' esolution � Presented By Referred To Committee: Date Out of Committee By Date �ESOLUTION CREATING MINNESOTA STATUTES SECTION 472A.11 ADVISORY BOARD FOR THE PROPOSED EAST SEVENTH STREET COrIlKERCIAL DEVELOPMENT DISTRICT AND APPOINTING MEMBERS THERETO WHEREAS; a) Minnesota Statutes Chapter 472A (the "Act") allows cities to create Development Districts and develop programs for their improvement pursuant to the Act; and b) Section 427A.11 of the Act requires cities of the first class to create an Advisory Board for each such proposed Development District and to consult with the Advisory Board prior to the creation of the Development Distxict; and c) The City of Saint Paul has been presented with a proposed program contemplating the creation of the East Seventh Street Commercial Development District, a Development District which is not substantially residential as that term is defined by the Act. NOW THEREFORE BE IT RESOLVED By the Council of the City of Saint Paul as follows: 1. An Advisory Board consisting of five members for the proposed East Seventh Street Development District is hereby created, three of the members shall be owners or occupants of real property located within the proposed district and two of whom who are representatives of the District 4 Community Council. The Advisory Board shall advise the City and the Administrator on the planning, construction and implementation of the development program, and ma.intenance and operation of the district after the program has been completed. The term of office for each member of the Advisory Board shall be two years. 3. The Advisory Board shall prepare its own By-laws and Rules, not inconsistant with this resolution, which it feels are required for its operation. 4. The staff of the Department of Planning and Economic Development shall make recommendations to and assist the Advisory Board and the Administrator as required. 5. Within thirty (30) days following its creation, the Advisory Board shall meet not less than twice to review and prepare recommendations regarding the Development Program. These recommendations shall be forwarded to the Admin- istrator and the City Council for review prior to the City Council's adoption of the Development Program. 6. Subsequent to the adoption of the Development Program, the Advisory Board shall hold a meeting on the third Wednesday of each month to review the pro- gress of the implementation of the Development Program until all of the projects proposed in the Development Program have been a. contractually committed for implementation, or b. formally terminated by the Administrator if contractual commitments have not been received for that part of the redevelopment actively within 180 days from the adoption of the Development Program. 7. Subsequent to the contractual commitments for all viable projects or the expiration of the 180-day period from the adoption of the Development Program, whichever is first, the Advisory Board shall meet on the first Wednesday of each quarter until all of the construction activities undertaken in accordance with the Development Program have been completed ("Construction Phase") to monitor the construction activities. 8. In the event of a confli,ct between the Advisory Board, the Administrator and/or the Planning Commission, the parties shall submit their recommendations in writing to the Council at its next regularly scheduled meeting and the Council shall render its decis3on regarding the conflicting recommendations within thirty (30) days and the decision of the Council shall be binding upon all parties. 10.
