition shall be prepared by the
32 Coliege. The plan shall be developed using a registered landscape architect or forester.
33 The plan shall, at a minimum, provide for screening the soccer field by planting and
34 maintaining a combination of trees and shrubs along the north, south and east sides of
35 the field. The shrubs and trees shall be of species which will grow at least 12 feet tall.

The shrubs and trees should be of different species and densities and have visual
37 screening, wind break, dust collection, heat and glare reduction and noise barrier
38 characteristics. The plan shall be developed with input from a neighborhood
39 committee. The committee must include some properry owners abutting the location
40

of the proposed soccer field. The plan shall be submitted to site pian review staff for
approval.
2. Drainage.
45 Two new catch basins shall be installed to intercept storm water. Public works
46 staff will review and approve their location, size, etc. The area to the south of the
47 soccer field must be graded to direct more storm water to the new and existing catch
48 basins. All catch basins shall be maintained to ensure that they are working properly.
49 In addition, the College must conduct a groundwater and surface drainage study on the
50 impact of the new soccer field on the capacity and availability of present storm and
51 sanitary sewers. The study shall include solutions to any

1 drainage problems present in the area of the new soccer field. In particular, the study
2 must address the drainage issues noted in the Planning Commission Resolution
3 fmdings at paragraph 8. The study shall be submitted to the department of public
4 works for review and approval. If deemed necessary by public works, the College shali
5 implement plans identified in the study to resolve groundwater or drainage problems
6 in the area of the new soccer field. This study shall be done as part of a broader
7 campus drainage study which the College has indicated that it is planning to prepaze.

3. Seating and lighting.
11 No spectator seating and no field lighting may be installed without the prior
12 approval of the zoning or plamzing administrator. Thereafter, no changes in seating
13 and lighting shall be made without prior approval by the zoning or planning
14 administrator. In addition, campus lighting shall be focused, shielded and located so as
15 to compensate for light screening as existing prior to the removal of the trees for the
16 soccer field and consistent with the safety needs of students and campus patrons.
17 Lighting issues should be addressed with input from a neighborhood committee.

4. Field activities.
All games, practices, and field activities shall be scheduled by the College and the
schedule of such activities shall be readily available to the public from the College.
The College has indicated that it will obtain the input of the Highland District Council
on any plan for use of the field by groups not related to the College. To make such
input meaningful, the College will not allow use of the field by groups not related to
the College for a period of one (1) year in order to allow the District Council an
opportwiity to conduct an evaluation of the impact of the field and to meet with the
College to formulate a plan for non-college field use approved by the District Councit.
The one year period shall commence as of the date the fietd is completed and availabte
to the College for play.
And Be It Further Resolved, That the appeal of Jean Iwen is denied;
34 And Be It Finally Resolved, That the City Clerk shall mail a copy of this resolution to the
35 College of St. Catherine, Jean Iwen, the Zoning Administrator and the Planning Commission.

On August 11 the Planning Commission approved a site plan for a new soccer field to be built at the
southeast corner of the campus of the College of Saint Catherine. The field requires the removal of an
number of existing trees and it witt be close to the back yards of nearby residences. So conditions were
added about landscaping, screening, draina�e, seating and lighting intended to minimize the impact of
field on nearby residents. (See attached resolution.)
The Zoning Committee of the Planning Commission, the Highland Area Community Council and LIEP
staff recommended approval with conditions.
At the public hearing 8 people spoke in opposition and 2 letters in opposition were received.

The appeal states that the Planning Commission erred by not adequately considering the impact that
removing the existing trees and building the field would have on light pollution, drainage and noise.

Randolph (the proposed field is at the SE corner of the campus near Fairview and Bayard).
Tom Beach showed siides and presented the staff report. Mr. Beach stated their was one letter
from a neighbor i� opposition and passed out a letter from the Highland District Council which
stated they recommend approvai of the Site Plan with the condition that no lights or benches are
installed. 7hey would also like to meet with the coilege of St. Catherine's to discuss how the
landscaping pian can be refined. Mr. Beach aiso stated the Zoning Staff is recommending approvat
of the site plan with conditions.
At the questions of Commissioner Gordon, Mr. Beach stated the College of Saint Catherine's did
not request Iighting. There wiil be approximately 30 trees over 12 inches in diameter that would
be cut down. The trees could nof be planted on the south side because the �oots coufd interfere
with the sewer system. The area drains to the south now and is similar to how the soccer field
would drain. Mr. Beach also expiained the Department of Public Works stated the soccer field
would not create additionai �vater drainage problems because of the sand and drain tites that are
being installed.
Upon further question of Commissioner Gordon, Mr. Beach expiained the Zoning Board couid make
no lighting and seating a condition of approval so they would be required to appiy for a site pian
to get them approved.
Ms. Mary Des Roches, Vice President for Finance and Business Operations for the Coliege of
Saint Catherine appeared and stated they view the soccerfield an enhancement to the campus as
essential to their ability to recruit and retain studenfs who are interested in athletics and physical
fitness as a component to tfieir total educationa[ experience, They have met with the neighbors
and have taken steps to respond to their suggestions. A neighborhood task force has been
established to make recommendations on the landscaping. Theirwili be 50 to 100 trees cut down.
A number of the trees are offshoots and scrubs and a number of the trees are matured and are
beyond their useful life and wouid have to come down in the future. She also explained they don't
need fighting because soccer is a seasonal spoR and woufd begin in August with about 11 to 15
games in the season depending on piay-off games. The games generaliy sta� about 4:OOpm and
end before dusk on weekdays.
At the question of Commissioner Gordon, Ms. Des Roch>s stated tnay would be wiliing to discuss
repianting trees taking into account the entire landscaping project. They have a comm+tment to

retain the beauty of the coitege through pianting trees, shrubbery and other horticultural designs. •
She aiso stated they would not have a problem applying for a permit if a Iight and seating need

Ms. Siettum, 1841 Bayard Ave, appeared in opposition and stated she supporfed the coliege and
their expansion but had concerns with seven issues. 1) Taking outthe numberof trees will reduce
the natural drainage. 2) Parking issues and fraffic flow during tournaments. 3) Replacing trees
that are removed. 4) Noise levels during soccer games. 5) Property values being decreased. 6)
Environmental issues with trees being removed in the past and present. 7. Make sure the field
is used for cotlege games as opposed to neighborhood games or others using the field.
At the question of Commissioner Gordon, Mr. Siettum stated they wanted the field to be used by
the coilege only.
At the question Commissioner Field, Mr. Beach stated under the Zoning Code there is no
requirement for additional parking for the soccer fieid because_the coitege is meefing the parking
requirements. Norfh of the field there is a parking lot witi:�300_uarking spaces.
Commissioner Fieid also noted he appreciated fhe issue of concem; property vatues are not an
issue to be considered in respect to this site plan review. �
Ms. Jean Iwen , 1855 Bayard, appeared in opposition and stated she was concerned about fhe
noise level created by the baseball and soccer teams. She aiso expiained noise during the day
could not exceed 65 decibels more than 10 percent of the time given in an hour. in comparison
street traffic is 80 decibeis. She also stated she had concerns about surface slant that wou[d not
allow landscaping to have a berm that would raise ihe bushes without causing roots to impact the
sewers. Ms. Iwen also stated she wouid like to have lights, seating and times of the fieid to be
stiputated as conditions.
At the question of Commissioner Field, Mr. Beach stated noise sfandards are set at 65 decibefs
used against noises that are continuous like a motor or fan from a business. tntermittent noise
from people piaying soccer would not trip the noise standards because it is sporadic.
Mr. John Matthews, 2009 Bayard, asked that nothing be done with Saint Catherine's until fhe high
water probiem is atleviated.
At the question of Commissioner Gordon, Mr. Matthews stated the soccer field wouid not have a
positive or �egative effect on the water problem.
Mr. Dennis Malloy, 2019 Bayard appeared and stated he wouid like Saint Catherine's to clean out
the catch basins.
Mr. James Neher, 1837 Bayard appeared and noted the field is oniy 50 feet from the neighbors
back yards.
Mr. Edward Stephens, 1805 Bayard, came forward and stated he had concerns with all the trees

Mr. Michael Browan 1991 Bayard, appeared and commenfed on fhe drainage issue and fhe
additionai adverse impact that the soccer fieid couid have on the drainage because oYthe frequent
watering of the field and that a study shouid be made on the fieid for drainage.
Mr. Craig Stephens, appeared and had concerns about the trees being cut down.
Ms. Mary Dayton stated she would like the coilege to monitor the field closely.
At the question of Commissioner Morton Ms. Deyton stated St. Catherine's has been a good and
responsible neighbor. �
Ms. Mary Des Roches reappeared and stated the facility could not be moved furffier to the north
because of the restrictions on service access that is required for safefy purposes for the apartment
building. -The plan for the soccer field is the fans will be on the north side of the field and the
players and coaches and referees would be on the southem perimeter ofi the fieid.
Ms. Sheila Brown came forward and stated between 11 and 15 soccer games wou(d be played on
• the field. She aiso stated they had requests for neighbors to use the fieid and they wouid restrict
the usage.
At the question of Commissioner Gordon, Ms. Brown stated there wouid be anywhere between 15
and 70 spectators.
Mr. Roger Poctor of Larson Engineering, appeared and explained the design of the soccerfieid and
stated it will have 12 inches of sand with peat and humus materiai which the water would flow
through easily. He aiso stated the catch basins in ptace wili be adjusted to improve the drainage
and two more wi(I be added. The storm sewer is 72 feet in diameter and has a significant capacity.
The water management will be significantly improved with the soccer fieid.
At the question of Commissioner Gordon, Mr. Poctor stated the plans have taken into consideration
the watering of the fieid.
At the question of Commissioner Fieid, Mr. Poctor stated an outdoorfieid woutd be better for water
management than a building with appropriate drainage.
Ms. Marcy Dowse, Communicafions Director of fhe College ofi Saint Catherine, addressed the
landscaping issues. She stated they witl be working with the neigh6ors and Zoning Staff to finalize
the landscaping. They will maintain communications with the neighborhood.

