William Donovan Valuation and Assessment Engi.neer Date: August 14, 1980 Subject: Petition of Richard Sagstetter for the vacation of paxt of northerly 30 feet of Case Avenue as ori�.nally platted. Public Hearing - August 19, 1980 The pe�itioner, who awns the abutting property, proposes to combine the street with his property to provide additional space for development purposes. The area petitioned to be vacated measures 30 feet by 151 ' feet, and is a trapezoidal shaped parcel containing an area of 3,375 squaxe feet. The area, althaugh platted as a street, has not been �mproved and utilized for street purposes. The area is actually located between the i.mproved Case Avenue right-of-way and the petitioners parcel which he hopes to develop. The Depaxtment of Public Works has no objection to the proposed vacation. The Staff of the Department of Planning and Economic Development has reviewed the subject petition and finds no objection to the vacation as proposed. There were no objections or recomanendations from an�y other public or private agencies involved. In view of the foregoing, I recommend the vacation be approved subject to the following terms and conditions: 1. That the description of the street to be vacated read as follows: All that part o� the Northerly 30 feet of Case Avenue, as originally platted, which is bounded by the following described line: Beginning at the Southwesterly corner of Lot 4, Block 7 of Ames Out Lots; thence South along the Southerly extension of the West line of said Lot 4 to the point of intersection with the center line of sa.id Case Avenue; thence East along the center line of Case Avenue to the point of intersection with a line produced by the Northeasterly exten- sion of the Southeasterly line of Block 1 of Fairchild & Howard's re-arrangement of part of Tracy OutLots; thence Northeasterly along the Northeasterly extension of the Southeasterly line of said Block 1 td the point of intersection with the South line of Lot 4, Block 7, of Ames OutLots; thence West along tne South line of said Lot 4 to the roint of be�i.nning. , � � � + + ~ < ` ` ♦ , -2- . �� That the vacation be subject to all the terms and conditions of Chapter 228 oP the St. Paul Le�i.s- lative Code, as �amended. y�3: That the petitioner pay to the City the sum of $1,690.00 as compensation for the vacation. � � That the petitioner fUrnish the City with a bond in the amount of $5,000.00, and by acceptance of the terms and conditions of this vacation agrees to indemnify, defend and save harmless the City of Saint Paul, its officers and employees from a11 suits, actions, or claims of a,ny character, includ- ing, but not limited to, a claim brought because of any injuries, or damages received or sustained by any person, persons or property, on account of this vacation; or because of a�y act or omission, neglect or misconduct of said petitioner; or because of any claim or liability axising f�om or based on any violation of any law or regulation made in accordance • with the law, whether by the petitioner ar any of-���t��`' agents or employees. ,._. _ � � . , l�G„� �tJ �,.,, � '�,.�-___._— �i , -" cc: Mayor George Latimer
