BLUE - MAVOR o�ncil Resolution Presented By ► Referred To Committee: Date Out of Committee By Date RESOLVED, That the proper City officials are hereby authorized and directed to execute an Amendment to a Lease Agreement dated December 21, 1966, among Independent School District No. 625, the Housing and Redevelopment Authority of the City of Saint Paul (now Public Housing Agency) , and the City of Saint Paul� said Lease per- taining to the operation of an existing gym at McDonough Homes Community Building, and said Amendment authorizing a forty-year ex- tension of the Lease Agreement; providing for an addition to the existing gymnasium; and further providing for lawn care services by the City; said Lease Agreement to be kept on file and of record in the office of the Department of Finance and Management Services. "Ct[v" and the PUBLIC ]iOUSiNC AGGNCY OF THE CITY OF SAINT ' .'AUL, hereinafter referred to as the "PHA"; � � WITNESSETH THAZ': [dHEREAS, the exis�ing LEASE dated December 21, 1966 can be amended to include an addi- tional area of School District proper[y for another structure to be built by ti�e PHA and operated by the City as an addition to an existing gym at the McDonough Homes community building; and W1irR�AS, there is a necd for a forty year lease for ttiis proposed addition to the gym; and ' WiILRGAS, tlicre is a nced to correct the names of .the PHA and the Department of Parks and Recreation and Public Buildings in the Lease; and WHEREAS, an additior.al Exhibit will be necessary t� describe the area of School District property the addition to the existing gym will require; and WHEREAS, the City has agreed to mow additional School DisCrict property; NOW THEREFORE, the parties hereto do mutually agree to the following revisions to the Lease dated December 21, 19b6: 1. Wherever the name "fiousing and Redevelopment Auth4rity of the City of Saint Paul, Minnesota" appears it shall be replaced with name "Public Housing Agency cf the City of Saint Paul" as authorized by the Laws of Minnesota for 1977 in Chapter 228. 2. Add the following to paragraph 1: "The City and the PHA agree to lease from the School District for the term of forty (40) years, commencing from the date of execution of the Amendment No. 1 the premises located within the City of Saint Paul on the Mississippi School site and described in the attached Exhibit "C" which is incorporated herein by reference. 3. In paragraphs 2, 3, 4, 6, 8, 9 and 13 whenever the term "recreation building" or "recreation facility" or "shelter building" or "recreational building" is used add to that term "and an addition to an existing ym:' 4. In paragraph 3 delete the name "Department of Parks and Recreation and Public Iisildings" and insert in its' place "Department of Community Services". , 5. Add to paragraph 9 the following sentence: "The City will mow the entire School District property westerly of Mississippi School building." Pape 1 of 3 .. ', . � i 6. Add to paragraph 14 the following sentonce: "Tliere is hereto attached Exhibit "C" describing tlie area for the addition to an existing gym, and the same is herewith incorporated by reference as though fully set forth verb�tim.