A. PURPOSE: Site plan review for a new soccer field
B. PARCEL SIZE: The soccer field would cover 1.7 acres (210 feet by 345 feet) at the
soutfieast corner of the campus of Saint Catherine's. The entire campus covers 110 acres.
C. EXISTING LAND USE: The land where the soccer field would go is currenfiy a wooded
area. Approximately 50% of the campus is v��ooded.
D. SURROUNDING LAND USE: The area to the east and south of the proposed soccer
field is single-famify residentiai. The area to the west and north is part of the Saint
Catherine's campus: to the west is a softbail field and to the north is a student apartment
buitding.
E. DISTRICT COUNCIL RECOMMENDATION: The Highland Area Community Councii will
meet to discuss this site plan on July 27. Residents near Saint Catherine's have told staff
they are concemed about noise from games on the fieVd, the loss of existing trees, and
drainage problems.
F. HISTORY/DISCUSSION:
1. Master plan The Coilege recentiy compieted a master plan for the campus to guide
development for the next 30 years. The master plan recommends locating simi(ar
functions together on the campus and so it cails for locating the proposed soccer field
and a proposed field house at the southeast corner of the campus near the existing
athletic building.
2. Drainage Some residents south of the campus have complained about wet
basements and other drainage probiems after heavy rain sforms. The exact cause of
these probiems has not been determined. However, officials from Saint Catherine's told

staff that most of these complaints have come from residents living west of the �
proposed soccer field.
3. Proposed use of the field The field wouid be used 6y Saint Catherine's soccer team.
They would play about 19 games there per season plus a few additional games if the
team made the play offs. They wouid also use the field for practice. Saint Cafherine's
has not made any commitments at this time to let outside groups such as youfh (eague
soccer feams use tfie field. They may consider permitting some outside use in ihe
future when Saint GaYherine's team is not having its season.
G. FINDINGS: Section 62.108(c) of the Zoning Code says that in "order to approve the site
plan, the planning commission shail consider and find ff�at tfie site p(an is consistent with"
the foliowing:
(1) Tfle city's adopted comprehensive plan and development or project plans for sub-areas
of the city.
The site plan meets this condition.
(2) Applicable ordinances of the City of Saint Paul.
The site plan meets this condition:
- The use is permitted. The College of Saint Catherine's has a Speciai Condition Use
Permit and an athletic field is considered a permitted accessory use for the college.
- Staff does not anticipate that the activifies on the field wil( exceed any noise timits. �
- As part of buitding the field, a number of trees must be removed. However, the
campus is not in a tree preservation district that regulates the removal of trees and
sets standards for replacing trees.
- The field complies with required setbacks. The zoning code does not estabtish a
minimum setback for athtetic fields but it requires a 50 foot setback for buildings on
coilege and the soccer field would meet this requirement: it will be 50 feet from the
south property line and 115 feef from the east property line.
(3} Preservafion of unique geologiq geographic orhistorically signifrcant characteristics of
the city and environmentalJy sensitive areas. "
The site plan meets this condition. Construction of the soccer field wili result in the
removal of a number of existing mafure trees. However, most of the remaining
undevetoped tand on the college's camp�s is wooded and so any other feasible location
for a soccer fiefd would aiso result in a similar foss of trees.
(4) Protection of adjacent and neighboring properties through reasonable provision for such
matters as surface water drainage, sound and sight buffers, preservation of views, light
and air, and those aspects of design which may have substantia! effecfs on neighboring
land uses.
The site pian meets this condifion. Sfeps will be taken to improve existing drainage
problems and the fietd will be scree�ed by new landscaping. (See items 8 and 9 below.) �
The field will not have lights or bleachers.
(5) The arrangement of buildings, uses and facilities of the proposed development in or der

The site plan meets this condition.
(7) Safety and convenience of both vehicular and pedestrian tra�c botfl within the site and
in relation to access streets, including traffic ci�cufation features, the locations and
design of enfrances and exits and parking areas within fhe site.
The site plan meets this condition.
(8) The safisfactory availa6ility and capacity of storm and sanitary sewers, including
solutions to any drainage prob/ems in the area of the deve%pment.
The site pian meets this condition. The soccer fieid has been designed to be built on
sand with drain tiles and wilf not add to the existing storm water run-off for the area.

I was pieased to Ieam that we have the approvai for the landscaping plans. At
our last meeting you asked that i send you somefhing in writing regarding our
master space plannning and the areas we had considered for the soccer field.
The Coliege administration approved the construction of a soccer fieid fifteen
months ago but put the project on hoid until we had compieted the full master
space pian. We did not want to limit our future options with this consVUCtion.
The fieid was in6tially intended to be in the generai area that it is now being
built, in close proximity to the softball field. During the master space
planning process we held to the assumption that we wanted to group like
activi6es together to the extent desireable. That is why the athietic
facilities are generaily grouped in the south east quadrant of the campus with
the Butler Center siightly west.
In December,1999 Ellerbe Becket presented the college with three aitemative
plans. Alternative A showed the athietic fields noRh of the Aiberta Apaertments
on the current parking lot with a new roadway and a new gate to the south
parallel and in proximity to the back of the homes on Bayard.Aiternative B
showed the same without a roadway. Both required the construction of a large
parking structure. Altemative C showed athietic fields east of the softbail
area. These were early schematic designs and Elierbe took comments from tfie
coilege community to do further development.
The plans in January continued to group the athletic faciiities in the south
east quadrant. One presented the fieid house where the Aiberta Apartment
building now stands. One showed the fieldhouse just north of the current
softbail fieid. The college recognized the �eed for a soccer field in phase one
of the impiementation of the plan and did not wish to tear down an apartment
building that is weii used stiil has some years left in it. We were aiso
reluctant to buiid large parking structures for both cost and secutity reasons.
We asked Eilerbe Becet to take these matters into consideration when they came
back with the next set of drawings.
Because of the urgency of constructing the soccer fieid and the impact the lack
of a fieid was having on our enrollment and athletic program, we considered
other temporary sites. We looked at the area directly west of Derham Hall and
near the Dewdrop pond. We rejected the idea of a temporary fieid because of the
cost and because of the enviroronmental issues. We remained committed to having
the soccer field in the area of campus with other athietic actvivies.
The plan which was presented to the board of trustees in April had the soccer
field with a track around it in the area generally where it now is planned. The
track was removed as not part of the master space pian. The field house was
moved north to be cioser to fhe Butler Center. The Alberta Apartment building
reamined intact. The O'Shaughessy parking lot was designated for future parking.
There was no new roadway through the south east quadrant to Fairview. This pian
was deemed the ieast disruptive to the neighbors and the most suited to the

college. �
We have made modifications to the plan to preserve as many trees as possible so
the current location is not exactly as on the pian of Aprit 14. The plan dated
June 26 is more exact . This is what was presented to the neighbors at the
meeting the evening of June 26.

The Highland District Council has reviewed the site plan submitted by the Coitege
of St, Catherine for the new field on the'sr campus. The Council agrees that there
should be no lighting installed on the fietds and that no permanent seating be
installed. We are aware that the College has held several meetings with their
neighbors and have taken concerns raised into consideration during the planning
process.
The Councii would like to have a member of our Board work with ffie neighbors
and fhe College regazding the landscape ptan for the area south of the field. The
board believes that it is important that community input be part of that process.
We further encourage the College to consider the needs of community youth
regarding use of the new fields for youth soccer should that need arise.

date set for a hearing on the soccer field proposal offered by St.
Catherine College, we respectfully submit this letter in our
absence.
We have resided at 1845 Bayard Avenue for almost 45 years.
�
AIl these years we na�e t�zed to be �ood neigiiboi ta St.
Catherine's, and they, in turn have been a solicitous institution.
The college has every right to build a soccer field, but some
safety provisions should be made for taxpayers whose properties
abut the school. The trees in question, besides having an esthetic
value, have been an anchor for the rain run off that forms a stream
of water as it gushes along the fence behind our properties. On
Memorial Day, 1965, down our block at 1939 Bayard, our friends +
were inundated in the basement with water within 18 inches of
their first floor.
Besides the noise involved on sports events, prevention of
flooding should be a primary concern in evaluating St. Catherine's
plans. Too often land is stripped of trees and foliage, and after a
heavy deluge there is a wringing of the hands as to mistakes made
in underestimating the results of heavy rains or heavy snow melts..
We hope in your consideration of St. Catherine's request for a
permit, you will keep her neighbors' troubling concerns in mind.

