WHEREAS, The City Council of the City of Saint Paul, by
Council Resolution C.F. 275096 adopted June 17, 1980, entitled
"Final Order In Condemnation Proceedings" did order the con-
struction of a permanent drainage easement on, over and across
property owned by Mary Hegner and more specifically described
in Exhibit A, herewith attached and made a part of this Reso-
lution; and
WHEREAS, Said Council by Council Resolution C.F. 275590,
adopted August 26, 1980 entitled "Resolution Ratifying and
Confirming Condemnation and Award of Damages and Assessment
Therefor" , did ratify and confirm the award of damages in the
amount of $750.00 to the owners for the taking of said property;
and
WHEREAS, The owner of the property has refused to accept
said payment of the award thereby precluding the City from going
onto the property to construct the necessary drainage system;
and
WHEREAS, Section 13 .03.8 (2) of the Saint Paul City Charter
in part provides that the City may pay the award to the Clerk
of the District Court for disbursement under the direetion of
the Court if the owner refuses to accept payment of the award;
and
WHEREAS, Section 13 . 03 .3 (2) of the Saint Paul City Charter
in part provides that upon payment of the award into the Court
the City shall thereafter have the right to enter immediately
upon the property appropriated for the purpose of construction of
the improvement.

NOW THEREFORE BE IT RESOLVED that the proper City officials
are hereby authorized and directed to deposit into the District
Court of Ramsey County the aforementioned award of damages to
the property of Mary Hegner.
BE IT FURTHER RESOLVED, that upon deposit of said award with
the Clerk of District Court the City pursuant to Section 13 .03 .3 (2)
shall be vested with the easement to the subject property as des-
cribed in Exhibit A, and the appropriate City officials are
hereby authorized and directed to commence construction of the
drainage easement.
BE IT FURTHER RESOLVED, that upon deposit of said award
the appropriate City officials are authorized and directed to
file with the appropriate office of recordation in Ramsey County,
this Resolution evidencing the vesting of the City's interest
in the subject property.

That triangular tract lying withinithe following described lines:
Beginning at a point of intersection of the north line of the platted alley in Block 1,
Budde's Addition and the east line of Lot 2, Block 1, Budde's Addition; thence westerly
on said alley north line to a point a distance of 10 feet, thence on a straight line in
a northeasterly direction to a point of intersection with the east line of said Lot 2,
a distance of 10 feet from the point of beginning measured northerly on the east line
of said Lot Z; thence southerly on the east line of said Lot 2 to the point of begin-
ning and there terminating.
Also, the northerly 10 feet of the southerly 10 feet of Lot 1, Block 1, Budde's Additio
Also, that part of the north half of the northeast quarter of the northeast quarter of
Section 20, Township 29, Range 24, lying east of Budde's Addition and further lying in

A public hearing having been had upon the taking and condemnation of the lands or easements therein, for the
above improvement, and the award of damages therefor, and also upon the assessment of benefits therefor, and the
Council having duly considered the same, now therefore be it
RESOLVED, That the taking and condemnation of the lands described in the annexed assessment roll, identified
by the signature of the Director of Finance and made a part hereof, and the awards of damages to the owners of such
lands for said taking and condemnation as set forth in said assessment roll, be and the same is hereby in all respects
ratified and confirmed.
RESOLVED FURTHER, That the said assessment of benefits, be and the same is hereby in all respects ratified,
and the same is hereby ordered to be submitted to the District Court for confirmation.
