Dear Sir/Madam:
The Office of License, Inspections and Environmentai Protection has recommended
adverse action a�ainst the Mait Off-Sale License held by Speedway Superamerica LLC, d/b/a
Superamerica, for the premises at 296 7`'' Street East in Saint Paul. The basis for the
recommendation is as follows: "
On July 13, 2000, an 18 year old and a 19 year old entered the
premises oi tae SuFe; america a� 295 �ast 7'" �#; eet as part �f a
liquor compliance check. The 18-year old female took a 12-
pack of Milier Genuine Araft beer to the counter, and the clerk
asked her for her birth year. The compliance checker stated it
was 1982, and the clerk then sold the beer. It is a violation of
Minn. Stat. §340A.503 to sell alcohol to a person under the age
of 21.
Since this is considered a second violation, the licensing office will reconmend a
$1,000.00 fine, pursuant to St. Paul Legislative Code §409.26.
At this time you have three options on how to proceed:
If you do not dispute the above facts and do not wish to have a public hearing, you will
need to pay the recommended fine for this violation. If this is your choice, you should
make payment directly to the Office of License, Inspections and Environmental
Protection, Room 300 Lowry Professional Building, 350 Saint Peter Street, Saint Paul,
Minnesota 55102. The letter should be directed to Ms. Christine Rozek. Payment of the
fine will be considered to be a waiver of the hearing to which you are entitled.

2. Altematively, if you do not dispute the above facts, but wish to have a public hearin�
before the Saint Paul City Council, you will need to send me a letter with a statement
admitting the violation and requesting a hearing by Monday, September 18, 2000. The
matter wi11 then be scheduled before the City Council for a public hearing to determine
what penalty, if any, to impose. You will have an opportunity to appeaz before the
Council and make a statement on your own behalf as to the penaity to be imposed.
3. If you do dispute the above facts, a hearing will be scheduled before an Administrative
Law Jud�e. At that hearing both you and the City will be able to appear and present
witnesses, evidence, and cross-examine the other's witnesses. The St. Paul City Council
will ultimately decide the case. Please let me know in writing no later than Monday,
September 18, 2000, how you wish to proceed.
if you have not contacted me by Monday, September 18, 2000, I will assume that
you are not contesting the facts and will schedule this matter for the St. Paul City Council
and have it placed on the Consent Agenda during which no public discussion is allowed
and the recommended penalty will be imposed.

Superamerica failed a routine liquor compliance check. �
NARRATIVE
On 07-13-00 Squad 795 (F. Reilly) and Squad 791 (Sgt. Ramstad) were conducting liquor
compliance checks of licensed liquor estabiishmencs in the city of St. Paul. We used two under
aged checkers. We verified that bo[h of the checkers were under the age of 21. We used
checker #56 (DOB OS/OS/82) and checker #53 (DOB 08-29-SO). We took all their personal
proper[y and provided them with buy money. They were trained on how to conduct the checks.
They were trained that they could not lie about their age and dates of births. They had no form of
identification to show.
On this date at 1745 hours the checkers were sent into the Superamerica at 296 E. 7th Street. The
checkers purchased a 12 pack of MGD cans from the clerk who was later identified as TUCKER,
Bazbaza Lynn (DOB 03-IS-bS, of 1115 York i14 Si. Paul, MN 55106 (H)771-9836 (W) 225-9567).
Checker !{56 was the checker who handed the money to TUCKER for the purchase. TUCKER
asked Checker #56 for her birth year and Checker N56 replied, "1982." TUCKER then sold the
beer to Checker /�56.
The checkers were wearing a transmitter and microphone and we were able [o monitor the
transaction as it occurred. The checkers retumed with the purchased beer and pointed ou[ the
clerk, TUCKER, u being the party who had sold the beer to them.
Sgt. Ramstad and I went into the store and identified ourselves. We told TUCKER and the shifr
supervisor, MARTINEZ, Renee Charmagne (DOB 10-08-81, of 2075 E. Hwy 36 f1313 North St. Paul,
MN 55109 (H)773-3009 (W) 225-956� about the violation. We told TUCKER and MARTINEZ that
a report of the violation would be forwarded to LIEP and that possible cruninal charges would be
forthcoming.
TUCKER and the MGD beer was photographed. The 12-pack was retumed to the store and the
money was recovered.