On Wednesday, Septembex 6, 2000, the College of St.Catherine will appe� at a
pub&c hearing to xespond to an appeal of one neighbox to the site plan foz the constcuction
of a socces field in the southeast azea of out piopesty. We believe the site plan as
unanimously approved by the Plannina Comuussion meets necessasy xequixements, that the
college has taken steps to alleviate the concems e�pressed by the neighboxs on Bayasd
Avenue, and that thexe has been no erxox made by the Planning Coimnission. In addirion,
we have the support of the Highland District Council.

We recognize that we caused some contLOVexsy in April in moving forwaxd cvith txee
xemoval on short notice to the neighbors. We have apologized to the neighbors for this e�or
in judgmen� and have subsequendy established an on-going neighboxhood liaison task foxce,
a landscaping task farce, and set periodic open-invitadon meetings with the neighbors on
Sayaxd and the surrounding azea. We ase pleased that the appellaiit is sexving on oux
landscaping task foxce.

The issues saised in the appeal relate to lighting, noise, and drainage. Each was
addiessed at the Zoning Coinmittee public heating on August 3, 2000, and the Plauning
Cotnmission on August 11, 2�00.
The college does not intend to install lighting fox the soccer field. It was never part
of oux plan, so we readilp agxeed to it as a condition. In addition, the landscaping plan
appxoved bp the city provides for planting tTees and shrubs that provide a natural bazriei
ftom other campus lighting.
Roger Pocta of Lasson Engineering will provide fuither detail on the dxainage plan
at the public hearing. We believe that the construcrion of the field cvill nnprove the dtainage
in the azea. Two new catch basins will be installed to intercept storm watet and the axea
south of the field will be graded to ditect more storm water to them.
The plan does not violate the noise standards. Intem�ittent noise will not vio]ate
these standazds.
These aze exciting times at the College of St. Catherine. We recently completed a
stcategic planning pxocess and a mastex space plan to guide the development within oux
cutrent campus boundaries. The College of St. Catherine's views the soccer field as essential
to out ability to recruit and setain women who ase incteasingly interested in athletics and
physical fimess as a component of theix total educational expeuence. We ask that pou
confirm the unaniixious vote of the Planning Coinuussion and allow us to proceed.

that the field would also be used for regular practices
(with no specifics on rnunber or time of day)� also
gym classes, impromptu games, and camnunity use!

4 pursuant to the provisions of the Saint Paul Zoning Code for property located on the St.

Whereas, the Zoning Committee of the Commission conducted a public hearing on
August 3, 200Q after having provided notice to affected property owners, and submitted its
recommendation to the Commission. By its resolution number 00-50, dated August 11, 2000,
the Commission decided to grant the application, subject to specific conditions, based on the
following findings and conclusions:

The city's adopted comprehensive plan and development or project plans
for sub-azeas of the city.
The site plan meets trus condition.
Applicable ordinances of the City of Saint Paul.
The site plan meets this condition:
- The use is permitted. The College of Saint Catherine's has a Special
Condition Use Permit and an athletic field is considered a permitted
accessory use for the college.
- Staff does not anticipate that the activities on the field will exceed any
noise limits.
- As part of building the field, a number of trees must be removed.
However, the campus is not in a tree preservation district that
regulates the removal of trees and sets standards for replacing trees.
36 - The field complies with required setbacks. The zoning code does
37 not establish a minimum setback for athletic fields but it requires a
38 50-foot setback for buildings on college and the soccer field would

8 The site plan meets this condition. Construction of the soccer field will
9 result in the removal of a number of existing mature trees. However, most
10 of the remainiug undeveloped land on the college's campus is wooded and
11 so any other feasible location for a soccer field would also result in a
12 similar loss of trees.

14 (4) Protection of adjacent and neighboring properties through reasonable
15 provision for such matters as surface water drainage, sound and sight
16 buffers, preservation of views, light and air, and those aspects of design
17 which may have substantial effects on neighboring land uses.

Preservation of unique geologic, geographic or historically significant
characteristics of the city and environmentally sensitive areas.
19 The site plan meets this condition. Steps will be taken to improve existing
20 drainage problems and the field will be screened by new landscaping. (See
21 items 8 and 9 below.) The field will not have lights or bleachers.

The arrangement of buildings, uses and facilities of the proposed
development in order to assure abutting properiy and/or its occupants will
not be unreasonably affected.
The site plan meets this condition. The soccer field is located as faz from
neighboring residential property as possible given the location of existing
buildings and athietic fields on the campus.
Creation of energy-conserving design through landscaping and location,
orientation and elevation of structures.
The site plan meets this condition.
(7) Safety and convenience of both vehiculaz and pedestrian traffic both within
the site and in relation to access streets, including traffic circulation
features, the locations and design of entrances and exits and pazking areas
within the site.
The site plan meets this condition.

The satisfactory availability and capacity of storm and sanitary sewers,
including solutions to any drainage probiems in the area of the
development.
The site plan meets this condition. The soccer field has been designed to be
built on sand with drain tiles and will not add to the existing storm water
run-off for the azea. However, some neazby residents have complained
about existing drainage problems that affect their properties after heavy rain
falls. Part of the problem in

the azea near the soccer field may be due to run-off from an older parking
3 lot north of the field that drains toward the neighboring properties.

5 To deal with the drainage, two new catch basins will be installed to
6 intercept more storm water run-off and the area south of the field will be
7 graded to direct more of the run-off to the new and existing catch basins.
8 Existing catch basins will be cleaned if needed to make sure they ue
9 functioning properly.

(9) Sufficient landscaping, fences, walls and parking necessary to meet the
above objectives.
The site plan meets this condition. Some of the yazds already have large
shrubs on their back property line which wiil help screen the field.
However, additional landscaping should be planted as needed to screen the
field from adjacent residences. There aze restrictions on what can be
planted because of an easement for a public sewer that runs along the south
and east property lines: trees cannot be planted in this area but lazge shrubs
are permitted. The site plan submitted shows shrubs planted along the
south and east properiy lines. The exact location and numbers of shrubs
can be adjusted to reflect the location of existing large shrubs on the
neighboring property.
(10) Site accessibility in accordance with the provisions of the Americans with
Disabilities Act (ADA), including parking spaces, passenger loading zones and
accessible routes.
The site plan meets this condition.
(11) Provision for erosion and sediment control as specified in the "Ramsey Erosion
Sediment and Control Handbook."
The site plan meets this condition. Silt fences and measures to protect catch
basins from sediment during construction will be required.
Whereas, given the findings above and under the authority of Leg. Code § 64.300(e), the
Commission imposed the following conditions upon the approved site plan:
40 1. Landscaping and screening The field must be screened on the south and east sides by
41 planting shrubs that will grow at least 12 feet tall. The exact number and placement of
42 these shrubs will be determined by site plan review staff based on the location of existing
43 shrubs on neighboring property and input from the neighboring property owners.

2. Drainage Two new catch basins must be installed to intercept storm water and the
area south of field must be graded to direct more storm water to the new and existing
catch basins. Catch basins must be cleaned as needed to ensure that they are working
properly.
3. Seating and lighting No permanent seating for spectators and no lighting for the field
may be installed without prior approval by the City.

2 Whereas, pursuant to the provisions of Leg. Code § 64.206, Jean Iwen duly filed with the
3 City Clerk an appeal from the determination made by the Commission and requested, for the
4 purpose of considering the actions taken by the said Commission, a hearing before the City
5 Council; and
7 Whereas, pursuant to Leg. Code §§ 64.206 - 64.208, and upon norice to affected parties a
8 public hearing was duly conducted by the City Council on September 6, 2000 where all
9 interested parties were given an opportunity to be heard; and

Whereas, The City Council, having heard the statements made, and having considered the
application, the report of staff, the record, minutes and resolution of the Zoning Committee and
ofthe Planning Commission, do hereby
Resolve, That the Council of the City of Saint Paul does hereby affirm the decision of the
Planning Commission in this matter, and adopts as its own the findings in Planning Commission
resolution 00-50; and
Be it Further Resolved, that the Council, acting in this matter pursuant to Leg. Code §
64.207, hereby modifies condirion numbers "one," "two; ' and "three" as imposed by the
Commission and adds a new condition "four" to read as follows:
l. Landscaping and screening.
25 The College shall replace trees that have been or will be removed to make
26 way for the soccer field with replacement trees using a replacement schedule consistent
27 with the City's Tree Replacement policy set forth in Leg. Code § 60.788(b)(1-3).
28 Replacement trees will heip preserve the essential chazacter of the college campus as
29 well as the abutting residential neighborhood and will promote a physical and aesthetic
30 buffer between the soccer field and abutting residential properties. In addition, a
31 landscaping plan consistent with this replacement condition shall be prepared by the
32 Coliege. The plan shall be developed using a registered landscape architect or forester.
33 The plan shall, at a minimum, provide for screening the soccer field by planting and
34 maintaining a combination of trees and shrubs along the north, south and east sides of
35 the field. The shrubs and trees shall be of species which will grow at least 12 feet tall.

The shrubs and trees should be of different species and densities and have visual
37 screening, wind break, dust collection, heat and glare reduction and noise barrier
38 characteristics. The plan shall be developed with input from a neighborhood
39 committee. The committee must include some properry owners abutting the location
40

of the proposed soccer field. The plan shall be submitted to site pian review staff for
approval.
2. Drainage.
45 Two new catch basins shall be installed to intercept storm water. Public works
46 staff will review and approve their location, size, etc. The area to the south of the
47 soccer field must be graded to direct more storm water to the new and existing catch
48 basins. All catch basins shall be maintained to ensure that they are working properly.
49 In addition, the College must conduct a groundwater and surface drainage study on the
50 impact of the new soccer field on the capacity and availability of present storm and
51 sanitary sewers. The study shall include solutions to any

1 drainage problems present in the area of the new soccer field. In particular, the study
2 must address the drainage issues noted in the Planning Commission Resolution
3 fmdings at paragraph 8. The study shall be submitted to the department of public
4 works for review and approval. If deemed necessary by public works, the College shali
5 implement plans identified in the study to resolve groundwater or drainage problems
6 in the area of the new soccer field. This study shall be done as part of a broader
7 campus drainage study which the College has indicated that it is planning to prepaze.

3. Seating and lighting.
11 No spectator seating and no field lighting may be installed without the prior
12 approval of the zoning or plamzing administrator. Thereafter, no changes in seating
13 and lighting shall be made without prior approval by the zoning or planning
14 administrator. In addition, campus lighting shall be focused, shielded and located so as
15 to compensate for light screening as existing prior to the removal of the trees for the
16 soccer field and consistent with the safety needs of students and campus patrons.
17 Lighting issues should be addressed with input from a neighborhood committee.

4. Field activities.
All games, practices, and field activities shall be scheduled by the College and the
schedule of such activities shall be readily available to the public from the College.
The College has indicated that it will obtain the input of the Highland District Council
on any plan for use of the field by groups not related to the College. To make such
input meaningful, the College will not allow use of the field by groups not related to
the College for a period of one (1) year in order to allow the District Council an
opportwiity to conduct an evaluation of the impact of the field and to meet with the
College to formulate a plan for non-college field use approved by the District Councit.
The one year period shall commence as of the date the fietd is completed and availabte
to the College for play.
And Be It Further Resolved, That the appeal of Jean Iwen is denied;
34 And Be It Finally Resolved, That the City Clerk shall mail a copy of this resolution to the
35 College of St. Catherine, Jean Iwen, the Zoning Administrator and the Planning Commission.

On August 11 the Planning Commission approved a site plan for a new soccer field to be built at the
southeast corner of the campus of the College of Saint Catherine. The field requires the removal of an
number of existing trees and it witt be close to the back yards of nearby residences. So conditions were
added about landscaping, screening, draina�e, seating and lighting intended to minimize the impact of
field on nearby residents. (See attached resolution.)
The Zoning Committee of the Planning Commission, the Highland Area Community Council and LIEP
staff recommended approval with conditions.
At the public hearing 8 people spoke in opposition and 2 letters in opposition were received.

The appeal states that the Planning Commission erred by not adequately considering the impact that

water run-off and the area south of the field �vili be graded to direct more of the run-off to
the ne�v and existin� catch basins. Existin� catch basins will be cleanzd if needed to
make sure they are functionin� properly.

The site plan meets this condition. Some of the yards already have large shrubs on their
back property line �vhich wili hzlp screen the field. However, additional landscapin�
should be planted as needed to screen the field from.adjacent residences. There are
restrictions on �vhat can be planted because of an easement for a public sewer that runs
alon� the south and east property lines: trees cannot be planted in this area but lazge
shrubs are permitted. The site plan submitted sho�vs shrubs planted alon� the south and
east property lines. The exact location and numbers of shrubs can be adjusted to reflect
the location of existin� large shrubs on the nei�hborin� property.

Coilege of Saint Catherine - 00-135-531 - Site Plan Review for a new soccer field. 2004
Randolph (the proposed field is at the SE corner of the campus near Fairview and Bayard).
Tom Beach showed siides and presented the staff report. Mr. Beach stated their was one letter
from a neighbor i� opposition and passed out a letter from the Highland District Council which
stated they recommend approvai of the Site Plan with the condition that no lights or benches are
installed. 7hey would also like to meet with the coilege of St. Catherine's to discuss how the
landscaping pian can be refined. Mr. Beach aiso stated the Zoning Staff is recommending approvat
of the site plan with conditions.
At the questions of Commissioner Gordon, Mr. Beach stated the College of Saint Catherine's did
not request Iighting. There wiil be approximately 30 trees over 12 inches in diameter that would
be cut down. The trees could nof be planted on the south side because the �oots coufd interfere
with the sewer system. The area drains to the south now and is similar to how the soccer field
would drain. Mr. Beach also expiained the Department of Public Works stated the soccer field
would not create additionai �vater drainage problems because of the sand and drain tites that are
being installed.
Upon further question of Commissioner Gordon, Mr. Beach expiained the Zoning Board couid make
no lighting and seating a condition of approval so they would be required to appiy for a site pian
to get them approved.
Ms. Mary Des Roches, Vice President for Finance and Business Operations for the Coliege of
Saint Catherine appeared and stated they view the soccerfield an enhancement to the campus as
essential to their ability to recruit and retain studenfs who are interested in athletics and physical
fitness as a component to tfieir total educationa[ experience, They have met with the neighbors
and have taken steps to respond to their suggestions. A neighborhood task force has been
established to make recommendations on the landscaping. Theirwili be 50 to 100 trees cut down.
A number of the trees are offshoots and scrubs and a number of the trees are matured and are
beyond their useful life and wouid have to come down in the future. She also explained they don't
need fighting because soccer is a seasonal spoR and woufd begin in August with about 11 to 15
games in the season depending on piay-off games. The games generaliy sta� about 4:OOpm and
end before dusk on weekdays.
At the question of Commissioner Gordon, Ms. Des Roch>s stated tnay would be wiliing to discuss
repianting trees taking into account the entire landscaping project. They have a comm+tment to

retain the beauty of the coitege through pianting trees, shrubbery and other horticultural designs. •
She aiso stated they would not have a problem applying for a permit if a Iight and seating need
arose.
Ms. Siettum, 1841 Bayard Ave, appeared in opposition and stated she supporfed the coliege and
their expansion but had concerns with seven issues. 1) Taking outthe numberof trees will reduce
the natural drainage. 2) Parking issues and fraffic flow during tournaments. 3) Replacing trees
that are removed. 4) Noise levels during soccer games. 5) Property values being decreased. 6)
Environmental issues with trees being removed in the past and present. 7. Make sure the field
is used for cotlege games as opposed to neighborhood games or others using the field.
At the question of Commissioner Gordon, Mr. Siettum stated they wanted the field to be used by
the coilege only.
At the question Commissioner Field, Mr. Beach stated under the Zoning Code there is no
requirement for additional parking for the soccer fieid because_the coitege is meefing the parking
requirements. Norfh of the field there is a parking lot witi:�300_uarking spaces.
Commissioner Fieid also noted he appreciated fhe issue of concem; property vatues are not an
issue to be considered in respect to this site plan review. �
Ms. Jean Iwen , 1855 Bayard, appeared in opposition and stated she was concerned about fhe
noise level created by the baseball and soccer teams. She aiso expiained noise during the day
could not exceed 65 decibels more than 10 percent of the time given in an hour. in comparison
street traffic is 80 decibeis. She also stated she had concerns about surface slant that wou[d not
allow landscaping to have a berm that would raise ihe bushes without causing roots to impact the
sewers. Ms. Iwen also stated she wouid like to have lights, seating and times of the fieid to be
stiputated as conditions.
At the question of Commissioner Field, Mr. Beach stated noise sfandards are set at 65 decibefs
used against noises that are continuous like a motor or fan from a business. tntermittent noise
from people piaying soccer would not trip the noise standards because it is sporadic.
Mr. John Matthews, 2009 Bayard, asked that nothing be done with Saint Catherine's until fhe high
water probiem is atleviated.
At the question of Commissioner Gordon, Mr. Matthews stated the soccer field wouid not have a
positive or �egative effect on the water problem.
Mr. Dennis Malloy, 2019 Bayard appeared and stated he wouid like Saint Catherine's to clean out
the catch basins.
Mr. James Neher, 1837 Bayard appeared and noted the field is oniy 50 feet from the neighbors
back yards.
Mr. Edward Stephens, 1805 Bayard, came forward and stated he had concerns with all the trees

Mr. Michael Browan 1991 Bayard, appeared and commenfed on fhe drainage issue and fhe
additionai adverse impact that the soccer fieid couid have on the drainage because oYthe frequent
watering of the field and that a study shouid be made on the fieid for drainage.
Mr. Craig Stephens, appeared and had concerns about the trees being cut down.
Ms. Mary Dayton stated she would like the coilege to monitor the field closely.
At the question of Commissioner Morton Ms. Deyton stated St. Catherine's has been a good and
responsible neighbor. �
Ms. Mary Des Roches reappeared and stated the facility could not be moved furffier to the north
because of the restrictions on service access that is required for safefy purposes for the apartment
building. -The plan for the soccer field is the fans will be on the north side of the field and the
players and coaches and referees would be on the southem perimeter ofi the fieid.
Ms. Sheila Brown came forward and stated between 11 and 15 soccer games wou(d be played on
• the field. She aiso stated they had requests for neighbors to use the fieid and they wouid restrict
the usage.
At the question of Commissioner Gordon, Ms. Brown stated there wouid be anywhere between 15
and 70 spectators.
Mr. Roger Poctor of Larson Engineering, appeared and explained the design of the soccerfieid and
stated it will have 12 inches of sand with peat and humus materiai which the water would flow
through easily. He aiso stated the catch basins in ptace wili be adjusted to improve the drainage
and two more wi(I be added. The storm sewer is 72 feet in diameter and has a significant capacity.
The water management will be significantly improved with the soccer fieid.
At the question of Commissioner Gordon, Mr. Poctor stated the plans have taken into consideration
the watering of the fieid.
At the question of Commissioner Fieid, Mr. Poctor stated an outdoorfieid woutd be better for water
management than a building with appropriate drainage.
Ms. Marcy Dowse, Communicafions Director of fhe College ofi Saint Catherine, addressed the
landscaping issues. She stated they witl be working with the neigh6ors and Zoning Staff to finalize
the landscaping. They will maintain communications with the neighborhood.

