Elmstrom and the Northwest District of the Christian and Missionary Alliance to rezone property at 1365 Englewood Avenue from RM-3 (High Density, High Rise Multiple Family Residential District) to OS-1 (Office Service District) in order to use the structure as an office building for general offices and administrative offices. On June 19, 1980, the Current Planning and Zoning Committee conducted a public hearing on this case, at which time the applicant requested an OS-1 zoning. One letter with four signatures was received in opposition. The District 11 Coalition submitted a letter in support of the proposed rezoning with some suggested restrictions primarily dealing with landscaping the proposed parking lot. The Committee recommended approval of the rezoning petition dependent upon the purchaser/applicants working closely with the District 11 Coalition regarding the appropriate landscaping of the proposed parking lot and that the staff very strongly explore in the site plan review process the possibility of closing the lot at night. The vote was 5 to 0 in favor of the rezoning petition. The Planning Commission considered the Current Planning and Zoning Committee's recorrmendation on June 13, 1980, and approved the petition dependent upon the above stipulations on a vote of 11 to 0. The matter of the requested rezoning is scheduled to be heard by the City Council on August 21 , 1980. SUFFICIENCY: The application was filed on a consent petition declared sufficient by the Finance Department on May 19, 1980; and received in the Planning Office on June 2, 1980. Twenty-three parcels were eligible, sixteen parcels were needed, and seventeen parcels were obtained. The purpose of the rezoning from RM-3 (Nigh Density, High Rise Multiple Family Residential District) to OS-1 (Office Service District} was stated on the petition as to use the structure as an office building. B. FRONTAGE & AREA: This rectangular corner property is composed of parts of two lots with a 124 foot frontage on Englewood Avenue and a 248 foot frontage on No. Albert Street, for a total area of 30,752 square feet. C. SITE/AREA CONDITIONS: The site is occupied by a 2-story red brick building set two to three feet above the grade of the sidewalk. The site is basically level and is located in a predominantly single family area. However, to the east is an elderly high rise (777 No. Hamline) to the south is Horton Park, and to the north is the Jue1 Fairbanks After Care Residence for chemically dependents. The site is nicely landscaped and has a large grassy area directly north of the bui7ding. The site is also a block away from a bus line and the more heavily traveled Minnehaha Avenue and Hamline Rvenue. � D. ZONING HISTORY: On March 8, 1974 the St. Paul Drug and Rehabilitation Center, which had occupied the building since January 1974 (through a lease from the Christian and Missionary Alliance) applied for a Special Condition Use Permit to continue operating. At the public hearing before the Board of Zoning on June 6, 1974 numerous residents expressed opposition to this commercial use in a residential zone as we11 as the great amount of traffic congestion which it generated. The Board of Zoning unanimously denied the application and gave the St. Paul Drug and Rehabilitation Center 120 days to vacate the building. This action was subsequently approved on appeal to the City Council on July 25, 1974. E. FINDINGS: 1 . The site was previously zoned "C" Residence. 2. The building was constructed in 1954 as a library for the Christian Bible College by the Christian and Missionary Alliance. 3. Between January 1974 and April 1976, the building was utilized as the St. Paul Drug and Rehabilitation Center. 4. The Building Department reports that the building obtained a certificate af occupancy as an educational building on May 19, 1978. In addition, it was found to be vacant in mid and late 1979 (6/19/79 and 10/3/79) by the Building Department when it was only used on weekends as a church. 5. The applicant has indicated that the building is currently used as the Northwest District office of the Christian and Missionary Alliance and as a Vietnamese and Hmong church on the weekends. 6. The property is currently being sold to Mr. Herbert A. Elmstrom and Mr. John Sauro who have signed a purchase agreement contingent on the successful rezoning of the nrnnerty to OS-1 . 7. According to the purchasers , one-third of the property is currently being used as office space by the Christian and P�issionary Alliance; therefore, a continuation of the existing use as office space makes a great deal of sense. A representative af the Christian and P�issionary Alliance, Reverend Barris also thought the building shoulu continue to be used as office space. . . �� S��� NORTHWEST DISTRICT OF CHRISTIAN AND MISSIONARY ALLIANCE (#8666) PAGE 2 E. FINDINGS CONT'D. - 8. The purchasers claim that they intend to use the building for general offices and administrative offices and have no intention of using it for retail uses. They have not made contact with any personal service uses and presently have no plans for including businesses of this type in the building. 9. The Physical Corr�nnittee of District 11 sent a letter to the Zoning Office on May 8 approving of the concept of using the building as a real estate office and suggesting that no retail uses be allowed and appropriate signage be included for the building. They also expressed a concern about how much of the green open space would be removed by a parking lot for this office building. This proposed rezoning was also discussed at their May i0, 1980 meeting, the results of which will be reported at the hearing. 10. The plan for required off-street parking inc]udes four rows of parking stalls in the rear of the building with access off Albert Street. The purchasers plan on providing some shrubbery along Albert as a landscaping buffer for the proposed parking lot. 11 . The purchasers indicated that the building was never used as a residerrtiaT structure and always as an office building and therefore do not see why it was previously zoned RM-3 which allows some office and retail uses as well. 12. The District 11 Plan's Land Use Map apparently indicates the land as 1ow density one and two family residential even though it lies in an RM-3 zone. 13. It appears that the original zoning of this property as RM-3 was in error and warrants strong consideration to another more suitable zone. 14.