Dear Sir/Madam:
The Office of License, Inspections and Environmentai Protection has recommended
adverse action a�ainst the Mait Off-Sale License held by Speedway Superamerica LLC, d/b/a
Superamerica, for the premises at 296 7`'' Street East in Saint Paul. The basis for the
recommendation is as follows: "
On July 13, 2000, an 18 year old and a 19 year old entered the
premises oi tae SuFe; america a� 295 �ast 7'" �#; eet as part �f a
liquor compliance check. The 18-year old female took a 12-
pack of Milier Genuine Araft beer to the counter, and the clerk
asked her for her birth year. The compliance checker stated it
was 1982, and the clerk then sold the beer. It is a violation of
Minn. Stat. §340A.503 to sell alcohol to a person under the age
of 21.
Since this is considered a second violation, the licensing office will reconmend a
$1,000.00 fine, pursuant to St. Paul Legislative Code §409.26.
At this time you have three options on how to proceed:
If you do not dispute the above facts and do not wish to have a public hearing, you will
need to pay the recommended fine for this violation. If this is your choice, you should
make payment directly to the Office of License, Inspections and Environmental
Protection, Room 300 Lowry Professional Building, 350 Saint Peter Street, Saint Paul,
Minnesota 55102. The letter should be directed to Ms. Christine Rozek. Payment of the
fine will be considered to be a waiver of the hearing to which you are entitled.

2. Altematively, if you do not dispute the above facts, but wish to have a public hearin�
before the Saint Paul City Council, you will need to send me a letter with a statement
admitting the violation and requesting a hearing by Monday, September 18, 2000. The
matter wi11 then be scheduled before the City Council for a public hearing to determine
what penalty, if any, to impose. You will have an opportunity to appeaz before the
Council and make a statement on your own behalf as to the penaity to be imposed.
3. If you do dispute the above facts, a hearing will be scheduled before an Administrative
Law Jud�e. At that hearing both you and the City will be able to appear and present
witnesses, evidence, and cross-examine the other's witnesses. The St. Paul City Council
will ultimately decide the case. Please let me know in writing no later than Monday,
September 18, 2000, how you wish to proceed.
if you have not contacted me by Monday, September 18, 2000, I will assume that
you are not contesting the facts and will schedule this matter for the St. Paul City Council
and have it placed on the Consent Agenda during which no public discussion is allowed
and the recommended penalty will be imposed.

Superamerica failed a routine liquor compliance check. �

On 07-13-00 Squad 795 (F. Reilly) and Squad 791 (Sgt. Ramstad) were conducting liquor
compliance checks of licensed liquor estabiishmencs in the city of St. Paul. We used two under
aged checkers. We verified that bo[h of the checkers were under the age of 21. We used
checker #56 (DOB OS/OS/82) and checker #53 (DOB 08-29-SO). We took all their personal
proper[y and provided them with buy money. They were trained on how to conduct the checks.
They were trained that they could not lie about their age and dates of births. They had no form of
identification to show.
On this date at 1745 hours the checkers were sent into the Superamerica at 296 E. 7th Street. The
checkers purchased a 12 pack of MGD cans from the clerk who was later identified as TUCKER,
Bazbaza Lynn (DOB 03-IS-bS, of 1115 York i14 Si. Paul, MN 55106 (H)771-9836 (W) 225-9567).
Checker !{56 was the checker who handed the money to TUCKER for the purchase. TUCKER
asked Checker #56 for her birth year and Checker N56 replied, "1982." TUCKER then sold the
beer to Checker /�56.
The checkers were wearing a transmitter and microphone and we were able [o monitor the
transaction as it occurred. The checkers retumed with the purchased beer and pointed ou[ the
clerk, TUCKER, u being the party who had sold the beer to them.
Sgt. Ramstad and I went into the store and identified ourselves. We told TUCKER and the shifr
supervisor, MARTINEZ, Renee Charmagne (DOB 10-08-81, of 2075 E. Hwy 36 f1313 North St. Paul,
MN 55109 (H)773-3009 (W) 225-956� about the violation. We told TUCKER and MARTINEZ that
a report of the violation would be forwarded to LIEP and that possible cruninal charges would be
forthcoming.
TUCKER and the MGD beer was photographed. The 12-pack was retumed to the store and the
money was recovered.

