WHEREAS, it has come to the attention of the City Council that certain
mapping errors were made on zoning maps 27 and 28 of the Saint Paul Zoning
Ordinance which was adopted on October 23, 1975, the errors being in the
vicinity of Grand Avenue and Oakland; and
WHEREAS, it also appears that some of the current zoning in this area
may be inappropriate, given existing land-uses, plans for future land-use,
and the overall needs of the community; and
WHEREAS, the specific area of concern pertains to those properties lying
in an area defined by a line running generally east from Dale Street along
Surr�nit Lane to Western Avenue, south along Western Avenue to Pleasant Avenue,
southwest along Pleasant Avenue to St. Albans Street, northwest along
St. Albans Street to Fairmont Avenue, east along Fairmont Avenue to Dale
Street, and north along Dale Street, which area is greater than 40 acres ; and
WHEREAS, the Saint Paul City Council is authorized under Minnesota
Statutes, section 462.357(5) and section 64.210 of the Saint Paul Legislative
Code, to initiate a 40 Acre Study for the purpose of amending the Zoning
Ordinance to correspond to the comprehensive plan and to correct the mapping
errors, subject to the review and recommendation of the Planning Commission;
and
WHEREAS, it has been recommended that the City Council adopt an interim
moratorium on all proposed developments within the above described area
during a six month period so as to allow a sensible and comprehensive zoning
study to be made by the Planning Commission and City Council ;

NOW, THEREFORE, BE IT RESOLVED, that the Saint Paul City Council does
hereby initiate a 40 Acre Study pursuant to Minnesota Statutes, Section 462.357(5)
to determine the appropriate zoning lines and zoning classifications for the
area described above and contained on existing zoning maps, pages 27 and 28, and
does hereby request that the Planning Commission conduct a study and report its
findings in accordance with the said Minnesota Statutes, Section 462.357(5); and
BE IT FURTHER RESOLVED, that from this date the Building Inspector shall
cease and desist from issuance of any building permits until six months from
the date of this resolution, other than those permits which may be necessary
for repair of or alteration of presently existing structures, which repairs or
alterations do not change the existing use of such structure.
