An administrative Resolution approving the terms and
conditions of a 1980 Memorandum of Agreement between
the City of St. Paul and the International Brotherhood of
Painters and Allied Trades, Local 61.
WHEREAS, the Council pursuant to the provisions of Section 12. 09
of the St. Paul City Charter and the Public Employees La.bor Relations Act
of 1971, as amended, recognizes the International Brotherhood of Painters
and Allied Trades, Local 61, as exclusive representative for those classes
of positions within the City of St. Paul certified by the Bureau of Mediation
Services under Case No. 73-PR-479-A for the purpose of ineeting and
negotiating the terms and conditions of employment for all full-time per-
sonnel in the classes of positions as set forth in the Agreement between
the City of St. Paul and the exclusive representatives herei.nabove referenced;
and
WHEREAS, the City through designatecl representatives, and the exclusive
representatives have met in good faith and negotiated the terms and conditions
of employment for the period May 1, 1980, through April 30, 1981, for such
personnel as are set forth in the Agreement between the City of St. Paul and
the exclusive representatives; now, therefore, be it
RESOLVED, that the Memorandum of Agreement, cited above, dated
as of the effective date of this Resolution, between the City of St. Paul and
the International Brotherhood of Painters and Allied Trades, Local 61, on

" MEMORANDUM OF AGREEMENT
This Memorandum of Agreement by and between the City of Saint Paul and the
International Brotherhood of Painters and Allied Trades, Local Union No. 61. _
In full settlement of 1980 negotiations the parties hereto have agreed as
follows:
1. Except as herein modified, the Agreement between the parties, entered
into October 6, 1978, shall be the basis of the forthcaming labor
agreement.
2, Appendix C of said Agreement shall be replaced with Appendix C which
is attached hereto and made a part hereof.
3. Appendix D of said Agreement shall be replaced with Appendix D which
is aCtached hereto and made a part hereof.
It is understood that the above settlement shall be recommended by the City
Alegotiator, but is subject to approval by the City Administration and adoption
by the Civil Service Commission and the City CounciL
IN WITNESS WHEREOF, the parties hereto have affixed their signatures this 5th

When performing the following types of work the rate of pay shall be sixty
cents ($ .60) per hour over the basic hourly wage rate of any class of positions:
Sandblasting, swing-stage work, erected structural steel
skeleton work, all bridge work, all exterior work where
safety belt or window jacks are used, spray painting and
when applying materials over 50% creosote and for appli-
cation of all two component epo�ry materials.
1'ite F.NII'LOYER agrees to pay $10.00 toward the cost of each pair of safety
shoes purchased by an Employee that is a member of this bargaining unit. The
EN�LOYER shall contribute for the cost of two pair of shoes per year and shall
not be responsible for any additional cost for any additional shoes thereafter.
This reimbursement of $10.00 per pair of shoes shall be made only after
investigation and approval by the immediate supervisor of that Employee. This
$10.00 per pair of shoes contribution to be made by the II�LOYER shall apply
only to those Employees who must wear protective shoes or boots for their
employment.

APPENDIX D
Effective May 1, 1980, the II�LOYER shall:
(1) contribute $ .55 per hour for all hours worked by participating
employees as defined in Articles 12.3, 12.4 and 12.5 covered by
this AGREEMENT, to a UNION designated Health and Welfare Fund.
�2) contribute $ .50 per hour for all hours worked by participating
employees as defined in Articles 12.3, 12.4 and 12.5 covered by
this AGREEMENT, to a Pension Fund.
(3) deduct $1.00 per hour from which payroll deduction has been made
for all hours worked by participating employees as defined in
Articles 12.3, 12.4 and 12.5 covered by this AGREEMENT, to a
Vacation Fund.
(4) contribute $ .09 per hour for all hours worked by participating
employees as defined in Articles 12.3, 12.4 and 12.5 covered by
this AGREEMENF, to a Apprenticeship Training Fund.
All contributions made in accordance with this Appendix shall be forwarded to
depositories as directed by the UNION.
The II�LOYER shall establish Workman's Compensation and Unemployment
Campensation programs as required by Minnesota Statutes.
Participating employees as defined in Articles 12.3, 12.4 and 12.5 covered
by this AGREEMENT, shall not be eligible for, governed by, or accumulate vacation,
sick leave, holiday, funeral leave, jury duty, or insurance fringe benefits
that are or may be. established by Civil Service Rules, Council Ordinance or
Council Resolutions.

, APPENDIX D (continued)
The F:NIPLOYER'S fringe benefit obligation to participating employees
as defined in Articles 12.3, 12.4 and 12.5 is limited to the contributions
and/or deductions established by this AGREEMENT. The actual level of
benefits provided to employees shall be the responsibility of the Trustees
of the various funds to which the EMPLOYER has forwarded contributions
and/or deductions.

ACTION REQUESTED
We recommend your approval and submission of this Resolution to the City Council.
PURPOSE AND RATIONALE FOR THIS ACTION:
This Resolution amends the 1978-1980 Mai.ntenance Labor Agreement between the City,
and the Painters Local #61. Appendi.x C and Appendix D are amended to refl�ct a
redistribution of the total package monies for the employees receiving the union fringe
benefits. A hourly amount of $. 25 is taken from the base rate and applied to the pension
contribution. The $. 70 deduction for vacation is increased to $1. 00.
Appendix C is also amended by adding a paragraph granting a reimbursement to the
emplpyee toward the cost of safety shoe s.