A. PURPOSE: Site plan review for a new soccer field
B. PARCEL SIZE: The soccer field would cover 1.7 acres (210 feet by 345 feet) at the
soutfieast corner of the campus of Saint Catherine's. The entire campus covers 110 acres.
C. EXISTING LAND USE: The land where the soccer field would go is currenfiy a wooded
area. Approximately 50% of the campus is v��ooded.
D. SURROUNDING LAND USE: The area to the east and south of the proposed soccer
field is single-famify residentiai. The area to the west and north is part of the Saint
Catherine's campus: to the west is a softbail field and to the north is a student apartment
buitding.
E. DISTRICT COUNCIL RECOMMENDATION: The Highland Area Community Councii will
meet to discuss this site plan on July 27. Residents near Saint Catherine's have told staff
they are concemed about noise from games on the fieVd, the loss of existing trees, and
drainage problems.
F. HISTORY/DISCUSSION:
1. Master plan The Coilege recentiy compieted a master plan for the campus to guide
development for the next 30 years. The master plan recommends locating simi(ar
functions together on the campus and so it cails for locating the proposed soccer field
and a proposed field house at the southeast corner of the campus near the existing
athletic building.
2. Drainage Some residents south of the campus have complained about wet
basements and other drainage probiems after heavy rain sforms. The exact cause of
these probiems has not been determined. However, officials from Saint Catherine's told

staff that most of these complaints have come from residents living west of the �
proposed soccer field.
3. Proposed use of the field The field wouid be used 6y Saint Catherine's soccer team.
They would play about 19 games there per season plus a few additional games if the
team made the play offs. They wouid also use the field for practice. Saint Cafherine's
has not made any commitments at this time to let outside groups such as youfh (eague
soccer feams use tfie field. They may consider permitting some outside use in ihe
future when Saint GaYherine's team is not having its season.
G. FINDINGS: Section 62.108(c) of the Zoning Code says that in "order to approve the site
plan, the planning commission shail consider and find ff�at tfie site p(an is consistent with"
the foliowing:
(1) Tfle city's adopted comprehensive plan and development or project plans for sub-areas
of the city.

I was pieased to Ieam that we have the approvai for the landscaping plans. At
our last meeting you asked that i send you somefhing in writing regarding our
master space plannning and the areas we had considered for the soccer field.
The Coliege administration approved the construction of a soccer fieid fifteen
months ago but put the project on hoid until we had compieted the full master
space pian. We did not want to limit our future options with this consVUCtion.
The fieid was in6tially intended to be in the generai area that it is now being
built, in close proximity to the softball field. During the master space
planning process we held to the assumption that we wanted to group like
activi6es together to the extent desireable. That is why the athietic
facilities are generaily grouped in the south east quadrant of the campus with
the Butler Center siightly west.
In December,1999 Ellerbe Becket presented the college with three aitemative
plans. Alternative A showed the athietic fields noRh of the Aiberta Apaertments
on the current parking lot with a new roadway and a new gate to the south
parallel and in proximity to the back of the homes on Bayard.Aiternative B
showed the same without a roadway. Both required the construction of a large
parking structure. Altemative C showed athietic fields east of the softbail
area. These were early schematic designs and Elierbe took comments from tfie
coilege community to do further development.
The plans in January continued to group the athletic faciiities in the south
east quadrant. One presented the fieid house where the Aiberta Apartment
building now stands. One showed the fieldhouse just north of the current
softbail fieid. The college recognized the �eed for a soccer field in phase one
of the impiementation of the plan and did not wish to tear down an apartment
building that is weii used stiil has some years left in it. We were aiso
reluctant to buiid large parking structures for both cost and secutity reasons.
We asked Eilerbe Becet to take these matters into consideration when they came
back with the next set of drawings.
Because of the urgency of constructing the soccer fieid and the impact the lack
of a fieid was having on our enrollment and athletic program, we considered
other temporary sites. We looked at the area directly west of Derham Hall and
near the Dewdrop pond. We rejected the idea of a temporary fieid because of the
cost and because of the enviroronmental issues. We remained committed to having
the soccer field in the area of campus with other athietic actvivies.
The plan which was presented to the board of trustees in April had the soccer
field with a track around it in the area generally where it now is planned. The
track was removed as not part of the master space pian. The field house was
moved north to be cioser to fhe Butler Center. The Alberta Apartment building
reamined intact. The O'Shaughessy parking lot was designated for future parking.
There was no new roadway through the south east quadrant to Fairview. This pian
was deemed the ieast disruptive to the neighbors and the most suited to the

college. �
We have made modifications to the plan to preserve as many trees as possible so
the current location is not exactly as on the pian of Aprit 14. The plan dated
June 26 is more exact . This is what was presented to the neighbors at the
meeting the evening of June 26.

The Highland District Council has reviewed the site plan submitted by the Coitege
of St, Catherine for the new field on the'sr campus. The Council agrees that there
should be no lighting installed on the fietds and that no permanent seating be
installed. We are aware that the College has held several meetings with their
neighbors and have taken concerns raised into consideration during the planning
process.
The Councii would like to have a member of our Board work with ffie neighbors
and fhe College regazding the landscape ptan for the area south of the field. The
board believes that it is important that community input be part of that process.
We further encourage the College to consider the needs of community youth
regarding use of the new fields for youth soccer should that need arise.

date set for a hearing on the soccer field proposal offered by St.
Catherine College, we respectfully submit this letter in our
absence.
We have resided at 1845 Bayard Avenue for almost 45 years.
�
AIl these years we na�e t�zed to be �ood neigiiboi ta St.
Catherine's, and they, in turn have been a solicitous institution.
The college has every right to build a soccer field, but some
safety provisions should be made for taxpayers whose properties
abut the school. The trees in question, besides having an esthetic
value, have been an anchor for the rain run off that forms a stream
of water as it gushes along the fence behind our properties. On
Memorial Day, 1965, down our block at 1939 Bayard, our friends +
were inundated in the basement with water within 18 inches of
their first floor.
Besides the noise involved on sports events, prevention of
flooding should be a primary concern in evaluating St. Catherine's
plans. Too often land is stripped of trees and foliage, and after a
heavy deluge there is a wringing of the hands as to mistakes made
in underestimating the results of heavy rains or heavy snow melts..
We hope in your consideration of St. Catherine's request for a
permit, you will keep her neighbors' troubling concerns in mind.

On Wednesday, Septembex 6, 2000, the College of St.Catherine will appe� at a
pub&c hearing to xespond to an appeal of one neighbox to the site plan foz the constcuction

unanimously approved by the Plannina Comuussion meets necessasy xequixements, that the
college has taken steps to alleviate the concems e�pressed by the neighboxs on Bayasd
Avenue, and that thexe has been no erxox made by the Planning Coimnission. In addirion,
we have the support of the Highland District Council.

We recognize that we caused some contLOVexsy in April in moving forwaxd cvith txee
xemoval on short notice to the neighbors. We have apologized to the neighbors for this e�or
in judgmen� and have subsequendy established an on-going neighboxhood liaison task foxce,
a landscaping task farce, and set periodic open-invitadon meetings with the neighbors on
Sayaxd and the surrounding azea. We ase pleased that the appellaiit is sexving on oux
landscaping task foxce.

