RESOLVED, that upon execution and delivery of a release in full
to the City of St. Paul, the proper City officers are hereby
authorized and directed to pay out of the Tort Liability Fund
09070-511-000 to Elmer Streich the sum of $750.00 in full settle-
ment of his claim for damages sustained February 9, 1979; March 2,
1979; and June 7, 1980, as a result of sewer backups at his home
located at 435 Burlington Road, Saint Paul.

RE: Claim of Elmer Streich against
the City of St. Paul
This case involves a sewer at 435 Burlington Road in St. Paul.
The homeowner has had three occurrences of sewer backup in his
basement and has expended time and money in having that cleaned
up.
Initially, the sewer department was not certain that the problem
was with the design of the sewer itself, but they have now cha,nged
their mind and recommended the settlement of this claim.
This office approves the settlement of this claim in the amount
of $750.
