AND BE IT I� [TRTHER RESOLVED, That, with the accompanying Utility Easement Certificates of Intended
Non-Use, filed voluntarily on behalf of Quest Corporation, Incorporated, Northem States Power
Company-Electric Distribution, and Northem States Power Company-Gas Distribution made a part hereof by this
reference and filed in the o�ce of the City Clerk of Saint Paul, the City, for itself and on behalf of these
corporations and departments, waives the right to the utility easements in the vacated area described above.

2 documented in Technology and Management Services Department File Number 14-1999, public

4 the herein stated exceptions easements within those public properties are hereby released.

10 This vacation shall be subject to the terms and condition of Chapter 130, codified March 1, 1981, of the
11 Saint Paui Legislauve Code as amended, and to the following conditions:

13 1. That the peutioners, their successors and assigns shall pay $500.00 as an administrative fee for
14 this vacation which is due and payable within 60 days of the effective date of this resoluuon.

2. The petitioner shall submit a second peation and diligenflp pursue the vacauon of Wells Street
between Walsh and Greenbrier; the alleys in Blocks 39 and 40 A.rlington Hiils Addition, the
remaining portions of Walsh and Weide Sueets south of Wells Street and the portion of Wells
Street abutting Lot 1, Block 2, Andrew Addition, as shown on the attached drawing, Exhibit "B".
3. The peutioner shall be responsibie for all costs associated with the removal of street lighting
within the vacated area and instaliauon of alternate power sources to accommodate remaining
lights outside ffie vacated azeas.
4. The petiuoner shall be responsible for all costs to maintain the City street light on the portion of
Wells Street west of Arcade Street and east of the southerly extension of the west line of Lot 1,
Block 2, Andrew Addition by backfeeding from Arcade Street.

The petitioner shall be responsible for the site grading and reconstruction of Wells Street from
the east line of Greenbrier Street to approximately 285 feet westerly, to the satisfaction of the
Department of Public Works and Housing and Redevelopment Authority of the Citp of Saint
Paul under an ordinance permit issued by Street Bngineering.

2 7. The petitioner shall be responsible for the consuuction maintenance and ongoing liabiliry of fhe
3 driveway entrance in Wells Street west of Arcade Street, which includes but is not limited to,

5 of the Department of Public W orks under an ordinance permit issued by Street Engineering.

The petitioner shall be responsible for the reconstruction of the intersections of York & Weide,
York & Walsh, Arcade & Wells, Greenbrier & VJells, and the ends of the vacated alleys where
they meet the existing public streets, to remove all appeazances of public right-of-way, to the
satisfaction of the Deparm�ent of Public Works, inciuding, but not limited to, new curbing ,
drainage structures sidewalk, boulevard, and signs.
The peutioner shall provide acceptable access to the properties on Wells Street between Payne
Avenue and W aish Street until said properties have been acquired and residents relocated.
The petiuoner shall accept ownership and responsibility for the existing 12" sanitary sewer in
York Avenue between Weide and Wa1sh Streets and the 9" sanitary sewer in Wells Street west of
the manhole 20 feet west of the center line of Arcade Sueet.
The petitioner shall be responsible for properly abandoning to the satisfaction of Saint Paul
Sewer i3tility the following existing sewer mains:
storm sewer in Wells Street, west of the manhole 46 feet west of the center line of Arcade
Street; and,
storm sewer in Upper Wells Street east of Greenbrier; and,
sanitary sewer in upper Weils Sueet between Walsh Street and 50 feet west of the center
line of Greenbrier Street.
The petitioner shall be responsible for protecting any survey monuments andlor property irons
wiffiin the vacated areas, with all costs to perpetuate said monuments to be borne by the
petitioner.
That a permanent utility easement sha11 be retained within the vacated area on behalf of the City
of Saint Paul, Board of Water Commissioners subject to the following property described as
follows:
All of that part of York Avenue between the east line of Walsh Street to the west line of
Weide Street; and,

