WHEREAS, The Council of the City of Saint Paul did meet on
May 28, 1980, to hear testimony concerning the recommendation of
the License Inspector that the Taxicab Licenses issued to Robert
Janecek, d/b/a Yellowbird, Inc. , be revoked; ax�d
WHEREAS, Copies of letters from Joseph F. Ca�`chedi, dated
May 5, 1980, and May 15, 1980, to Robert Janecek setting �'orth
the grounds for revocation were introduced in evidence; and
WI�REAS, Mr. Robert Janecek appeared together with his attor-
ney, James Miley, 7900 Xerxes Avenue, Minneapolis, Minnesota; and ,
WHEREAS, Mr. Carchecli testified that the increas�e in the
flagthrow from $0.80 to $1.00 was to be allocated to the Taxi-
Drivers' Health and Welfare Fund; and
WI�REAS, Mr. Carchedi testified that the benefits from the
fund had been cancelled because of the failure of Yellowbird,
Inc. , to make payments; and
WI�REAS, Carchedi testified that on April 4, 1980, he did
witness Taxicab No. 92, licensed to Yellowbird, Inc. , in the
operation of a driver appearing to be under the in�luence of
alcohol; and � .
WHEREAS, Carchedi testified that he had been informed orally
and in writing by eight drivers that they were independently
operating a taxicab which was licensed by the City to Yellowbird,
Inc. ; and

WHEREAS, John Swits, William Graves and other drivers admitted
that they were independently operating taxicabs, hiring their own
employees and paying Mr. Janecek for the use of a Yellowbird, Inc. ,
Taxicab License; and
WHEREAS, Mr. Janecek, President of Yellowbird, Inc. , testified
that he did not have any driver employees, that he did not directly
operate any taxicabs, and that all of his taxicab licenses were
being used by independent operators; and
WHEREAS, The Council found the operation of taxicabs by other
than the Licensee to be in violation of Section 152.14 of the Saint
Paul Legislative Code; and
WHEREAS, It was moved and seconded that the Taxicab Licenses
issued to Robert Janecek, d/b/a Yellowbird� Inc. , be revoked; now,
therefore, be it
RESOLVED BY THE COUNCIL OF THE CITY OF SAINT PAUL, That the
following Taxicab Licenses issued to Robert Janecek, d/b/a Yellow—
b ird, Inc. , are hereby revoked:
16; 20; 27; 32; 33; 41; 42; 51; 52; 53; 57; 58; 59; 62;
68; 75; 86; 92; 96; 103; and 110.