The issues saised in the appeal relate to lighting, noise, and drainage. Each was
addiessed at the Zoning Coinmittee public heating on August 3, 2000, and the Plauning
Cotnmission on August 11, 2�00.
The college does not intend to install lighting fox the soccer field. It was never part
of oux plan, so we readilp agxeed to it as a condition. In addition, the landscaping plan
appxoved bp the city provides for planting tTees and shrubs that provide a natural bazriei
ftom other campus lighting.
Roger Pocta of Lasson Engineering will provide fuither detail on the dxainage plan
at the public hearing. We believe that the construcrion of the field cvill nnprove the dtainage
in the azea. Two new catch basins will be installed to intercept storm watet and the axea
south of the field will be graded to ditect more storm water to them.
The plan does not violate the noise standards. Intem�ittent noise will not vio]ate
these standazds.
These aze exciting times at the College of St. Catherine. We recently completed a
stcategic planning pxocess and a mastex space plan to guide the development within oux

Whereas, the Zoning Committee of the Commission conducted a public hearing on
August 3, 200Q after having provided notice to affected property owners, and submitted its
recommendation to the Commission. By its resolution number 00-50, dated August 11, 2000,
the Commission decided to grant the application, subject to specific conditions, based on the
following findings and conclusions:

The city's adopted comprehensive plan and development or project plans
for sub-azeas of the city.
The site plan meets trus condition.
Applicable ordinances of the City of Saint Paul.
The site plan meets this condition:
- The use is permitted. The College of Saint Catherine's has a Special
Condition Use Permit and an athletic field is considered a permitted
accessory use for the college.
- Staff does not anticipate that the activities on the field will exceed any
noise limits.
- As part of building the field, a number of trees must be removed.
However, the campus is not in a tree preservation district that
regulates the removal of trees and sets standards for replacing trees.
36 - The field complies with required setbacks. The zoning code does
37 not establish a minimum setback for athletic fields but it requires a
38 50-foot setback for buildings on college and the soccer field would

8 The site plan meets this condition. Construction of the soccer field will
9 result in the removal of a number of existing mature trees. However, most
10 of the remainiug undeveloped land on the college's campus is wooded and
11 so any other feasible location for a soccer field would also result in a
12 similar loss of trees.

14 (4) Protection of adjacent and neighboring properties through reasonable
15 provision for such matters as surface water drainage, sound and sight
16 buffers, preservation of views, light and air, and those aspects of design
17 which may have substantial effects on neighboring land uses.

Preservation of unique geologic, geographic or historically significant
characteristics of the city and environmentally sensitive areas.
19 The site plan meets this condition. Steps will be taken to improve existing
20 drainage problems and the field will be screened by new landscaping. (See
21 items 8 and 9 below.) The field will not have lights or bleachers.

The arrangement of buildings, uses and facilities of the proposed
development in order to assure abutting properiy and/or its occupants will
not be unreasonably affected.
The site plan meets this condition. The soccer field is located as faz from
neighboring residential property as possible given the location of existing
buildings and athietic fields on the campus.
Creation of energy-conserving design through landscaping and location,
orientation and elevation of structures.
The site plan meets this condition.
(7) Safety and convenience of both vehiculaz and pedestrian traffic both within
the site and in relation to access streets, including traffic circulation
features, the locations and design of entrances and exits and pazking areas
within the site.
The site plan meets this condition.

The satisfactory availability and capacity of storm and sanitary sewers,
including solutions to any drainage probiems in the area of the
development.
The site plan meets this condition. The soccer field has been designed to be
built on sand with drain tiles and will not add to the existing storm water
run-off for the azea. However, some neazby residents have complained
about existing drainage problems that affect their properties after heavy rain
falls. Part of the problem in

the azea near the soccer field may be due to run-off from an older parking
3 lot north of the field that drains toward the neighboring properties.

5 To deal with the drainage, two new catch basins will be installed to
6 intercept more storm water run-off and the area south of the field will be
7 graded to direct more of the run-off to the new and existing catch basins.
8 Existing catch basins will be cleaned if needed to make sure they ue
9 functioning properly.

(9) Sufficient landscaping, fences, walls and parking necessary to meet the
above objectives.
The site plan meets this condition. Some of the yazds already have large
shrubs on their back property line which wiil help screen the field.
However, additional landscaping should be planted as needed to screen the
field from adjacent residences. There aze restrictions on what can be
planted because of an easement for a public sewer that runs along the south
and east property lines: trees cannot be planted in this area but lazge shrubs
are permitted. The site plan submitted shows shrubs planted along the
south and east properiy lines. The exact location and numbers of shrubs
can be adjusted to reflect the location of existing large shrubs on the
neighboring property.
(10) Site accessibility in accordance with the provisions of the Americans with
Disabilities Act (ADA), including parking spaces, passenger loading zones and
accessible routes.
The site plan meets this condition.
(11) Provision for erosion and sediment control as specified in the "Ramsey Erosion
Sediment and Control Handbook."
The site plan meets this condition. Silt fences and measures to protect catch
basins from sediment during construction will be required.
Whereas, given the findings above and under the authority of Leg. Code § 64.300(e), the
Commission imposed the following conditions upon the approved site plan:
40 1. Landscaping and screening The field must be screened on the south and east sides by
41 planting shrubs that will grow at least 12 feet tall. The exact number and placement of
42 these shrubs will be determined by site plan review staff based on the location of existing
43 shrubs on neighboring property and input from the neighboring property owners.

2. Drainage Two new catch basins must be installed to intercept storm water and the
area south of field must be graded to direct more storm water to the new and existing
catch basins. Catch basins must be cleaned as needed to ensure that they are working
properly.
3. Seating and lighting No permanent seating for spectators and no lighting for the field
may be installed without prior approval by the City.

2 Whereas, pursuant to the provisions of Leg. Code § 64.206, Jean Iwen duly filed with the
3 City Clerk an appeal from the determination made by the Commission and requested, for the
4 purpose of considering the actions taken by the said Commission, a hearing before the City
5 Council; and
7 Whereas, pursuant to Leg. Code §§ 64.206 - 64.208, and upon norice to affected parties a
8 public hearing was duly conducted by the City Council on September 6, 2000 where all
9 interested parties were given an opportunity to be heard; and

Whereas, The City Council, having heard the statements made, and having considered the
application, the report of staff, the record, minutes and resolution of the Zoning Committee and
ofthe Planning Commission, do hereby
Resolve, That the Council of the City of Saint Paul does hereby affirm the decision of the
Planning Commission in this matter, and adopts as its own the findings in Planning Commission
resolution 00-50; and
Be it Further Resolved, that the Council, acting in this matter pursuant to Leg. Code §
64.207, hereby modifies condirion numbers "one," "two; ' and "three" as imposed by the
Commission and adds a new condition "four" to read as follows:
l. Landscaping and screening.
25 The College shall replace trees that have been or will be removed to make
26 way for the soccer field with replacement trees using a replacement schedule consistent
27 with the City's Tree Replacement policy set forth in Leg. Code § 60.788(b)(1-3).
28 Replacement trees will heip preserve the essential chazacter of the college campus as
29 well as the abutting residential neighborhood and will promote a physical and aesthetic
30 buffer between the soccer field and abutting residential properties. In addition, a
31 landscaping plan consistent with this replacement condition shall be prepared by the
32 Coliege. The plan shall be developed using a registered landscape architect or forester.
33 The plan shall, at a minimum, provide for screening the soccer field by planting and
34 maintaining a combination of trees and shrubs along the north, south and east sides of
35 the field. The shrubs and trees shall be of species which will grow at least 12 feet tall.

The shrubs and trees should be of different species and densities and have visual
37 screening, wind break, dust collection, heat and glare reduction and noise barrier
38 characteristics. The plan shall be developed with input from a neighborhood
39 committee. The committee must include some properry owners abutting the location
40

of the proposed soccer field. The plan shall be submitted to site pian review staff for
approval.
2. Drainage.
45 Two new catch basins shall be installed to intercept storm water. Public works
46 staff will review and approve their location, size, etc. The area to the south of the
47 soccer field must be graded to direct more storm water to the new and existing catch
48 basins. All catch basins shall be maintained to ensure that they are working properly.
49 In addition, the College must conduct a groundwater and surface drainage study on the
50 impact of the new soccer field on the capacity and availability of present storm and
51 sanitary sewers. The study shall include solutions to any

1 drainage problems present in the area of the new soccer field. In particular, the study
2 must address the drainage issues noted in the Planning Commission Resolution
3 fmdings at paragraph 8. The study shall be submitted to the department of public
4 works for review and approval. If deemed necessary by public works, the College shali
5 implement plans identified in the study to resolve groundwater or drainage problems
6 in the area of the new soccer field. This study shall be done as part of a broader
7 campus drainage study which the College has indicated that it is planning to prepaze.

3. Seating and lighting.
11 No spectator seating and no field lighting may be installed without the prior
12 approval of the zoning or plamzing administrator. Thereafter, no changes in seating
13 and lighting shall be made without prior approval by the zoning or planning
14 administrator. In addition, campus lighting shall be focused, shielded and located so as
15 to compensate for light screening as existing prior to the removal of the trees for the
16 soccer field and consistent with the safety needs of students and campus patrons.
17 Lighting issues should be addressed with input from a neighborhood committee.

4. Field activities.
All games, practices, and field activities shall be scheduled by the College and the
schedule of such activities shall be readily available to the public from the College.
The College has indicated that it will obtain the input of the Highland District Council
on any plan for use of the field by groups not related to the College. To make such
input meaningful, the College will not allow use of the field by groups not related to
the College for a period of one (1) year in order to allow the District Council an
opportwiity to conduct an evaluation of the impact of the field and to meet with the
College to formulate a plan for non-college field use approved by the District Councit.
The one year period shall commence as of the date the fietd is completed and availabte
to the College for play.
And Be It Further Resolved, That the appeal of Jean Iwen is denied;
34 And Be It Finally Resolved, That the City Clerk shall mail a copy of this resolution to the
35 College of St. Catherine, Jean Iwen, the Zoning Administrator and the Planning Commission.

