BLUE - MAYOR I'11@ N O. � ouncil Resolu�tion Presented By Referred To Committee: Date Out of Committee By Date WI�REAS, SPH �Hotel Co. and Capital Hospitality Corp., d/b/a The Radisson Plaza, 411 Minnesota Street, have made application for the extension of the approved liquor service area under its on-sale liquor license to the Town Square Park; and ' WHEREAS, The Council finds that the licensee' s Hotel building abuts the Town Square Park Building and is compact and contiguous . with the Town Square Park; now, therefore, be it Resolved by the Council of the City of Saint Paul that the liquor service area under the on-sale license of SPH Hotel Co. and Capital Hospitality Corp. is hereby extended to include the Town Square Park, subject to the following conditions to which the applicant has consented: l. Liquor will be served only to private groups who are renting all or part of Town Square Park from the Division of Community Services, and liquor will be served only in the specific area as set forth in the rental agreement between the private group and the Division of Community Services; 2. No liquor will be served on the first, second, or third levels of the Park during hours in which re- tail merchants are open for business; and 3. As you know, the Radisson Plaza Hotel is immediately adjacent to and contiguous with Town Square. It is the desire of the licensee to sell or serve intoxicating liquors in Town Square Park on those occasions in which special events are held in Town Square Park. Request is therefore made, pursuant to Section 308 . 09 (b) of the Saint Paul Legislative Code that the council adopt a resolution permitting the licensee to sell or serve intoxicating liquors in Town Square Park. To the extent that Town Square Park is detexmined to be public property, within the meaning of Section 308 . 09 (f) of the Saint Paul Legislative Code, a waiver of the restriction contained therein is also requested. The permission requested herein may be made effective until the time the Minnesota Legislature enacts a statute permitting the sale of intoxicating liquors in Town Square Park under a special legislative authorization similar to that previously granted for Landmark Center, St. Paul Civic Center and Science Museum.