save harmless the Boazd of Water Commissioners, its officers agents, employees,
and servants from all suits, action or ciaims which shall arise from any injuries or
damages received or sustained by any break in any service pipe, water main, or
connection in said reserved easement, arising out of or resulting from any action or
negligence of the petiuoner, its employees, agents or business invitees.
That a permanent uulity easement shall he retained within the vacated area to protect the interest
of Northern States Power Company-Gas Distribution in the foliowittg property described as
foliows:

of a11 easements in the property described in the property described as follows:
all that part of Wells Street east of the west line of Walsh Sueet and west of the southerly
extension of east line of the Lot 8, Block 31, Chas. Weide's Subdivision of Arlington
Hills Addition.
The purpose of this request is to construct the new Achievement Plus Elementary School.
I recently ta7ked with Dan Pahl of PED and he stated that NSP Gas Distribution no longer needs
to retain its easement for the York Achievement Plus School Project, as documented in the
Technology and Management Services file as vacation 14-1999 with the following property
description:
all that part of Wells Street east of the west line of Walsh Street and west of the southerly
extension of east line of the Lot 8 Block 31, Chas. Weide's Subdivision of Arlington
Hills Addition.
Please execute the enclosed certificate and retum it to the Rea1 Fstate Division, as addressed
above by 7(28(2000. Upon receiving the updated Certificate of Intended Non-Use the Rea1
Estate Division will amend the resolution of vacation 14-1999 to waiver the easement of NSP
Gas Distribution for the above described property.

The petitioner shall be responsible for the reconstruction of the intersections of York & Weide,
York & Walsh, Arcade & Wells, Greenbrier & VJells, and the ends of the vacated alleys where
they meet the existing public streets, to remove all appeazances of public right-of-way, to the

The peutioner shall provide acceptable access to the properties on Wells Street between Payne

The petitioner shall be responsible for the reconstruction of the intersections of York & Weide,
York & Walsh, Arcade & Wells, Greenbrier & VJells, and the ends of the vacated alleys where
they meet the existing public streets, to remove all appeazances of public right-of-way, to the
satisfaction of the Deparm�ent of Public Works, inciuding, but not limited to, new curbing ,
drainage structures sidewalk, boulevard, and signs.
The peutioner shall provide acceptable access to the properties on Wells Street between Payne
Avenue and W aish Street until said properties have been acquired and residents relocated.
The petiuoner shall accept ownership and responsibility for the existing 12" sanitary sewer in
York Avenue between Weide and Wa1sh Streets and the 9" sanitary sewer in Wells Street west of
the manhole 20 feet west of the center line of Arcade Sueet.
The petitioner shall be responsible for properly abandoning to the satisfaction of Saint Paul
Sewer i3tility the following existing sewer mains:
storm sewer in Wells Street, west of the manhole 46 feet west of the center line of Arcade
Street; and,
storm sewer in Upper Wells Street east of Greenbrier; and,
sanitary sewer in upper Weils Sueet between Walsh Street and 50 feet west of the center
line of Greenbrier Street.
The petitioner shall be responsible for protecting any survey monuments andlor property irons
wiffiin the vacated areas, with all costs to perpetuate said monuments to be borne by the
petitioner.

Dear Ms Determan:
The property owner of ISD 625 for 740 York Achievement Plus School has requested a waiver
of a11 easements in the property described in E�ibit "A". The purpose of this request is to
construct the new Achievement Plus Elementary School.
I recently talked with Dan Pahl of PED and he stated that NSP Power Company no longer needs
to retain its easement for the York Achievement Plus School Project, as documented in the
Technology and Management Services file as vacation 14-1999 with the following property
description:
all that part of Wells Street east of the west line of Wa1sh Street and west of the southerly
extension of east line of the Lot 8, Block 31, Chas. Weide's Subdivision of Arlington
Hills Addition.
Please execute the enclosed certificate and return it to the Rea1 Estate Division, as addressed
above, by4/14/2000. Upon receiving the updated Certificate of Intended Non-Use the Real
Estate Division will amend the resolution of vacation 14-1999 to waiver the easement of the
Water Utility for the above described propezry.
