2. That a water utility easement be retained in
the following described area.
The North one-half of Hubbard Avenue
from the e�sterly line of North Avon
Street extended to a line 62 feet
east of and parallel to the said
easterly line of North Avon Street

trees are permitted within th�

structure, fixture or other objects
that will prohibit normal access to
water facilities for maintenance
purposes.
b) That no change from existing gra de

c) That no change in surfacing within

out written permission from the water
Utility.
d) That the petitioner, his successors
and assigns, fully indemnify, defend and
save harmless the Board of Wa ter
Commissioners, its officers, agents,

suits, actions or claims which
shall arise from any injuries or
damages received or sustain�d by
any 'break or leak in any service
pipe, water main or connection in

3. That the petitioner assume maintenance responsibility
of the 2-inch water service connection supplying
781 Hubbard, with the exception of the 2-inch control
valve which will remain the responsibility and
property of the Water Utility.
4. That the petitioner be respansible for securing from
the Order of the Eagles a written statem�nt to the
effect that they have no intentirn of requesting
the improvement of Hubbard Avenue be�ween Grotto
and St. Albans Streetsl an alternative condition is
the dedication of a cul-de-sac acceptable to the
Department of Public Works, said dedication to be
done in a manner and form acceptable to the City
Attorney.
5. That the petitioner agrees ta provide emergency
access to the satisfaction of the Department of
Fire and Safety Services.
6. That a specific easement be retained to protect the
interest of Northern States Power Company in
Hubbard Avenue.

Please consider this letter a petition to vacate tha.t paxt of Grotto
Street lying north of the extended north line of the alley in Block 3�
J. R. Weide's Re., to the south line of Hubbard Avenue, and Hubbaxd
Avenue from the extended easterly line of Lot 16, Block il, Butterfield
Syndicate Addition No. 2., to the easterly line of North Avon Street
extended.
The petitioners own all of the property abutting the portion of Grotto
Street to be vacated and all of the groperty abutting the south line
of Hubbard Avenue and Lots 1� 2� 3, and 4 of Block 4, �dinter's Addition,
and statement of ownership prepaxed by David '�T. Thurston is enclosed.
'�le desire to vacate this portion of Grotto Street and Hubbard Avenue
for the purpose of cohesive development. PIeither one of these streets
has ever been officially graded, and it is doubtful that they will be
in the future.

The petitioner desires to vacate certain portions of North Grotto Street and
Hubbard Averiue for the purpose of a more cohesive develapment in this area.
The streets that are proposed far vacation hav� never been graded or improved,
and camprise an area of appraxia�a.tely �+9,600 square feet. The adjoining lands
axe zoned I-1.
The Department of Public Works had no objection to the vacation, subject to a
Hubbard Avenue cul-de-sac dedicatian near the intersection of what is now
North Grotto and Hubbard Averiue. They feel that a cul-d�-sac is necessaxy when
a dead-end street is created, as would be the case with H�.ibb�rd Avenue between
Grotto and St. Albans Streets.
The City Planning sta,ff finds no objection to t he proposed vacation.
The Water Utility reports the existence oP water faeilities 3.n Hubbard Av�eriue,
and requests the retention of aa easement in that portion of H�abbard Avenue.
Northern States Power Company reports that there is a gas main and a gas service
in I�ub'bard Avenue, and. requests that an easement be retained to protect their
interests.
The petitioners have asked tY�at the cul.-de-sac requested by the Public Works
Department not be reg,uired.
Hubbard Avenue between Gratto and St. Albans Streets� which is the s�treet which
would be dead-ended, is an unimproved and ungraded street with a width of only
�+0 feet. Ixnproven�ent of this right-of way is unlikely. The north side oP the
street is railroad pruperty with a spur track actually i.n tk�e ri�ht-of way itselP,
which in �ffect further decreases the a]ready narrcyFr width. The south side of
Hubbard Avertue is cx�rned by the Order of the Eagles, which does nAt intend to
ever request the improvemen-� of <Hubbaxd Avenue.

The Public Works Department has stated that because of the presence of the spvr
track in Htiibbard Avenue they would not reg,uire the cul-de-sa,c dedication, provided
tha,t the Order of the Eagles submit a letter stating that they have no interest

There were no ather ob�ections os reservationa made by any ot�er public or private

Dear Mr. Donovans
A review of the proposed vacation of Grotto St. and Hubbard Ave. has been
completed.
Hubbard Ave. between Avon and Grotto Sts. is unimproved, 60 ft. wide, 624 ft.
long.
Hubbard Ave. between Grotto St. and the northerty extension of the East Line
of Lot 16, Blk. 11 , Butterfield Syndicate Add. No. 2 is unimproved, approxi-
mately 67 ft. wide and 70 ft. long.
Grotto St. is unimproved, 60 ft. wide and 124.3 ft. long.
The vacation of portions of public right-of-ways that result in dead-ended
remaining sections of publi� r' - f- enerall frowned u on. At
some future date, these said remaining dead-en e portions may be improved.
Maintenance, access, utility, turn-around, etc. , probtems usually become a
reality when these said portions are improved.
The dead-ending of Grotto St. from Pierce Butler Rte. north to the a11ey
right-of-way may not be a problem due to some access through the alley.
Therefore, a dedicated turn-around would probably not be required for
this short (144.3 ft.} dead-ended remaining portion of street.
The vacatian of a small portion of Hubbard Ave. , lying east of Grotto St. ,
creating a long 800 f ft. dead-ended street will create a problem when it
is improved, i .e. : maintenance, turn-around, u i �ty, etc.

permission from the Water Utilitp.

stall a control valve on the 6-inch water main in the Avon$ubbard intersect�an as
showa on the attached plan. The estimated cost to the petitione� for install.ing the
valve is $1�500,00. If the va],ve is install,ed, all water piping witl�in the vac�ted
street becomes the pxopertp pf the petitioner.

Dear Mr. Donovan:
This is to confirm your letter of August 29, 1978,
regarding the petition of 6 & S Rigging and Erection, Inc. and
Lange Brothers Building Material Company for the vacation of
that part of Grotto Street lying north of the extended
north line the alley in Block 3, Joseph R. Weide's Rear.,
to the south line of Hubbard Avenue. Also Hubbard Avenue from
the extended easterly line of Lot 16, Block 11, Butterfield
Syndicate Addition No. 2, to the easterly line of North Avon
St�eet ext�nc�ed.
* �his request to vacate will not hinder the fire department
but with one exception. Lange Brothers have been blocking this
area with a couple trucks during closed hours and it would be
difficult for ingress in case of fire. They have agreed to
put up a fence with gates that can be unlocked with our tools.
I also contacted the B & S Rigging and Erection Company and
they said this fence would not effect them.
