THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN: Section 1 . That permission and authority are hereby granted to College Hill Assoc- iates , 162 College Avenue, Saint Paul , Minnesota and/or its successors. in interest, to keep and maintain a stairway on the southeasterly side of Col- lege Avenue at approximately 16 feet southwesterly of the southwesterly right- of-way line of West Sixth Street and a stairway on the southwesterly side of West Sixth Street at approximately 62 feet southeasterly of the southeasterly right-of-way line of College Avenue. � Section 2. That said permittee and/or its successors in interest shall forthwith furnish and detiver to the City of Saint Paul a Surety Bond in the amount of One Thousand Dollars ($1 ,000.00) for said stairways made and executed by said permittee and/or its successors in interest as Principal and a Corporate Surety Company duly authorized to transact business in the State of Minnesota as Surety to and in favor of the City of Saint Paul as obligee, conditioned to comply with all the terms of this Ordinance. Said Surety Bond shall remain in force and effect as long as said stairways or any part thereof remain within College Avenue or West Sixth Street rights-of-way; b, That said permittee and/or its successors in interest shall take out and maintain Comprehensive Protective Public Liability Insurance which shall remain in force and effect as long as said stairways are located on the public rights-of-way of College Avenue or West Sixth Street. This liability insurance shall fully indemnify, hold harmless and defend the City of Saint Paul , its agents, officers and employees from any and alt damages, claims , losses, judgments, suits or expenses on account of all claims of whatever nature arising out of or by reason of this permission and authority and by reason of the cantinued presence and existance or removal of said stairways. The tiability insurance shall be issured by an insurance com- pany ticensed to do business in the State of P1innesota and the premiums and all expenses incidental thereto shall be paid promptly by the permittee initially and upon renewal . Before any expiration , said permittee shall deposit with the City of Saint Paul a new certificate to replace any expiring insurance. The permittee and the City shall be named jointly insured with limits of liability indicated as follows; Bodily injury insurance ( including death) in an amount of not less than $250,000.00 for all damages arising out of bodily in- juries to or death of one person and subject to the same limit for each person , in a total amount of not less than $500,00�.00 on account of any c�ne accident. Property damage insurance in an amount of not less than $150,�00.00 for all damages to or destruction of property in any one accident and subject to that limit per accident. Further subject to a total of not less than $200,000.00 for all damages to or destruction of property during the policy period. The insurance coverage shall be automaticatly restored immedi- ately after the occurence of any accident or loss from which liability may thereafter accrue and the City of Saint Paul shall be notified at least 30 days in advance of the cancellation of the insurance coverage by the issuing insurance company; . ��C�Cp� � � ������ -3- c. That said permittee shall submit the necessary bond and in- surance documents to the Office Engineer of the Department of Public 4lorks. The Office Engineer shall submit said doc- uments to the City Attorney of the City of Saint Paul for review and if said bond and insurance are sufficient said documents shall be filed with tt�e Director of Finance and Management Services of the City of Saint Paul ; d. Said permittee expressly aqrees and undertakes to maintain the stairways in a safe and proper condition , to include placement and maintenance of adequate handrails and guards, as di rected and approved by the Di rector of Publ ic 4dorks , and to keep the stairways free and clear of any obstacles or snow; e. That whenever the Council of the City of Saint Paul , by its resolution, shall determine the discontinuance and removal of said stait'way(s) necessary in the public interest and ac- cordingly order the discontinuance and removal of the same from said location(s) , said stairway(s) shall be discontinued and rerioved from the subject public sidewalk area, which public sidewalk area shall be restored by the permittee at the permittee's sole cost and expense; f. That said permittee shall pay the costs for the publication of this ordinance and all related resolutions and ordinances; g.
