Petition of Darrell Butler for the vaca.tion of part

This office submitted a repart to the City Council, dated Idov�ember 5, 1979, con-
cerning the above referenced subject. That report recommended denial of the
petition.
Subsequently, the Department of Public Works has submitted a revised report, re-
marving their objection to the vacation, subject to certain commitments by the
petitioner.
Should the Council on the basis of the public hearir� and the revised Public Works
report determine that the vacation be granted, the followin� conditions are
reconmlended:
l. TY�at the description of the street to be vacated read as follaws;
The west 5 feet of Mystic Street lyin� between a line
3 feet south of and pax�llel to the south line of Lot
38, Block 7, Burlington Hei�hts, Division No. 2 Ramsey
Co. Minn., and a line 27 feet south of and parallel
to the south line of said Lot 38.
2. That the vacation be subject to a11 the terms and conditions of
Chapter 228 of the St, Paul Legislative Cod.e, as amended.
� 3• Tha.t the petitioner, his heirs and assigns, agree that in the
event of a successfla.l Final Order callin� for theimprovement of
adjacent Mystic Street, the petitioner will convey to the City
of St. Paul all the lands being vaeated herein and also remove
ar�y structure built within the vacated area a11 at the petitioner's
cost and expense, said conveyance and remova.l to be c�npleted
within 90 days after forma.l notification by the City.
�+. That the petitioner agree to secure the necessary building perm3.t
and waiver of set back requireme�s before beginning �arage con-

Public Hearing - November 27, 1979
The petitioner, who owns the property abutting the proposed vacation area,
desires this vacation in order to build a garage on said proposed vacation site.
The area to be vacated is 10 feet by 2�+ feet (240 square feet) and is zoned
R-l. The petitioner states this is the only place to build the garage without
blocking the scenic view from his house.
The Department of Public Works states tha� there is apparently adequate room
on the petitioner's oFtn property to construct a garage. Whi.le Mystic Street
is a through street, it is presen�ly uriusable south of the petitioner's proper-
ty due to the existence of a steep bluff. If the street were ever i�proved, a
cul-d.e-sac would probably be necessary near the petitioner's property and the
City wrna.ld need all of the existing right-of way. Therefore, the Depa,�tment of
Pub].ic Works reco�nmends th�at the proposed vacation be denied.
The W�ter Utility states in its report tYrzt the street vacation as shvwn appears
to permit private property within 10 feet of the water main and even closer to
the Y�ydrant lead, based on information available to this office. It is their
standard to provide a minimum of 15 feet of clearance between water mains aud
private property. This standard keeps buildings at lea.st 15 feet fram the water
znains and minimizes the possibility of dama�e to buildings in the event of a
water main leak or brea.k. The petitioner ha.s sulasequently expressed his agree-
ment to cut�in� back his request to a 5 foot wide pareel, rather tha.n a lO f00'�
parcel to accommodate the Water Utility's concerns.
The Police Department objects to the vacation because the encroacYnnent into �the
right-of wa,y of Mystic Street would render the Mystic Street ri�ht-of way useless
as a street, while the City's liabilities and responsibilities would not be
lessened.

The staPf of the Department o� Planning and Econanic Develo�xnerrt has no ob�ection
to the va.cation.
The District I Community Council ha.s stated it has no objection to the proposed
vacation. They feel the vacation would serve to prevent any possible attempt
at construction of more road or structures at the Sauth end of Mystic Street.
1Qo other public or private agencies irivolved had any ob�ection to the vac�ation.
In 1968, a one foot by 20 foot area was vacated across �he street arxl north of
the sub�ect area as the result of a bui.lding encroacltiment. This previous va-
cation combined with the present proposal wauld constr�:�ct the right-of way to
an undesirable degree.
In view of the foregoing, specifically the possible fliture aeed for a11, of the
right-of wa,y, I recoannend that the vacation be denied.
However, should the Council on the basis of the public hea.ring determine that
the vacation be granted, it is reco�ended that the matter be referred ba.ck
to the Department of Firlance and Mana�ement Services for a supplemental report
that wauld set forth the terms and conditions that w _�.�ply to the vacation.

available to this office. It is our standard to provide a mini.mum of 15 feet
of clearance between water mains and private property. This standard keeps

The District 1 Comraunity Council has no objection to the
vacation of P�ystic Street requested by Da.rrell P. Butler. We
believe it to be in conformance with our Highwood Plan and we
believe it would also serve to prevent any possible attempt
at construction of more road or structures at the South end
of Mystic. This would be a positive constraint as the area
is not suitable for further development. We disagree with
Capt. Jyrkas� letter concerning this property and question
whether he made an inspection of the property or relied on
the poor city maps of the area. This� decision must be made
on site - not on paper.

I , the undersigned, the owner of lots 10-15 and 36-41, Block 7, Burlington
Heights Division 2, St. Paul , MN 55119 do hereby petition the City
Council , City of St. Paul , St. Paul , MN 55102, to vacate a 10-foot by
25 foot parcel of land located adjacent to the eastern edge of lots 37
and 38. The land was originally plotted to be a road; however, it is
not currently being used for that purpose and I understand there are no
plans to ever use it for that purpose.
A vacation is requested so that I can build a 24 foot garage on the only
logical place in the area. Scenic easement restrictions and the extreme
topographical conditions of the property precludes building anywhere on
the property except where indicated as described above and as depicted
in attachment 1. No garage currently exists on the property.
I have contacted representatives of the District 1 Community Council �
Valuations Office, City of St. Paul and the Water Utility Department,
City of St. Paul , informing them of my intent to build a garage on the
aforementioned property and they interposed no objection to my doing so,
The proposed garage, when and if built, will not interfere with either
the proposed nature trail or a fire hydrant located near lot 37.
The proposed garage will not be a detriment to the neighborhood and the
imnediate neighbors see attachment 2 support building of the garage on
the specified site.
Attachment 3 is statement of ownnership from the Ramsey County Abstract
Clerk.
Your attention to this matter is greatly appreciated.
