An Ordinance amending hapter 60 of the
St. Paul Legislative C de pertaining to
zoning for the City of Saint Paul and the
zoning maps thereof.
WHEREAS, Pursuant to Minnesot Statutes, §462.357 and §64 .210
of the Legislative Code, Tim Stafk' duly petitioned to rezone Lots
15 & 16, Block 9, Burlington Heigh s Division No. 2, located on
the east side of Point Douglas Roac�, from R-1 to RT-1 for the pur-
pose of construction of a double bungalow, the petition having been
certified by the Department of Finance and Manage�nent Services on
May 21, 1980 as having been consentled to by at least 67� of the
owners of the area of the property ,to be rezoned, and further,
having been consented to by at leasit two-thirds of the owners of
the property situated within 100 feiet of the total contiguous
descriptions of real estate held by the same owner or any party
purchasing any such contiguous prop rty within one year preceding
the date of the petition; and
WHEREAS, The current planning �ommittee on June 19, 1980
conducted a public hearing for the �urpose of considering the
rezoning petition, and, pursuant to Section 107.03 of the Admini-
strative Code, submitted its recomm�ndation to the Planning Com-
mission that the petition be granted; and '
WHEREAS, The Planning Commissi�n considered the rezoning
petition at its meeting held on Jun� 27, 1980 and recommended
that the City Council approve the p�tition; and
WHEREAS, Notice of a public he�ring before the City Council
on the said rezoning petition was dwly published in the official

Dear Madam:
This is written in response to the peti$ion of Tim Stafki to rezone Lots 15
and 16, Block 9, Burlington Heights , Division #2 (south of 614 Point Douglas
Road) from R-1 (single family residenti�l ) to RT-1 (two family residential )
in order to allow him to build a double bungalow.
On June 19, 1980, the Current Planning ajnd Zoning Committee held a public
hearing at which the applicant and one a�djacent resident spoke in favor of
granting the petition. There was no opdosition. The Committee recommended
approval of the rezoning on a 5 to 0 vo�e.
At its June 27, 1980 meeting the Planning Commission also approved the
rezoning on a vote of 13 to 0.
This matter is scheduled to be heard by the City Council on August 14, 1980.

PRESENT: Mmes. Karns and Surr�ners ; Messrs. Lanegran, Levy and Pangal of the
Current Planning and Zoning Conunittee; Mr. Terry Sullivan, Assistant
City Attorney; Ms. Lane of the Division of Housing and Building Code
Enforcement; Ms. Beseman and Mr. Bunnell of the Planning Division
Staff. _
ABSENT: Messrs. Armstead, Bryan and Hanggi .
The meeting was chaired by Joseph Pangal , Vice-Chairman.
TIM STAFKI (#8667) : An application for a rezoning from R-1 to RT-I ta build
a ou le bunga ow to live in at 620 South Point Douglas Road.
The applicant was present. There was na opposition present at the hearing.
Mr. Bunnell showed slides of the site and reviewed his staff report with a
recortunendation for approval of the rezoning. The address of the property is
620 South Point Douglas Road.
Tim Stafki , 1301 St. Clair, said he pruchased the land with the intention of
building a double bungalow and homesteading half. There are many 50 foot lots
throughout the area with small homes. He bought two 50 foot lots to make up �
100 foot. l_ot to build a large home on and felt that it might set a tr:.end for
the rest of the area.
A resident from 590 S. Point Douglas Road stated his support of Mr. Stafki 's
proposal . He felt it was a good idea to put homes on 100 ft. parcels rather
than sticking tiny homes on 50 foot lots.
Hearing no further testimony, Mr. Pangal closed the public hearing portion of
the meeting.
Ms. Summers made a motion to recommend approval of the rezoning based on
staff findings 10 through 14. Ms . Karns seconded the motion. The mation
passed on a roll call vote of 5 to 0. _

A. SUFFICIENCY: The application was filed on a consent petition declared sufficient by
the Finance Department on May 21 , 1980; and received in the Planning �ffice on June 2,
1980. Fourteen parcels were eligible, ten parcels were needed, and twelve parcels were
obtained. The purpose of the rezoning from R-1 (One Family Residential District� ta
RT-1 (Two Family Residential District) was stated on the petition as: to build a
double bungalow to live in.
B. FRONTAGE & AREA: The property consists of two fifty foot lots on 100 foot frontage an
S. Point Douglas Road and a depth of 130 fee�t for a total area of 13,000 square feet.
C. SITE/AREA CONDITIONS: The site is just south of an attractive single-family, one story
brick home. The property is heavily wooded with sizable trees, brush, and tall grass
prevalent over the two lots from the frontage on S. Point Douglas Road to the rear of
the lot about 20-25 feet higher than street grade. The site overlooks U.S. Highway 61
and 10 and a portion of Pig's Eye Lake as well as the railroad trackage between these
two features. The property frontage is �abou� 30-40 feet higher than the grade of the
Highway.
D. FINDINGS:

l . The site was previously zoned "A" Resideruce.
2. In 1975 the site, and the surrounding area, was rezoned R-1 (One Family Residential )
as part of the citywide zoning change.
3. The applicant acquired the property in AprTl 1980.
4. The applicant intends to build a 28'x76' split entry double bungalow with brick
and stucco exterior roughly comparable to the adjacent home at 614 S. Point Douglas
Road. Each housing unit will have two bedrooms and a two car tuck-under garage.
5. The property has an overall grade of 13-14� and therefore the applicant does nat
require a variance from the Mississippi Rjver Critical Area regulations.
6. The applicant intends to use retention terracing in the rear of the property for
slope stabilization as well as sodding and general landscaping of the property to
minimize erosion possibilities.
7. The applicant claims that the doublQ bungalow, when constructed, will have 12 foot
side yard setbacks and about a 60 foot front yard setback, both allowable in either
a R-1 or RT-1 zone.
8. The applicant intends to occupy a portion of the double bungalow and homestead it. .
9. The applicant maintains that the design of the double bungalow would essentially
match the neighbor's house and would benefit the neighborhood by converting vacant
land into an attractive, larger resident�al structure.
10. The applicant claims that the changing economic condition relating to single-family
financing, such as increasingly high finan�ing requirements and potential resale
difficulties , essentially mandate the cons�ruction of a double bunqalow on this
site as a hedge against inflation and the �conomic situation.

D. FINDINGS CONT'D:
11 . The District 1 Community Council 'has reviewed the applicant's request for a
. zoning change and has approved it in early May. The applicant indicated
that the local neighborhood was also in support of his plans to build a
double bungalow subject to the ap�roval of the rezoning request.
12. The construction of a double bung�low which would blend into the residential
neighborhood would not introduce �ny disharmony into the area.
13. The requested change would allow a new residential structure on currently
vacant land which would apparently be' beneficial to the surrounding
neighborhood.
14. The Land Use Plan encourages high�r density development in residential zones;
the Housing Policy Plan encourages alternatives such as duplexes and double
bungalows in residential construction; and the District 1 Plan identifies
the guidelines which the applicant apparently met. Therefore, one can
conclude that this proposal is generally in accordance with these three plans.
E. STAFF RECOMMENDATION: Based on findings l0 through 14, staff recomnends approval
of t e requeste rezoning of the two lats directly south of 614 S. Point Douglas
Road.
