Hearing Date - Jarnlary 8, 1980 The petitioners, who own the abutting properties, desire the vacation in order to remodel and enlarge their �ara�es. The street deadends into a 30 foot high embankment, thus it is unlikely that the street will ever be improved to carry traffic. Tkro gara�es have been cons�ructed within the right-of-way of Riverview� Avenue just north of the sub�ect segment of Riverview without the benefit of a vacation proceeding. The area petitinned to be vaca.ted is 7,530 square feet and the adjoining lands are zoned RT-l. The Department of Public Works has reviewed the proposed vacation site. They report that the area is unimproved and is 60 feet wide by an average of 125.5 feet lor�. They have no objection to the vacation of this street. No other public or private agencies involved ob�ected to the vacation. There- fore, in view of the foregoing, I recommend the vaoation be approved sub�ect to the followin� terms and conditions: 1. Rive rview Avenue is undeveloped at this location and due to the conditions that exist, it is our opinion that future development is highly unlikely. At the rear of our property a steep bank rises approximately 25' and at the top of the hill, two garages have been constructed within the street easement area. At the present time, we would like to remodel and enlarge our garages as well as do extensive landscaping. However, we hesitate to do so without adequate access. We both use the street access as a driveway and this has been going on for many years. In closing, we request that you approve vacating the street easement that is undeveloped at the present time. Acquisition of the property is very important to both of us and after a great deal of research we cannot find any reason for the city developing the street now or in the future.