On August 11 the Planning Commission approved a site plan for a new soccer field to be built at the
southeast corner of the campus of the College of Saint Catherine. The field requires the removal of an
number of existing trees and it witt be close to the back yards of nearby residences. So conditions were
added about landscaping, screening, draina�e, seating and lighting intended to minimize the impact of
field on nearby residents. (See attached resolution.)
The Zoning Committee of the Planning Commission, the Highland Area Community Council and LIEP
staff recommended approval with conditions.
At the public hearing 8 people spoke in opposition and 2 letters in opposition were received.

WHEREAS, the Saint Paul Zonin� Committee on 813J00, held a public hearing at which ail
persons present were given an opportunity to be heazd pursuant to said application in accordance

However, some nzarby residents have complained about eristin� draiesge problems that

affect their properties after heavy rain falls. Part of the problem in the area near the'
• soccer fieid may be due to run-off from an older parking lot north oi the fieId that drains
to�vard the neighborin� properties.
To deal with the draina�e, rivo ne�v catch basins �vill be installed to intercept more storm
water run-off and the area south of the field �vili be graded to direct more of the run-off to
the ne�v and existin� catch basins. Existin� catch basins will be cleanzd if needed to
make sure they are functionin� properly.

The site plan meets this condition. Some of the yards already have large shrubs on their
back property line �vhich wili hzlp screen the field. However, additional landscapin�
should be planted as needed to screen the field from.adjacent residences. There are
restrictions on �vhat can be planted because of an easement for a public sewer that runs
alon� the south and east property lines: trees cannot be planted in this area but lazge
shrubs are permitted. The site plan submitted sho�vs shrubs planted alon� the south and
east property lines. The exact location and numbers of shrubs can be adjusted to reflect
the location of existin� large shrubs on the nei�hborin� property.

The meeting was chaired by Commissioner Field.
Coilege of Saint Catherine - 00-135-531 - Site Plan Review for a new soccer field. 2004
Randolph (the proposed field is at the SE corner of the campus near Fairview and Bayard).
Tom Beach showed siides and presented the staff report. Mr. Beach stated their was one letter
from a neighbor i� opposition and passed out a letter from the Highland District Council which
stated they recommend approvai of the Site Plan with the condition that no lights or benches are
installed. 7hey would also like to meet with the coilege of St. Catherine's to discuss how the
landscaping pian can be refined. Mr. Beach aiso stated the Zoning Staff is recommending approvat
of the site plan with conditions.
At the questions of Commissioner Gordon, Mr. Beach stated the College of Saint Catherine's did
not request Iighting. There wiil be approximately 30 trees over 12 inches in diameter that would
be cut down. The trees could nof be planted on the south side because the �oots coufd interfere
with the sewer system. The area drains to the south now and is similar to how the soccer field
would drain. Mr. Beach also expiained the Department of Public Works stated the soccer field
would not create additionai �vater drainage problems because of the sand and drain tites that are
being installed.
Upon further question of Commissioner Gordon, Mr. Beach expiained the Zoning Board couid make
no lighting and seating a condition of approval so they would be required to appiy for a site pian
to get them approved.
Ms. Mary Des Roches, Vice President for Finance and Business Operations for the Coliege of
Saint Catherine appeared and stated they view the soccerfield an enhancement to the campus as
essential to their ability to recruit and retain studenfs who are interested in athletics and physical
fitness as a component to tfieir total educationa[ experience, They have met with the neighbors
and have taken steps to respond to their suggestions. A neighborhood task force has been
established to make recommendations on the landscaping. Theirwili be 50 to 100 trees cut down.
A number of the trees are offshoots and scrubs and a number of the trees are matured and are
beyond their useful life and wouid have to come down in the future. She also explained they don't
need fighting because soccer is a seasonal spoR and woufd begin in August with about 11 to 15
games in the season depending on piay-off games. The games generaliy sta� about 4:OOpm and
end before dusk on weekdays.
At the question of Commissioner Gordon, Ms. Des Roch>s stated tnay would be wiliing to discuss
repianting trees taking into account the entire landscaping project. They have a comm+tment to

retain the beauty of the coitege through pianting trees, shrubbery and other horticultural designs. •
She aiso stated they would not have a problem applying for a permit if a Iight and seating need
arose.
Ms. Siettum, 1841 Bayard Ave, appeared in opposition and stated she supporfed the coliege and
their expansion but had concerns with seven issues. 1) Taking outthe numberof trees will reduce
the natural drainage. 2) Parking issues and fraffic flow during tournaments. 3) Replacing trees
that are removed. 4) Noise levels during soccer games. 5) Property values being decreased. 6)
Environmental issues with trees being removed in the past and present. 7. Make sure the field
is used for cotlege games as opposed to neighborhood games or others using the field.
At the question of Commissioner Gordon, Mr. Siettum stated they wanted the field to be used by
the coilege only.
At the question Commissioner Field, Mr. Beach stated under the Zoning Code there is no
requirement for additional parking for the soccer fieid because_the coitege is meefing the parking
requirements. Norfh of the field there is a parking lot witi:�300_uarking spaces.
Commissioner Fieid also noted he appreciated fhe issue of concem; property vatues are not an
issue to be considered in respect to this site plan review. �
Ms. Jean Iwen , 1855 Bayard, appeared in opposition and stated she was concerned about fhe
noise level created by the baseball and soccer teams. She aiso expiained noise during the day
could not exceed 65 decibels more than 10 percent of the time given in an hour. in comparison
street traffic is 80 decibeis. She also stated she had concerns about surface slant that wou[d not
allow landscaping to have a berm that would raise ihe bushes without causing roots to impact the
sewers. Ms. Iwen also stated she wouid like to have lights, seating and times of the fieid to be
stiputated as conditions.
At the question of Commissioner Field, Mr. Beach stated noise sfandards are set at 65 decibefs
used against noises that are continuous like a motor or fan from a business. tntermittent noise
from people piaying soccer would not trip the noise standards because it is sporadic.
Mr. John Matthews, 2009 Bayard, asked that nothing be done with Saint Catherine's until fhe high
water probiem is atleviated.
At the question of Commissioner Gordon, Mr. Matthews stated the soccer field wouid not have a
positive or �egative effect on the water problem.
Mr. Dennis Malloy, 2019 Bayard appeared and stated he wouid like Saint Catherine's to clean out
the catch basins.
Mr. James Neher, 1837 Bayard appeared and noted the field is oniy 50 feet from the neighbors
back yards.
Mr. Edward Stephens, 1805 Bayard, came forward and stated he had concerns with all the trees

being cut down and the drainage problems.

Mr. Michael Browan 1991 Bayard, appeared and commenfed on fhe drainage issue and fhe
additionai adverse impact that the soccer fieid couid have on the drainage because oYthe frequent
watering of the field and that a study shouid be made on the fieid for drainage.
Mr. Craig Stephens, appeared and had concerns about the trees being cut down.
Ms. Mary Dayton stated she would like the coilege to monitor the field closely.
At the question of Commissioner Morton Ms. Deyton stated St. Catherine's has been a good and
responsible neighbor. �
Ms. Mary Des Roches reappeared and stated the facility could not be moved furffier to the north
because of the restrictions on service access that is required for safefy purposes for the apartment
building. -The plan for the soccer field is the fans will be on the north side of the field and the
players and coaches and referees would be on the southem perimeter ofi the fieid.
Ms. Sheila Brown came forward and stated between 11 and 15 soccer games wou(d be played on
• the field. She aiso stated they had requests for neighbors to use the fieid and they wouid restrict
the usage.
At the question of Commissioner Gordon, Ms. Brown stated there wouid be anywhere between 15
and 70 spectators.
Mr. Roger Poctor of Larson Engineering, appeared and explained the design of the soccerfieid and
stated it will have 12 inches of sand with peat and humus materiai which the water would flow
through easily. He aiso stated the catch basins in ptace wili be adjusted to improve the drainage
and two more wi(I be added. The storm sewer is 72 feet in diameter and has a significant capacity.
The water management will be significantly improved with the soccer fieid.
At the question of Commissioner Gordon, Mr. Poctor stated the plans have taken into consideration
the watering of the fieid.
At the question of Commissioner Fieid, Mr. Poctor stated an outdoorfieid woutd be better for water
management than a building with appropriate drainage.
Ms. Marcy Dowse, Communicafions Director of fhe College ofi Saint Catherine, addressed the
landscaping issues. She stated they witl be working with the neigh6ors and Zoning Staff to finalize
the landscaping. They will maintain communications with the neighborhood.
The hearing was ciosed.

