bought the building in January, 1978, he had completed a Iong ].ist �f
repairs and had vacated four units that Iacked a t�rindo�r tha.t could be

rooms shared by 14 persons . He introduced Mxs. Neimann, who hacl been
caretaker of the building for 39 yeaxs . He saa.cl a7.I. the tenants of t;hE�
rooms in question had come with him taday ancl would Ue ��a.17_ing to 2�tt�st
to the cleanliness and comfort of their raoms� A11 were men between the
age of 60 and 85, and some had special dietary needsg t�rhi.ch made �he
i�div�.dual cooking facilities important to th�m.
Mr. McCausland said that apparently the buil:d_a��g Iiad heen operatec� as
it was today for many previous years with no objectiuns �ram authar5t3_cs .
It had been noted, hoi�ever, at an inspectiax� �nacie July 7.0 , Z980 , and at
w�:s felt that the situation should receive s�me a�tent-a.on sa:i-�ce it. was
� being aperated in violation of health ancl housing codes. He fel.t no
serious objections ta continuing the eurre�it mannex af. c�gexation, t�ut
also felt it should be clarified.
Ms . Bij jani said,from her understanding, vaha� was needed Zoras a varianr.e
on the shared baths . She suggested that one additianal shoiv�x ox t:tih
facility would be advisable.
Mr. McCausland said this would satisfy state eodP requixements , a�.t:haugh �
the city code is more stringent.
Chairman ti'Vozniak commented that occupancy of each uni'C should probab�y
be restricted to one person. Mre Roach said thi.s would be no problem,
that there never had been more than one person pex unit.

PROCEEDINGS : Chairman tiNozniak called the board� s attention to a l.etter
rom District Eleven Coalition, dated 9/3/80 , objecting to the gran�ing
of any variances on this property.
1�1r. Koenig said he had talked to some of the members of the coalition to
let them knoi�r what he intended to do to improve his pronerty. He said

� there had been some favorable reaction , but evidently not enough members
ti�ere so persuaded. He explained that he had applied for perrnits to
remodel �yhat he had thought was an existing basement apartment . Permits
had been issued and he started work, and to date had spen't about �8,000.
Then he learned that he would need a change of zoning status to operate
three units . He had gone before the Zoning Board and his appeal had been
denied, so he could only operate as a duplex. In order. to reeover some
of his investment, he decided to change the basement unit to three bed-
rooms and add them to the first floor two-bedroom apartment, thereby
making it a five-bedroom apartment, with th� possibility of chargi.ng �
higher rent.
his. Bijjani said there had been a misunderstanding as to ��hat Mr. t:oenig
planned to do at the time the building permit was issued. Othexwise, he
might have been advised against the project and have avoided spenda.ng
his money on it. ° -
Dir. Koenig said all he �vanted to do was to improve the existing a}�axt-
ment. He had pulled a permit to add another entrance to improve the
safety of tenants . The unit was vacant at the time he bot�gh't the propFrtx,
but he had assumed it had been rented in the past because it had a kitc:hen
and was laid out as an apartment . The seller had not specifical7.y
sold the property as a three-unit building, but neither had he said a�
was not . Mr. Koenig said he had just thought it needed upgrading� to
make it a rentable unit , but had since learned otherwise . He ha.d �;one
to all hzs neighbors prior to his appeal to the Zoni.ng Board to aT7ocv�
a third unit and had obtained signatures of all agreei.ng to his plan,
so he felt sure there would be no objection from �hem i.f. he i��ere alloti��d
y to use the space as bedrooms .
Ms . Bijjani said some members of the district were concerned �ha�Y 1�'fr.
Koenig might be attempting to circumvent the zoning 1aw by renta.il,�; our
the bedrooms separately, while claiming to make them part of tlxe firsL
floor unit. HotJever, it would be illegal ta rent ta mar� 'chan fc�tzr
unrelated persons in a duplex zane.

a suggestion from Ms. Bijjani that an additional stair�aa.y he provided.
bir. Koenig agreed that this was needed and 'said �here t�as a space f:o
install it.
�Zs . Bij j ani pointed out several violations that r.equ�.xed at 4entzon i� �
the basement was to be used for living space , such as the need far larger
windows .
Mr. Koen�g said he was aware of this , but he had �o �ind aut fixst ��thc�the�-
it could be used at all before he snent more money. He said he was �v�all.in�
to do whatever necessary and asked that an insnector come� aut and advise _
him exactly what should be done ,if allowed to use the space. Thexe ���exe
two things that could not be done , one , exposing the other �c1S�lll�ylt: SSc'2� � y
and, two, lowering the floor.
BOARD ACTION: Mr. Tieso moved to grant variances of Sections 5�1. 13(a)
and 54. 13�, pertaining to ceiling height and occupaney of rooms more
than SO% below grade , respectively, on condition that all remaini.ng
code requirements are met, and that an additional stair��ray be i.nstalled
from the first floor to the sleeping room area of the basement. rir. Gaus-
man seconded. MOTION CARRIED AND SO ORDERED. �
