WHEREAS, A public hearing before the City Council, having
been conducted on October 16, 1980 where all interested persons
were heard, and the Council having considered all the facts and
recommendations concerning the petition; now, therefore,
THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section l.
That the zoning map of the City of Saint Paul, Sheet No. 27,
as incorporated by reference in Section 60.401 of the Saint Paul
Legislative Code, as amended, is hereby further amended as follows:
That property located on the northwest corner of
Osceola and Randolph, being more paxticularly de-
scribed as the South 31 feet of the North 62 feet
of Lots 22, 23 and 24, Block 32, A. Vance Brown's
Subdivision of Stinson, Brown and Ram sey' s Addition
be and is hereby rezoned from R-4 to P-1.
Section 2 .
This ordinance shall take effect and be in force thirty (30)
days from and after its passage, approval and publication.

An Ordinance amending Chapter 60 of the
St. Paul Legislative Code pertaining to
zoning for the City of Saint Paul and
the zoning maps thereof.
WHEREAS, Pursuant to Minnesota Statutes, � 462 .357 and § 64.210
of the Legislative Code, Cherokee Agency, Inc. duly petitioned to
rezone the South 31 feet of the North 62 feet of Lots 22, 23 and
24, Block 32, A. Vance Brown' s Subdivisian of Stinson, Brown and
Ramsey's Addition, located on the northwest carner of Osceola and
Randolph, from R-4 to P-1 for the purpose of providing additional
parking for the adjacent branch banking office, the petition having
been certified by the Department of Finance and Management Services
on July 21, 1980 as having been cansented to by at least 67� of the
owners of the area of the property to be rezoned, and further having
been consented to by at least two-thirds of the owners of the
property situated within 100 feet of the total contiguvus de-
scriptions of real estate held by the same owner or any party
purchasing any such contiguous property within one year preceding
the date of the petition; and
WHEREA'S, The current planning cammittee on August 21, 1980
conducted a public hearing for the purpose of cansidering �he
rezoning petition, and, pursuant to Section 107.03 of the Admini-
strative Code, submitted its recammendation to the Planning Com-
mission that the petition be granted; and
WHEREAS, The Planning Co�nmission considered the rezoning
petition at its meeting held on August 22� 1980 and recommended
that the City Council approve the petition; and
WHEREAS, Notice of a public hearing before the City Council
on the said rezoning petition was duly published in the official

This is in regard to the petition of Cherokee Agency to rezone 469 S. Osceola
from R-4 to P-1 to expand their parking lot.
The issue was heard by the Zoning Committee of the Planning Commission on
August 21 , 1980. The Committee recorr�nended approval on a vote of 6-0.
The Planning Corrrnissaon concurred on a vote of 16-0 at their August 22, 1980
meeting.
The matter is before the City Council for public hearing on the 16th of
October 1980.

A. SUFFICIENCY: The applica��iorr. was filed o'n a consent petition, subscribed and sworn befare
a notary public on July 17, 1980, declared sufficient by the Finance Department on
July Z1 , 1980, and received in the P]anning Office on July 30, ]980. Twenty-one parcels
were eligible, 14 required and 14 signatures were obtained.
B. PURPOSE: The purpose of the rezoning is to provide additional parking space for
Cherokee State Bank's branch office at Randolph and Osceola Avenues.
C. SITE & AREA CONDITIONS: The �property is 31 feet along Osceola and 94 feet deep, for a
tota area of 2,9 4 square feet. An existing house on the site is being moved. Cherokee
State Bank brarich office is to the south, Machovec's Grocery to the east across Osceola.
Homes line Osceola on the west with St. Francis De Sales School to the northeast. To
the west of the bank, Randolph is a residential street.
D. HISTORY: The site was zoned commercial under the 1922 Zoning Ordinance and R-4 under the
�dinance.
` E. fINDINGS: :-: _ _ .
1 . The applicant proposes expansion of its existing parking area to serve a branch bank.
2. The draft St. Paul Land Use Plan indicates the west of Randolph and West Seventh as
part of a mixed use strip. The use of the site and rezoning to P-1 is an appropriate
land use under the draft plan.
3. The District 9 Plan encourages commercial activity at Randolph and West Seventh.
4. The provision of parking in a P-1 zone at this site will create a buffer between
residential uses to the north and the commercial activity at the Randolph, Osceola
and West Seventh intersection.
F. STAFF RECOMMENDATION: Based on findings 1 through 4, staff recommends approval of the
rezoning petition.

CHEROKEE AGENCY, INC. (#8712 : A petition to rezone from R-4 to P-] property

The applicant was present. There was no opposition present at the hearirrg.
Mr. Grochala showed slides of the site and reviewed his staff report with a
recommendation for approval of the rezoning.
Delmar Ohmann, 675 Randolph, representing Cherokee Aqency, stated he had nothing
further to add at this time.
Hearing no further testimony, Mr. Bryan closed the public hearing portion of the
P meeting.
Mr. Pangal made a motion to recommend approval based on findings 1 through 4 of
the staff report. Mr. Lanegran seconded the motion. The motion passed on a roll
call vote of 6 to 0.
