AN ORDINANCE GRANTING TO UNITED HOSPITALS, 333 NORTIi
SMITH AVENUE, SAINT PAUL, MINNESOTA, AND/OR ITS SUC-
CESSORS IN INTEREST, PERMISSION TO CONSTRUCT, OPERATE
AND MAINTAIN AN UNDERGROUND FU�L STORAGE TANK WHICH
EXTENDS APPROXIMATELY EIGHT FEET INTO WALNUT STREET
RIGHT-OF-WAY ADJACENT LOTS 1 AND 2, BLOCK 66, DAYTON
AND IRVINE'S ADDITION AND LYING BETWEEN 20 FEET AND
80 FEET SOUTHEASTERLY OF THE SOUTHEASTERLY RIGHT-OF-
WAY LINE OF PLEI4SANT AVENUE.
THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section 1 .
That permission and authority are hereby granted to United Hospitals,
333 North Smith Avenue, Saint Paul , Minnesota and/or its successors in inter-
eat, to construct, operate and maintain an underground fuel storage tank which
extends approximately eight feet into Walnut Street right-of-way adjacent Lots
1 and 2, Block 66, Dayton and Irvine's Addition and lying between 20 feet and
80 feet southeasterly of the southeasterly right-of-way line of Pleasant Avenue.
Section 2.
That the Director of the Department of Public Works is hereby authorized
to issue a permit to United Hospitals, for the construction, operation and
maintenance of an underground fuel storage tank according to approved plans
upon said permittee's compiiance with the following conditions:

e. That said permittee shall construct said underground fuel
storage tank entirely at its own expense, to the satisfac-
tion of the Director of Public Works in accordance with
approved plans on file in the Department of Public Works�
f. That said permittee shall pay the cost of publication of
this ordinance and of all resolutions or ordinances passed
in relation to said ordinance�
g. That said permittee shall pay the costs of administration,
engineering and inspection incurred by the Department of
Public Works due to this undertaking. Said costs are es-
timated to be a sum of Two Hundred Dollars ($200.00) to
be accounted for under a separate Department of Public
Works project number;
h. That said permittee expressly agrees to comply with Chapter
216 of the Saint Paul Legislative Code as amended pertaining
to street obstructions;
i . That said permittee shall notify the Construction Engineer
of the Department of Public Works five (5) working days
before construction begins and notify the same said Engineer
when construction has been completed to allow for a final
inspection;
j . That said underground fuel storage tank shall be removed by
and at the sole cost and expense of said permittee and/or its
successors in interest whenever the Council of the City of
Saint Paul shall by resolution determine such removat necessary
in the public interest and accordingly order the removal of
said tank from Walnut Street right-of-way;
k. That said permittee shall coordinate all work involving exist-
ing utility installations, public or private with the affected
utility companies or agencies;

1. That said permittee shall properly protect all excavations
made in the street right-of-way of Walnut Street so as to
avoid all damage or injury to persons or property, shall
properly filt and compact said street right-of-way to avoid
settling, and shall restore said street right-of-way to its
original condition, as per Section 19 of the Specifications
for Street and Sewer Construction, Department of Public Works,
City of Saint Paul , Minnesota, dated April 1 , 1959 as amended,
under the supervision and to the satisfaction of the Construc-
tion Engineer of the Department of Public Works;
m. That said permittee shall during the term of this permit, re-
store and repair all property whether public or private
damaged or which may be damaged due to the construction,
operation, maintenance and removal or presence of said under-
ground fuel storage tank provided for herein;
n. That said permittee shall , within thirty (30) days from and
after the publication of this ordinance, file written accept-
ance thereof, specifically agreeing to all the provisions,
terms and conditions herein, with the City Clerk;
Section 3
That this ordinance shall take effect and be in force
thirty (30) days from and after its passage, approval and publication.

ACTION REQUES7ED:
The attached ordinance wouid permit United Hospitals to install and maintain
an underground fuel storage tank which extends into Walnut Street right-of-
way. A portion of the tank will be located under the sidewalk and boulevard
on the southwesterly side of Walnut Street just southerly of Pleasant Avenue.
