WHEREAS, Patsy Monno applied to the Board of Zoning Appeals
for a variance from the strict application of the provisions of
61.101 (f) of the Saint Paul Legislative Code; and
WHEREAS, The Saint Paul Board of Zoning Appeals by Resolution
No. 8596 adopted April 8, 1980 denied this appeal; and
WHEREAS, Patsy Monno has appealed the decision of the Board
of Zoning Appeals to the City Council pursuant to the provisions
of Section 64.204; and
WHEREAS, The Council having considered the variance application,
the report of staff, the minutes and findings of the Board of Zoning
Appeals, does hereby
RESOLVE, That the Council of the City of Saint Paul does hereby
grant the variance request of Patsy Monno and the provisions of
Section 61. 101 (f) be and are hereby relaxed so as to permit the
addition of a 30th residential unit to the property at 2338 Marshall
Avenue; and, be it
FURTHER RESOLVED, That the City Clerk shall mail a copy of this
resolution to Patsy Monno, the Zoning Administrator, Planning Com-
mission and the Board of Zoning Appeals.

Dear Madam:
This is written in response to the appeal of 4Jillie Olmer and Patsy Monno
of a decision of the Board of Zoning Appeals to deny their request for a
variance of the Schedule of Regulations pertaining to minimum lot size
per room in an RM-2 Multiple-Family Residential District in order to allow
a 30th residential unit they added to their apartment building illegally,
without a building permit, in 1978. The area of the parcel would allow
32 rooms. The 6uilding at 2338 Marshall has legal nonconforming use status
far 29 one-bedroom apartment units, or a total of 5� rooms. The applicant
is requesting a variance to allow a total of 60 rooms.
A verbal opinion recently issued 6y Jerry Segal , Assistant City Attorney,
is applica6le to this case. Ne has informed the Board of Zoning Appeals
that they do not have the authority to grant density variances; a density
variance (i .e. , permitting more "rooms" on a parcel than allowed by
Section 61 .101 (f) of the Zoninc� Ordinance) would constitute a "use" variance,
which is prohibited 6y state law,
The Board of Zoning Appeals conducted a public hearing on the variance
request of Patsy Monno on March 25, 1980, and passed a motion to deny the
variance request on a roll call vote of 5 to 0. A formal resolution
denying the variance was passed by the Board of Zoning Appeals on April 8,
1980 b,y a vote of 7 to 0.
This matter is scheduled for hearing before the City Council on May 22, 1980.

The Council of the City of St. Paul will hold a public hearing in the Council
Chambers of the City Hall and Court House (third floor) at 10:00 A.M. on
. May 22, 1980 on the:
Appeal of Wi11ie Olmer and Patsy Monno to a decision of the Board of
Zoning Appeals regar.ding property at 2338 Marshall Avenue. This ap-
peal is to contest the decision of the Board of Zoning Appeals to
deny a variance to Patsy Monno to retain the use of a 30-unit apart-
ment building at 2338 Marshall Avenue. This property is located on
the southwest corner of Marshail and Otis Avenues and l,egally de-
scribed as: East half of alley vacant and adjacent and Lots 22 and
23, Block 46, Desnoyer Park.
