WHEREAS, the Secretary of the Department of Transportation is authorized to make grants for mass transportation projects; and WHEREAS, the contract for financial assistance will impose certain obligations upon the applicant including the provision by it of the local share of project cost; and WHEREAS, it is required by the U. S. Department of Transportation in accordance with the provisions of the Civil Rights Act of 1964 that the applicant will give an assurance that it will comply with Title VI of the Civil Rights Act of 1964 and the U. S. That the Mayor be and hereby is authorized to execute and file an application on behalf of the City of Saint Paul with the U. S. Department of Transportation for a Capital grant to aid in the financing of street and transit improvements in Lowertown Revitalization Project area in Downtown Saint Paul. 2 . That the Mayor be and hereby is authorized to identify sources of funds and execute and file with such application such assurances of the local share of the project cost as may be required. 3 . That the Mayor be and hereby is authorized to execute and file with such application an assurance or other document required by the U. S. Department of Transportation effectuating the purposes of the Civil Rights Act of 1964 . 4. That the Mayor be and hereby is authorized to furnish such additional information as the U. S. Department of Transpor- tation may require in connection with the application or the project. 5. That the Mayor be and hereby is authorized to set forth and execute affirmative minority business policies in connection with the project procurement needs; and be it FURTHER RESOLVED, that a certified copy of the resolution be forwarded with the grant application. STARR, CITY ATTORNEY :n � 647 City Hall, Saint Paul, Minnesota 55102 612-298-5121 GEORGE LATIMER MAYOR July 17, 1980 ����� Mayor George Latimer City of Saint Paul 347 City Hall Saint Paul, MN 55102 RE: Legal Opinion--City Legal Ability to Proceed with Street and Transit Improvements Re--Section 3 UMTA Capital Grant Application Dear Mayor Latimer: We have been asked to provide an opinion as to the legal ability of the City of Saint Paul (City) to proceed with street and transit improvements in the Lowertown Urban Revitalization Project Area in Downtown Saint Paul (the Project) under a Section 3 Capital Grant from the United States Department of Transportation pursuant to the Urban Mass Transportation Act of 1964 as amended. We have examined applicable statutes and Saint Paul City Charter and ordinances which relate to the City's right to make such improvements, its eligibility to receive and expend such grant funds for the purpose intended, and its legal capacity to agree to the terms and conditions imposed by the Federal Government in connection with making such grant. Based on the foregoing we are of the opinion that the City of Saint Paul as a public body, is fully authorized to carry out such work, to receive and expend Federal, State and local funds for such work, to contract with the United States of America for the purpose of receiving a grant under Section 3 of the Urban Mass Transportation Act of 1964 as amended, and to do any and all other things necessary for the successful completion of the Project.