Dear Sir/Madam:
The Office of License, Inspections and Environmentai Protection has recommended
adverse action a�ainst the Mait Off-Sale License held by Speedway Superamerica LLC, d/b/a
Superamerica, for the premises at 296 7`'' Street East in Saint Paul. The basis for the
recommendation is as follows: "
On July 13, 2000, an 18 year old and a 19 year old entered the
premises oi tae SuFe; america a� 295 �ast 7'" �#; eet as part �f a
liquor compliance check. The 18-year old female took a 12-
pack of Milier Genuine Araft beer to the counter, and the clerk
asked her for her birth year. The compliance checker stated it
was 1982, and the clerk then sold the beer. It is a violation of
Minn. Stat. §340A.503 to sell alcohol to a person under the age
of 21.
Since this is considered a second violation, the licensing office will reconmend a
$1,000.00 fine, pursuant to St. Paul Legislative Code §409.26.
At this time you have three options on how to proceed:
If you do not dispute the above facts and do not wish to have a public hearing, you will
need to pay the recommended fine for this violation. If this is your choice, you should
make payment directly to the Office of License, Inspections and Environmental
Protection, Room 300 Lowry Professional Building, 350 Saint Peter Street, Saint Paul,
Minnesota 55102. The letter should be directed to Ms. Christine Rozek. Payment of the
fine will be considered to be a waiver of the hearing to which you are entitled.

2. Altematively, if you do not dispute the above facts, but wish to have a public hearin�
before the Saint Paul City Council, you will need to send me a letter with a statement
admitting the violation and requesting a hearing by Monday, September 18, 2000. The
matter wi11 then be scheduled before the City Council for a public hearing to determine
what penalty, if any, to impose. You will have an opportunity to appeaz before the
Council and make a statement on your own behalf as to the penaity to be imposed.
3. If you do dispute the above facts, a hearing will be scheduled before an Administrative
Law Jud�e. At that hearing both you and the City will be able to appear and present
witnesses, evidence, and cross-examine the other's witnesses. The St. Paul City Council
will ultimately decide the case. Please let me know in writing no later than Monday,
September 18, 2000, how you wish to proceed.
if you have not contacted me by Monday, September 18, 2000, I will assume that
you are not contesting the facts and will schedule this matter for the St. Paul City Council
and have it placed on the Consent Agenda during which no public discussion is allowed
and the recommended penalty will be imposed.

Superamerica failed a routine liquor compliance check. �
NARRATIVE
On 07-13-00 Squad 795 (F. Reilly) and Squad 791 (Sgt. Ramstad) were conducting liquor
compliance checks of licensed liquor estabiishmencs in the city of St. Paul. We used two under
aged checkers. We verified that bo[h of the checkers were under the age of 21. We used
checker #56 (DOB OS/OS/82) and checker #53 (DOB 08-29-SO). We took all their personal
proper[y and provided them with buy money. They were trained on how to conduct the checks.
They were trained that they could not lie about their age and dates of births. They had no form of
identification to show.
On this date at 1745 hours the checkers were sent into the Superamerica at 296 E. 7th Street. The
checkers purchased a 12 pack of MGD cans from the clerk who was later identified as TUCKER,
Bazbaza Lynn (DOB 03-IS-bS, of 1115 York i14 Si. Paul, MN 55106 (H)771-9836 (W) 225-9567).
Checker !{56 was the checker who handed the money to TUCKER for the purchase. TUCKER
asked Checker #56 for her birth year and Checker N56 replied, "1982." TUCKER then sold the
beer to Checker /�56.
The checkers were wearing a transmitter and microphone and we were able [o monitor the
transaction as it occurred. The checkers retumed with the purchased beer and pointed ou[ the
clerk, TUCKER, u being the party who had sold the beer to them.
Sgt. Ramstad and I went into the store and identified ourselves. We told TUCKER and the shifr
supervisor, MARTINEZ, Renee Charmagne (DOB 10-08-81, of 2075 E. Hwy 36 f1313 North St. Paul,
MN 55109 (H)773-3009 (W) 225-956� about the violation. We told TUCKER and MARTINEZ that
a report of the violation would be forwarded to LIEP and that possible cruninal charges would be
forthcoming.
TUCKER and the MGD beer was photographed. The 12-pack was retumed to the store and the
money was recovered.