A. PURPOSE: Site plan review for a new soccer field
B. PARCEL SIZE: The soccer field would cover 1.7 acres (210 feet by 345 feet) at the
soutfieast corner of the campus of Saint Catherine's. The entire campus covers 110 acres.
C. EXISTING LAND USE: The land where the soccer field would go is currenfiy a wooded
area. Approximately 50% of the campus is v��ooded.
D. SURROUNDING LAND USE: The area to the east and south of the proposed soccer
field is single-famify residentiai. The area to the west and north is part of the Saint
Catherine's campus: to the west is a softbail field and to the north is a student apartment
buitding.
E. DISTRICT COUNCIL RECOMMENDATION: The Highland Area Community Councii will
meet to discuss this site plan on July 27. Residents near Saint Catherine's have told staff
they are concemed about noise from games on the fieVd, the loss of existing trees, and
drainage problems.
F. HISTORY/DISCUSSION:
1. Master plan The Coilege recentiy compieted a master plan for the campus to guide
development for the next 30 years. The master plan recommends locating simi(ar
functions together on the campus and so it cails for locating the proposed soccer field
and a proposed field house at the southeast corner of the campus near the existing
athletic building.
2. Drainage Some residents south of the campus have complained about wet
basements and other drainage probiems after heavy rain sforms. The exact cause of
these probiems has not been determined. However, officials from Saint Catherine's told

staff that most of these complaints have come from residents living west of the �
proposed soccer field.
3. Proposed use of the field The field wouid be used 6y Saint Catherine's soccer team.
They would play about 19 games there per season plus a few additional games if the
team made the play offs. They wouid also use the field for practice. Saint Cafherine's
has not made any commitments at this time to let outside groups such as youfh (eague
soccer feams use tfie field. They may consider permitting some outside use in ihe
future when Saint GaYherine's team is not having its season.
G. FINDINGS: Section 62.108(c) of the Zoning Code says that in "order to approve the site
plan, the planning commission shail consider and find ff�at tfie site p(an is consistent with"
the foliowing:
(1) Tfle city's adopted comprehensive plan and development or project plans for sub-areas
of the city.
The site plan meets this condition.
(2) Applicable ordinances of the City of Saint Paul.
The site plan meets this condition:

and air, and those aspects of design which may have substantia! effecfs on neighboring

I was pieased to Ieam that we have the approvai for the landscaping plans. At
our last meeting you asked that i send you somefhing in writing regarding our
master space plannning and the areas we had considered for the soccer field.
The Coliege administration approved the construction of a soccer fieid fifteen
months ago but put the project on hoid until we had compieted the full master
space pian. We did not want to limit our future options with this consVUCtion.
The fieid was in6tially intended to be in the generai area that it is now being
built, in close proximity to the softball field. During the master space
planning process we held to the assumption that we wanted to group like
activi6es together to the extent desireable. That is why the athietic
facilities are generaily grouped in the south east quadrant of the campus with
the Butler Center siightly west.
In December,1999 Ellerbe Becket presented the college with three aitemative
plans. Alternative A showed the athietic fields noRh of the Aiberta Apaertments
on the current parking lot with a new roadway and a new gate to the south
parallel and in proximity to the back of the homes on Bayard.Aiternative B
showed the same without a roadway. Both required the construction of a large
parking structure. Altemative C showed athietic fields east of the softbail
area. These were early schematic designs and Elierbe took comments from tfie
coilege community to do further development.
The plans in January continued to group the athletic faciiities in the south
east quadrant. One presented the fieid house where the Aiberta Apartment
building now stands. One showed the fieldhouse just north of the current
softbail fieid. The college recognized the �eed for a soccer field in phase one
of the impiementation of the plan and did not wish to tear down an apartment
building that is weii used stiil has some years left in it. We were aiso
reluctant to buiid large parking structures for both cost and secutity reasons.
We asked Eilerbe Becet to take these matters into consideration when they came
back with the next set of drawings.
Because of the urgency of constructing the soccer fieid and the impact the lack
of a fieid was having on our enrollment and athletic program, we considered
other temporary sites. We looked at the area directly west of Derham Hall and
near the Dewdrop pond. We rejected the idea of a temporary fieid because of the
cost and because of the enviroronmental issues. We remained committed to having
the soccer field in the area of campus with other athietic actvivies.
The plan which was presented to the board of trustees in April had the soccer
field with a track around it in the area generally where it now is planned. The
track was removed as not part of the master space pian. The field house was
moved north to be cioser to fhe Butler Center. The Alberta Apartment building
reamined intact. The O'Shaughessy parking lot was designated for future parking.
There was no new roadway through the south east quadrant to Fairview. This pian
was deemed the ieast disruptive to the neighbors and the most suited to the

college. �
We have made modifications to the plan to preserve as many trees as possible so
the current location is not exactly as on the pian of Aprit 14. The plan dated
June 26 is more exact . This is what was presented to the neighbors at the
meeting the evening of June 26.

The Highland District Council has reviewed the site plan submitted by the Coitege
of St, Catherine for the new field on the'sr campus. The Council agrees that there
should be no lighting installed on the fietds and that no permanent seating be
installed. We are aware that the College has held several meetings with their
neighbors and have taken concerns raised into consideration during the planning
process.
The Councii would like to have a member of our Board work with ffie neighbors
and fhe College regazding the landscape ptan for the area south of the field. The
board believes that it is important that community input be part of that process.
We further encourage the College to consider the needs of community youth
regarding use of the new fields for youth soccer should that need arise.

date set for a hearing on the soccer field proposal offered by St.
Catherine College, we respectfully submit this letter in our
absence.
We have resided at 1845 Bayard Avenue for almost 45 years.
�
AIl these years we na�e t�zed to be �ood neigiiboi ta St.
Catherine's, and they, in turn have been a solicitous institution.
The college has every right to build a soccer field, but some
safety provisions should be made for taxpayers whose properties
abut the school. The trees in question, besides having an esthetic
value, have been an anchor for the rain run off that forms a stream
of water as it gushes along the fence behind our properties. On
Memorial Day, 1965, down our block at 1939 Bayard, our friends +
were inundated in the basement with water within 18 inches of
their first floor.
Besides the noise involved on sports events, prevention of
flooding should be a primary concern in evaluating St. Catherine's
plans. Too often land is stripped of trees and foliage, and after a
heavy deluge there is a wringing of the hands as to mistakes made
in underestimating the results of heavy rains or heavy snow melts..
We hope in your consideration of St. Catherine's request for a
permit, you will keep her neighbors' troubling concerns in mind.

On Wednesday, Septembex 6, 2000, the College of St.Catherine will appe� at a
pub&c hearing to xespond to an appeal of one neighbox to the site plan foz the constcuction
of a socces field in the southeast azea of out piopesty. We believe the site plan as
unanimously approved by the Plannina Comuussion meets necessasy xequixements, that the
college has taken steps to alleviate the concems e�pressed by the neighboxs on Bayasd
Avenue, and that thexe has been no erxox made by the Planning Coimnission. In addirion,
we have the support of the Highland District Council.

We recognize that we caused some contLOVexsy in April in moving forwaxd cvith txee
xemoval on short notice to the neighbors. We have apologized to the neighbors for this e�or
in judgmen� and have subsequendy established an on-going neighboxhood liaison task foxce,
a landscaping task farce, and set periodic open-invitadon meetings with the neighbors on
Sayaxd and the surrounding azea. We ase pleased that the appellaiit is sexving on oux
landscaping task foxce.

The issues saised in the appeal relate to lighting, noise, and drainage. Each was
addiessed at the Zoning Coinmittee public heating on August 3, 2000, and the Plauning
Cotnmission on August 11, 2�00.
The college does not intend to install lighting fox the soccer field. It was never part
of oux plan, so we readilp agxeed to it as a condition. In addition, the landscaping plan
appxoved bp the city provides for planting tTees and shrubs that provide a natural bazriei
ftom other campus lighting.
Roger Pocta of Lasson Engineering will provide fuither detail on the dxainage plan
at the public hearing. We believe that the construcrion of the field cvill nnprove the dtainage
in the azea. Two new catch basins will be installed to intercept storm watet and the axea
south of the field will be graded to ditect more storm water to them.
The plan does not violate the noise standards. Intem�ittent noise will not vio]ate
these standazds.
These aze exciting times at the College of St. Catherine. We recently completed a
stcategic planning pxocess and a mastex space plan to guide the development within oux
cutrent campus boundaries. The College of St. Catherine's views the soccer field as essential
to out ability to recruit and setain women who ase incteasingly interested in athletics and
physical fimess as a component of theix total educational expeuence. We ask that pou
confirm the unaniixious vote of the Planning Coinuussion and allow us to proceed.

Ms. Shiela Brown (athletic director) came foreward and stated
between-�.1 and 15 soccer games would be.played on the field
and they would restrict useage. There would be between 15 and
70 spectators.
CONCIItN: Ms. Brown told me in a phone call I made to her
that the field would also be used for regular practices
(with no specifics on rnunber or time of day)� also
gym classes, impromptu games, and camnunity use!
Point 4 in zoning conditions:
Protection of adjacent and neighboring properties through reasonable
provisions for such matters as ...si�ht and sound buffers...and those ,s:,.�• i: rt
aspects of design which may have substantial ef£ects on neighboring
land use. ,
CONCII2N: The use of homeowners back yards for gardening,relaxing,
entertaining, etc. will be greatly di,minished by
our "Neighbors” to the north having up to 70 spectators,�lus
coaches, and players yelling!! Referees will blow -
shri3l whistles!

shrubs and fences for �aomse control�.�adequate. The
field wa.11 be 30 ft. fran the property line�(team benches).
The Highland District Council
Their recommendation was made without in ut from an of the affected
haneowners. They evaluated only the St. Catherine s si e of t e issue.
Ms. Soauners was aware of my concexn regarding the field and had my
phone rnunber.
CANCIItN: I question their bias and their ability to mediate questions
regarding useage of the field.
RECOhIINmDATION REGARDING NOISE CONTROL: PLEASE GIVE ADJACE�T PROPERTIES AT
