RESOLUTION APPROVING "FUNDING IN LIEU OF
ASSESSMENT" AGREEMENT5 WITH OXFORD DEVELOPMENT
MINNESOTA, INC. AND SAINT PAUL AREA CHAMBER OF
COMMERCE FOR THE FIRST YEAR OPERATION, MAINTENANCE
AND PROGRAM COSTS OF TOWN SQUARE PARK AND
AUTHORIZING EXECUTION THEREOF
WHEREAS, Final Order C.F. 275183, adopted July 1, 1980,
called for special assessment financing for the costs of operation,
maintenance and program for the "Town Square" public space; and
WHEREAS, the Saint Paul Area Chamber of Commerce (Chamber)
has submitted an offer to obligate itself to $270,000 for the
operation, maintenance and program costs of "Town Square" public
space first year of operation if the City Council will agree to
defer the special assessment for said first year operation,
maintenance and program costs; and
WHEREAS, Oxford Development Minnesota, Inc. (Oxford) in consi-
deration for the operation, maintenance and program costs of "Town
Square" public space first year of operation will obligate itself
to $123,062 in cash and in kind services for said operation and
maintenance costs if the City Council will agree to defer the
special assessment for said first year of operation, maintenance
and program costs; and
WHEREAS, the City Council has determined by Amended Final Order
C.F. 275479 that for the first year commencing on August 13, 1980,
the costs of operating and maintaining the "Town Square" public
spaces should not be paid by special assessment but rather by joint
obligations of Oxford, Chamber and the City of St. Paul pursuant
to "Funding in Lieu of Assessment" Agreements �ntered into between
the parties.

NOW, THEREFORE, BE IT RESOLVED, that the "Funding in Lieu
of Assessment" Agreements dated as of August 13 , 1980 between
the City and Oxford and between the City and the Chamber are
hereby approved; and
BE IT FURTHER RESOLVED that the proper officers of the City
be and hereby are authorized and directed to sign said agreements
upon approval as to form by the Assistant City Attorney; and
BE IT FURTHER RESOLVED, that this Resolution is in no way
intended to waive any right to assess for costs ineurred in the
operation, maintenance, repair, reconstruction and/or program
of "Town 5quare" public space for year two and thereafter.
